About approval of Rules on providing processing industry with domestic raw materials of the companies

According to the subitem 29) article 9 of the Law of the Republic of Kazakhstan "About industrial policy" PRIKAZYVAYU:

1. Approve the enclosed Rules on providing processing industry with domestic raw materials of the companies.

2. To provide to committee of industrial development of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order is entered after ten calendar days after day of its first official publication.

Rules on providing processing industry with domestic raw materials of the companies

Chapter 1. General provisions

1. These rules on providing processing industry with domestic raw materials of the companies (further – Rules) are developed according to the subitem 29) of article 9 of the Law of the Republic of Kazakhstan "About industrial policy" (further – the Law) and determine procedure by providing processing industry with domestic raw materials of the companies.

2. In these rules the following concepts and reducings are used:

1) the quoted period – the pricing period established in the range of the last month during which average value of the maximum and minimum prices published on London Metal Exchange (London metal exchange) to prior month of delivery is determined;

2) the conclusion – the letter of response to the applicant prepared by authorized body on the basis of examination;

3) domestic raw materials – the material intended for further industrial processing, made by the companies of the industry in the territory of the Republic of Kazakhstan;

4) producer of domestic raw materials – the legal entity, turning out products used for further industrial processing in the territory of the Republic of Kazakhstan;

5) authorized body in the field of the state stimulation of the industry (further – authorized body) – the central executive body performing management in the field of the industry in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination and participation in realization of the state stimulation of the industry;

6) the request – the statement of the established sample with appendix of necessary documents according to these rules;

7) the applicant – the subject of industrial and innovative activities;

8) examination – the research conducted by authorized body for the purpose of determination of feasibility or not feasibility in provision of domestic raw materials to the applicant according to the provided documents;

9) technology and technical assets – availability at the subject of industrial and innovative activities of production equipment for accomplishment of engineering procedures which application provides release of certain products.

Chapter 2. Procedure on providing processing industry with domestic raw materials of the companies

3. Domestic raw materials are provided to the subjects of the industrial and innovative activities oriented to production, included in the list of the priority goods approved according to the subitem 28) of article 9 of the Law.

4. Applicants on receipt of domestic raw materials are the subjects of industrial and innovative activities having technology and technical assets on production of priority goods from the corresponding raw materials in the territory of the Republic of Kazakhstan.

5. Provision of domestic raw materials according to these rules is performed by producers of the domestic raw materials issued in the territory of the Republic of Kazakhstan by deliveries based on the signed agreement on supply of raw materials signed according to the Standard agreement on providing processing industry with domestic raw materials of the companies (further – the Agreement) between the subject of industrial and innovative activities, producer of domestic raw materials and authorized body according to appendix 1 to these rules.

6. By consideration of the request for provision of domestic raw materials by authorized body expertize according to these rules is carried out.

7. The authorized body publishes the announcement of the beginning of order taking for provision of domestic raw materials in official mass media, places information on conditions and procedure for adoption of requests on the official website with indication of contact information of persons no later than 15 (fifteen) working days from the date of entry into force of these rules.

8. The authorized body performs order taking for provision of domestic raw materials on permanent basis.

9. The procedure of provision of domestic raw materials includes the following stages:

1) acceptance and consideration of requests by authorized body regarding compliance to requirements of these rules;

2) conducting examination by authorized body;

3) in case of the positive conclusion, the authorized body notifies producer of domestic raw materials and the applicant on the beginning of work on agreement signature.

In case of the negative conclusion the authorized body notifies the applicant on impossibility in agreement signature;
