About creation of Public institution Tunduk under the Ministry of digital development of the Kyrgyz Republic

For the purpose of proper and effective technical coordination of implementation of system of interdepartmental electronic interaction, electronic services, and also accomplishment of strategically important technical tasks in the sphere of digitalization of the Kyrgyz Republic, according to Articles 13, 17 and 26 constitutional Laws of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic", the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Create Public institution Tunduk under the Ministry of digital development of the Kyrgyz Republic (further - Organization).

2. Approve Regulations on Organization according to appendix 1.

3. Determine Organization the operator of the following elements of infrastructure of electronic control:

- system of interdepartmental electronic interaction Tunduk;

- State portal of electronic services;

- State system of electronic messages;

- Single system of identification;

- Register of infrastructure of electronic control;

- Register of basic information resources.

4. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 01.08.2022 No. 434

5. Bring in the order of the Government of the Kyrgyz Republic "About approval of Instructions for use the State portal of electronic services" of October 7, 2019 No. 525 the following change:

- in Item 2 of the word "The state company "Infokom" shall be replaced with words "Public institution Tunduk.

6. Bring in the order of the Government of the Kyrgyz Republic "About approval of the Regulations on the state system of electronic messages and rules of its use" of December 31, 2019 No. 745 the following change:

9. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About some questions of the Ministry of digital development of the Kyrgyz Republic" of November 15, 2021 No. 257 the following changes:

1) Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 13.12.2023 No. 675

2) in the Charter of the State company "Infokom" under the Ministry of digital development of the Kyrgyz Republic approved by the above-stated resolution:

- to declare the subitem 2 of Item 8 invalid;

- subitems 5, of the 6 and 8 Item 9 to recognize invalid;

- in Item 10:

paragraphs the fourth, the fifth, the sixth, the seventh, eighth and twelfth subitem 1 to recognize invalid;

declare subitem 2 invalid;

- to recognize subitems 3 and 20 of Item 11 invalid.

10. To the state company "Infokom" under the Ministry of digital development of the Kyrgyz Republic to transfer Organizations to fixed assets:

- elements of infrastructure of electronic control (system of interdepartmental electronic interaction Tunduk, Single system of identification, State portal of electronic services, State system of electronic messages, National monitoring system, Register of infrastructure of electronic control, Register of basic information resources);

- the equipment and fixed assets which are earlier received as a result of reorganization of the State company "Tunduk" under the State committee of information technologies and communication of the Kyrgyz Republic.

11. Determine that transfer by the State company "Infokom" under the Ministry of digital development of the Kyrgyz Republic of the equipment and fixed assets on balance of Organization is delivery, tax-exempt on value added, according to part 2 of article 288 of the Tax Code of the Kyrgyz Republic.

12. To the Ministry of Finance of the Kyrgyz Republic:

- in accordance with the established procedure by preparation of the bill of the Kyrgyz Republic "About introduction of amendments to the Law of the Kyrgyz Republic "About the republican budget of the Kyrgyz Republic for 2022 and the forecast for 2023-2024" to provide the corresponding changes following from this resolution;

- to provide annually in the republican budget financial resources in the amount of represented by Organization for ensuring functioning of information systems and activities of Organization.

13. To Administration of the President of the Kyrgyz Republic to place Organization indoors, with a total area of 421 sq.m, located to Bishkek, Ulitsa Toktonaliyeva, 96 for permanent placement of Organization.

14. To the ministry of digital development of the Kyrgyz Republic to perform state registration of the created Organization in judicial authorities and to take other measures following from this resolution.

15. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

16. This resolution becomes effective after seven days from the date of official publication.

2. The organization is subordinated organization of the Ministry of digital development of the Kyrgyz Republic (further - the Ministry).
