According to Item and paragraph one of part two of article 9 of the Law of Ukraine "About licensing of types of economic activity" the Cabinet of Ministers of Ukraine decides 24 parts one of Article 7:

Approve Licensed conditions of implementation of economic activity on transportation of passengers, dangerous goods and dangerous wastes by inland water, sea transport which are applied.

Licensed conditions of implementation of economic activity on transportation of passengers, dangerous goods and dangerous wastes by inland water, sea transport

General provisions

1. These Licensed conditions establish the exhaustive list of the documents enclosed to the application for receipt of the license and also the organizational, personnel and production requirements obligatory for accomplishment by subjects of managing who perform economic activity on transportation of passengers, dangerous goods and dangerous wastes by inland water, sea transport.

2. These Licensed conditions are obligatory for accomplishment by all subjects of managing (irrespective of their form of business and pattern of ownership) who perform or intend to perform economic activity on transportation of passengers, dangerous goods and dangerous wastes by inland water, sea transport and obtained the license for this type of economic activity.

3. In these Licensed conditions terms are used in such value:

services in transportation of passengers, dangerous goods and dangerous wastes by inland water, sea transport - implementation by the subject of managing of movement of passengers, dangerous goods and dangerous wastes by means of inland navigation vessels, ocean and small ships;

the vessel - the self-propelled or not self-propelled floating construction used for transportation of passengers, dangerous goods and dangerous wastes, and also towage, pushing or schalivaniye of other courts in which there are passengers, dangerous goods and dangerous wastes;

the shipowner - the subject of managing operating the vessel on its own behalf irrespective of whether he is owner of the vessel or uses the vessel on other legal causes;

the specialist in management of activities for transportation of goods - the physical person having the valid certificate of professional competence of carrier inland water transport.

Other terms are used in the value given in the Maritime Code of Ukraine, the Law of Ukraine "About licensing of types of economic activity" (further - the Law), the Laws of Ukraine "About transportation of dangerous goods", "About waste", "About inland water transport".

4. The license applicant submits the application to body of licensing by the method provided by part one of article 10 of the Law.

Application forms about obtaining license/expansion of implementation of type of economic activity; data on availability of material and technical resources and specialists necessary for implementation of economic activity in transportation of passengers, dangerous goods and dangerous wastes by inland water, sea transport; statements for renewal of the license; statements for suspension and renewal of action of the license in full or partially; statements for narrowing of implementation of type of economic activity are given in appendices 1, of 3, 5 - 8.

The list of the documents enclosed to the application for obtaining license/expansion of implementation of type of economic activity is given in Appendix 2.

5. To the statement for receipt of the license, in addition to documents, the stipulated in Article 11 Laws, are attached signed by the license applicant or person authorized by it such supporting documents:

data on availability of material and technical resources and specialists necessary for implementation of economic activity in transportation of passengers, dangerous goods and dangerous wastes by inland water, sea transport (appendix 3);

the list of documents in duplicate, enclosed to the application (appendix 4).

6. Persons having the documents issued in accordance with the established procedure confirming their qualification necessary for fulfillment of duties on the vessel are allowed to holding the posts of command structure for which assignment of rank is not provided and also members of crew.

The licensee shall conclude and have employment contracts with all hired specialists.

7. The licensee shall notify body of licensing on change of the data specified in the documents enclosed to the application for receipt of the license (except the information about the crew members of the vessel providing provision of the corresponding services). In case of such changes the licensee shall submit within a month to body of licensing the adequate notice in writing together with copies of the documents confirming corresponding changes.

8. The licensee shall adhere in the activities to personnel, organizational and production requirements taking into account type, appointment and the navigation area of the vessel (courts) which shipowner he is.

9. The licensee shall provide storage during effective period of the license of documents which copies went to body of licensing, and also the document confirming introduction of payment for licensing.

11. The licensee can provide services in transportation of passengers, dangerous goods and dangerous wastes by inland water, sea transport only by those courts, data on which were represented to body of licensing.
