About approval of the Procedure of the state registration of livestock capacities and operators of the market

According to part fifteen of article 44 of the Law of Ukraine "About veterinary medicine" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure of the state registration of livestock capacities and operators of the market which is applied.

2. This resolution becomes effective from the date of its publication and No. 1206-IX "About veterinary medicine" becomes effective along with the Law of Ukraine of February 4, 2021.

Procedure of the state registration of livestock capacities and operators of the market

1. This Procedure determines the procedure of the state registration:

1) the livestock capacities intended for content, cultivation, cultivation of domestic land animals, bees, objects of aquaculture, collection, production, conversion of reproductive material, and also other livestock capacities which are not subject to approval according to article 43 of the Law of Ukraine "About veterinary medicine" (further - the Law);

2) the operators of the market performing the activities connected with:

transportation of house ungulates for the purposes of export from Ukraine;

collection of house ungulates and/or poultry without capacity utilization, including operators of the market who perform sale or purchase of the specified animals.

2. In this Procedure terms are used in the value given in the Law.

3. The operator of capacities in whose management there are livestock capacities specified in the subitem of 1 Item of 1 this Procedure and the operator of the market performing the activities specified in the subitem 2 Items of 1 this Procedure shall provide (to direct) to territorial authority of Gosprodpotrebsluzhby the application for the state registration of livestock capacity / operator of the market according to this Procedure.

4. If during registration of animal, antiepizootic actions or by results of implementation of actions of the state control the unregistered livestock capacity (the operator of the market) which obligation of the state registration is established By the law is revealed, and information necessary for its state registration is obtained, the territorial authority of Gosprodpotrebsluzhby performs the state registration of such livestock capacity (the operator of the market) on own initiative what in writing reports to the operator of capacities (the operator of the market) within five working days from the date of the state registration about.

5. Each separate livestock capacity or group of capacities of aquaculture is subject to the state registration.

The group of the livestock capacities intended for content, cultivation and cultivation of animals of aquaculture (capacities of aquaculture) is registered at one registration number if:

1) capacities are located within the epizootic connected territory and all operators of capacities within the specified territory apply general system of biological safety;

2) capacities are in management of one operator of capacities and function within general system of biological safety;

3) animal aquacultures of the specified capacities constitute part of one epizootic unit.

6. The livestock capacity located at one address is considered separate livestock capacity. The location (residence) of the operator of capacities in which management there is such livestock capacity is considered the address of livestock capacity which is the vehicle or other personal estate.

Their location is considered the address of group of capacities of aquaculture.

7. The state registration of livestock capacities and operators of the market is performed by territorial authority of Gosprodpotrebsluzhby by entering of information about them into the State register of livestock capacities and operators of the market.

8. The state registration of livestock capacities and operators of the market is performed on a grant basis.

9. The application form about the state registration of livestock capacity / operator of the market which moves the operator of capacities (the operator the market) affirms Minagropolitiki.

10. The application is submitted by the operator of capacities (the operator of the market) or person authorized by it not later than three working days about day of the beginning of work of the livestock capacity specified in the subitem of 1 Item of 1 this Procedure or about day of the beginning of the activities specified in the subitem 2 Items of 1 this Procedure.

11. For implementation of the state registration of groups of livestock capacities which according to part five of article 44 of the Law are registered at one registration number one application is submitted (irrespective of amount of livestock capacities).

12. The application signed by the operator of capacities (the operator of the market) or person authorized by it moves in paper or electronic form. Filing of application is electronically performed according to requirements of the laws of Ukraine "About electronic confidential services" and "About electronic documents and electronic document management".

13. The operator of capacities (the operator of the market), is responsible for accuracy of the information, specified to them (or person authorized by it) in the statement.

14. The statement is registered territorial authority of Gosprodpotrebsluzhby in day of its receipt.

15. The operator of capacities (the operator of the market) shall report in paper or electronic form to territorial authority of Gosprodpotrebsluzhby about any changes of the data provided by part six of article 44 of the Law no later than five working days after approach of such changes.

16. The decision on the state registration of livestock capacity (the operator the market) is made by territorial authority of Gosprodpotrebsluzhby within one working day after receipt of the statement.

17. The copy of the decision on the state registration of livestock capacity or the operator of the market or about refusal in the state registration goes to the operator of capacities (the operator of the market) in paper or electronic form within one working day after its acceptance.
