Some questions of carrying out verification of assembly records of civil status

According to Item 10 of the Regulations on the Ministry of Justice of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 2, 2014 No. 228, I order:

1. Determine that:

assembly record of civil status which data correspond to the Algorithm of the automated verification of data of assembly records of civil status (further - the Algorithm) which is applied, is considered the checked (verified) system about what it by the automated method is given the status "is verified by system";

assembly record of civil status which data do not correspond to the Algorithm is considered not checked (not verified) system about what it by the automated method is given the status "is not verified by system";

assembly record of civil status on which the qualified digital signature of the official of department of state registration of acts of civil status is imposed is considered checked (verified) by the registrar about what it during its signing by the automated method is given the status "is verified";

imposing of the qualified digital signature of the official of department of state registration of acts of civil status when entering assembly records of civil status into the State register of acts of civil status of citizens (further - the register), modification of assembly records of civil status which contain in it is obligatory with the corresponding technical capability in the register.

2. In six-months time from the date of entry into force of this order to provide to the administrator Reestra:

conducting the automated verification of data of assembly records of civil status, the acts of civil status which are drawn up by departments of state registration by means of the software of the Register and entered in the Register according to the procedure, determined by the legislation based on which certificates on state registration of acts of civil status after January 01, 2009, on the Algorithm which is applied were granted;

realization of technical capability of imposing of the qualified digital signature of the official of department of state registration of acts of civil status when entering data of assembly records of civil status into the register and in case of modification of the assembly records of civil status containing in it.

3. Approve Changes in some regulatory legal acts of the Ministry of Justice of Ukraine which are attached.

4. To department of private law (Ferens E.) submit this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

5. This order becomes effective from the date of its official publication.

6. To impose control of execution of this order on the First Deputy minister Gorovts E. and the deputy minister concerning digital development, digital transformations and digitalization Orlov S. according to distribution of functional obligations.

Changes in some regulatory legal acts of the Ministry of Justice of Ukraine

1. The paragraph of the sixth of Item 2 of the Section IV of Rules of state registration of the acts of civil status in Ukraine approved by the order of the Ministry of Justice of Ukraine of October 18, 2000 No. 52/5, registered in the Ministry of Justice of Ukraine on October 18, 2000 for No. 719/4940 (in edition of the order of the Ministry of Justice of Ukraine of December 24, 2010 to state No. 3307/5) in the following edition:

"Check of compliance of data in the State register of acts of civil status of citizens to data of paper of assembly record of civil status during repeated issue of the certificate or the statement from the State register of acts of civil status of citizens is not carried out if reliability of assembly record of civil status is checked by the administrator of this Register automated by method or department of state registration of acts of civil status with imposing of the qualified digital signature of the official performing such check.".

2. In the Rules of modification of assembly records of civil status, their recovery and cancellation approved by the order of the Ministry of Justice of Ukraine of January 12, 2011 No. 96/5, registered in the Ministry of Justice of Ukraine on January 14, 2011 for No. 55/18793:

"Compliance of data in the State register of acts of civil status of citizens to data of paper of assembly record of civil status is not performed if reliability of assembly record of civil status is checked by the administrator of the State register of acts of civil status of citizens automated by method or department of state registration of acts of civil status with imposing of the qualified digital signature of the official performing such check.";

In Chapter 2.1 of the Section II of the Instruction for maintaining the State register of acts of civil status of citizens approved by the order of the Ministry of Justice of Ukraine of July 24, 2008 No. 1269/5, registered in the Ministry of Justice of Ukraine on July 25, 2008 for No. 691/15382:
