According to subitem 2.8 of Item 2 of the Presidential decree of the Republic of Belarus of April 18, 2006 "About payment for use of radio-frequency range" the Council of Ministers of the Republic of Belarus DECIDES: No. 240

1. Establish procedure for determination of the amount of annual, one-time payment and payment for selection of radio-frequency range according to appendix.

2. Make to the Ministry of Communications and Informatization explanations on application of this resolution.

3. This resolution becomes effective after its official publication.

Procedure for determination of the amount of annual, one-time payment and payment for selection of radio-frequency range

Chapter 1. General provisions

1. When calculating the amount of annual, one-time payment and payment for selection of radio-frequency range:

in all territory of the Republic of Belarus (except for radio-electronic means (further - RES) amateur and amateur satellite radio service) calculation of payment is made for use of radio-frequency range (further - RChS) in the territory of each settlement according to K3, coefficient specified in Chapter 4 (the table 4), and then the received values are summed up, except for the case provided in Item 16 part two;

in the territory of settlements value of coefficient K3 is accepted equal to the coefficient applied to the area in the territory of which this settlement, except for the settlements specified in table 4 of Chapter 4 is located.

Chapter 2. Calculation of the amount of annual and one-time payment for use of RChS

2. Calculation of the amount of annual payment for use of RChS is made by the legal entity, the individual entrepreneur and the citizen (except for radio fans) based on the data specified in permission to right to use of RChS by one RES.

For calculation data which are specified by the State inspectorate of the Republic of Belarus for telecommunication of the Ministry of Communications and Informatization (the republican unitary enterprise for supervision of telecommunication of "BELGIE", further - BELGIE) in the permission to right to use of RChS issued by it or in other type, stipulated by the legislation undertake.

3. When calculating the amount of annual and one-time payment are considered:

3.1. the primacy or secondariness of use of RChS specified in the decision of the State Commission on Radio Frequencies under the Security Council of the Republic of Belarus (further - the Commission). If in the decision of the Commission primacy or secondariness of use of RChS is not specified, then use of RChS on primary basis is accepted;

3.2. value of the band width of radio emission (further - ShPI) determined on the basis of class of radiation of RES specified in permission to right to use of RChS. ShPI value is expressed by three digits and single Latin letters (the letter is decimal comma and reflects dimension of significant figures). Shares of hertz and hertz are designated by letter N, kilohertzes - To, megahertz - M and gigahertzes - G. For RES creating radio signal of different classes of radiation the ShPI greatest value is used.

4. When using RChS:

4.1. the simplex radio networks and duplex radio networks with realization of technology of temporary duplex separation (further - TDD) any radio service consisting of base stations and repeaters, and also subscriber stations (wearable, portable and (or) stationary), calculation of payment is carried out only for use of this range by base stations and repeaters;

4.2. the simplex radio networks and duplex radio networks with realization of TDD technology of any radio service consisting of fixed subscriber stations, repeaters and (or) wearable (portable) subscriber stations, calculation of payment is carried out only for use of this range by fixed stations and repeaters;

4.3. the simplex radio networks and duplex radio networks with realization of TDD technology of any radio service consisting only of wearable and (or) portable subscriber stations, calculation of payment is carried out for use of this range by each subscriber station;

4.4. the duplex radio networks (except for radio networks with realization of TDD technology) consisting of base stations, repeaters and subscriber stations (wearable, portable and (or) stationary), calculation of payment is carried out only for use of RChS by base stations and repeaters;

4.5. the duplex radio networks of overland mobile radio service (except for radio networks with realization of TDD technology) consisting of fixed subscriber stations, repeaters, wearable and portable subscriber stations, calculation of payment is carried out only for use of RChS by fixed stations and repeaters;

4.6. the duplex radio networks (except for radio networks with realization of TDD technology) consisting only of wearable or portable subscriber stations, calculation of payment is carried out for use of RChS by each subscriber station, at the same time value of height of suspension of the RES antenna is accepted by equal 1,5 of m for wearable and 3 m for portable subscriber radio stations;

4.7. duplex radio networks of overland mobile radio service (except for systems of cellular mobile telecommunication and radio networks with realization of TDD technology) value of the calculated payment needs to be increased twice for accounting of the used radio frequencies by subscriber stations of this radio network.

5. When calculating the amount of annual and one-time payment for use of RChS:

5.1. the portable RES (except for systems of cellular mobile radio communication) established and operated on vehicles, value of height of suspension of the antenna is accepted equal 3 m, in other cases - 10 m;

5.2. and also in rooms (buildings) and on aircrafts, value of height of suspension of the antenna is accepted by the basic, stationary RES and repeaters established and used not on the Earth's surface (in mines, underground passages, underground constructions, etc.) equal 10 m;

5.3. the wearable and portable RES established and operated not on the Earth's surface (in mines, underground passages, underground constructions, etc.), value of height of suspension of the antenna is accepted equal 3 m;

5.4. RES of systems of cellular mobile telecommunication as value of radio frequency of radiation of bearing is accepted:

450 MHz for the standards using the range 450–470 MHz;

700 MHz for the standards using the range 694–790 MHz;

800 MHz for the standards using the range 790–862 MHz;

900 MHz for the standards using the range 925–960 MHz;

1800 MHz for the standards using the range 1805–1880 MHz;

2000 MHz for the standards using the range 1900–2170 MHz;

2600 MHz for the standards using the MHz 2483,5–2700 range;
