Based on paragraphs of the fourth or sixth of article 11 of the Law of the Republic of Belarus of December 25, 2005 "About quarantine and protection of plants" the Council of Ministers of the Republic of Belarus DECIDES: No. 77-Z

1. Approve:

Regulations on procedure for determination and designation of borders of quarantine phytosanitary zone, establishment, providing and removal of the quarantine mode (are applied);

The regulations on procedure for forming and use of fund of data on protection of plants (are applied);

The regulations on procedure and payment terms (are applied) by legal entities and individual entrepreneurs of quarantine phytosanitary actions and actions for protection of plants.

2. Ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 19.04.2024 No. 293

3. To republican state bodies to bring the regulatory legal acts into accord with this resolution.

4. This resolution becomes effective from the date of its official publication.

Regulations on procedure for determination and designation of borders of quarantine phytosanitary zone, establishment, providing and removal of the quarantine mode

Chapter 1. General provisions

1. This Provision developed according to the Law of the Republic of Belarus "About quarantine and protection of plants" (further – the Law), establishes procedure for delimitation and designation of borders of quarantine phytosanitary zone, establishment, providing and removal of the quarantine mode.

2. In the Provision the main terms and determinations in the values established by the Law are used.

3. The quarantine mode is set for the purpose of non-admission of entering and distribution of quarantine objects, and also localization and liquidation of the centers of infection with such objects.

4. The quarantine mode is set on the territories, the separate parcels of land, buildings, constructions, reservoirs and (or) places of warehousing.

Chapter 2. Determination and designation of borders of quarantine phytosanitary zone

5. The quarantine phytosanitary zone is determined proceeding from biological features of quarantine object, its type, stage of development, potential danger of distribution and degree of injuriousness.

6. Borders of quarantine phytosanitary zone are established by public institution "Main state inspectorate for seed farming, quarantine and protection of plants" and (or) its territorial organizations.

7. Designation of quarantine phytosanitary zone is made by drawing borders on maps or schemes with their binding to area objects.

Chapter 3. Establishment, providing and removal of the quarantine mode

8. In case of detection of the organisms similar on morphological features to quarantine objects, and also for identification in quarantine products of the latent form of infectiousness quarantine objects the state inspector on quarantine of plants selects and sends to the legal entities certified on conducting quarantine phytosanitary examination of quarantine products, samples of the quarantine products infected with quarantine objects or the allocated organisms for conducting quarantine phytosanitary examination.

9. In case of confirmation of availability of quarantine object (except cases of universal distribution of quarantine object) the public institution "Main state inspectorate for seed farming, quarantine and protection of plants" and (or) its territorial organizations bring in the relevant local executive and administrative organ idea of establishment of the quarantine mode with appendix of the following documents:

cards about carrying out quarantine phytosanitary observations;

the conclusion of quarantine phytosanitary examination confirming availability of quarantine object with indication of recommended quarantine phytosanitary actions;

the act of holding quarantine phytosanitary actions including system of actions for liquidation of the center;

cards or schemes with the put borders of quarantine phytosanitary zone.

10. Based on representation of public institution "Main state inspectorate for seed farming, quarantine and protection of plants" and (or) its territorial organizations the relevant local executive and administrative organ within one days makes the decision on establishment of the quarantine mode.

11. The public institution "Main state inspectorate for seed farming, quarantine and protection of plants" and (or) its territorial organizations immediately, but no later than three hours from the moment of adoption by local executive and administrative organ of the decision on imposing of quarantine of plants, informs legal entities and physical persons, including the individual entrepreneurs performing economic and other activity in quarantine phytosanitary zone on imposing of quarantine of plants, on establishment of the quarantine mode and responsibility for its violation.

12. In quarantine phytosanitary zone public institution "Main state inspectorate for seed farming, quarantine and protection of plants" and (or) its territorial organizations:

will organize holding actions for fight against quarantine objects, localizations and liquidations of their centers;

impose ban or restriction for use and export of certain quarantine products.

13. For the purpose of providing the quarantine mode it is forbidden:

sow (to plant) the seeds infected with quarantine objects and landing material of agricultural and other cultures;

use the parcels of land on which the quarantine mode is set, for production of agricultural production, promoting development and distribution of quarantine objects;

store products infected with quarantine objects in one room with not infected products;

store products infected with quarantine objects in bulk;

sell out of limits of quarantine phytosanitary zone products without passing of the state phytosanitary quarantine control (supervision) exercised by public institution "Main state inspectorate for seed farming, quarantine and protection of plants" and (or) its territorial organizations;

use on forage to the cattle the waste containing quarantine objects;

perform pasturage of animals on the pastures and pastures infected with quarantine objects;
