About introduction of temporary ban on export of grain crops out of limits of the territory of the Russian Federation
According to articles 29 and 47 of the Agreement on the Eurasian Economic Union of May 29, 2014, appendix No. 7 to the specified Agreement, Item 1 of part 2 of article 21 of the Federal law "About Bases of State Regulation of Foreign Trade Activity" and for the purpose of ensuring food security the Government of the Russian Federation decides:
1. Establish from March 15 to June 30, 2022 inclusive temporary ban on export from the Russian Federation of wheat and meslin (group of 1001 CN FEA EEU), rye (group of 1002 CN FEA EEU), barley (group of 1003 CN FEA EEU) and corn (group of 1005 CN FEA EEU) (further - grain crops).
2. The temporary ban specified in Item 1 of this resolution does not extend:
a) on the grain crops which are exported from the territory of the Russian Federation for rendering the international humanitarian assistance to foreign states based on decisions of the Government of the Russian Federation;
b) on the grain crops which are exported from the territory of the Russian Federation within the international transit carriages which are beginning and coming to an end outside the territory of the Russian Federation and also on the grain crops of the Russian Federation moved between parts of the territory of the Russian Federation through the territories of foreign states;
c) on the grain crops which are exported from the territory of the Russian Federation as supplies;
d) on the grain crops which are exported from the territory of the Russian Federation for the purpose of ensuring activities of the military forming of the Russian Federation which are in the territories of foreign states;
e) on the grain crops which are exported from the territory of the Russian Federation for the purpose of ensuring organization activity of the Russian Federation, located in Baikonur (Republic of Kazakhstan) and in the territory of the Baikonur complex;
e) on the grain crops which are exported from the territory of the Russian Federation for the purpose of ensuring organization activity of the Russian Federation on Svalbard archipelago;
g) on the grain crops which are exported about the territories of the Russian Federation issued according to the customs procedures allowing export of grain crops from the territory of the Russian Federation till March 15, 2022, except for grain crops which customs declaring was performed with the features provided by Articles 115 and 116 of the Customs code of the Eurasian Economic Union or with the features established by the legislation of state members of the Eurasian Economic Union on customs regulation according to Item 8 of Article 104 of the Customs code of the Eurasian Economic Union;
h) on the grain crops which are taken out from the territory of the Russian Federation to the Republic of Abkhazia, the Republic South Ossetia, the Donetsk People's Republic and the Luhansk People's Republic;
i) on grain crops when implementing transit international airborne transportations through the territory of the Russian Federation to the third countries in the following cases:
the aircraft makes intermediate landing at the international airport of the Russian Federation without unloading of grain crops and after intermediate landing follows out of limits of the territory of the Russian Federation;
the aircraft makes intermediate landing at the international airport of the Russian Federation with single overload of grain crops on other aircraft going out of limits of the territory of the Russian Federation (without their room under customs procedure of customs transit) provided that grain crops are under customs control and do not leave the check point through frontier of the Russian Federation;
j) on the grain crops which are exported from the territory of the Russian Federation based on the one-time licenses for export granted by the Ministry of Industry and Trade of the Russian Federation according to Item 7 of the order of the Government of the Russian Federation of December 31, 2021 No. 2595 "About measures for regulation of export of wheat and meslin, barley, rye and corn out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union";
k) on the grain crops which are exported from the territory of the Russian Federation for use by passengers and crew members water, aircrafts or passengers of trains and workers of crews of train, drivers of the automotive vehicles performing international carriages and also for ensuring activities of water vessels, constructions and installations concerning which the Russian Federation has the exclusive jurisdiction;
l) on the grain crops which are taken out from the territory of the Russian Federation to the Republic Belarus within the Union State;
m) on wheat and meslin seed (codes 1001 11 000 0, 1001 91 100 0, 1001 91 200 0 and 1001 91 900 0 CN FEA EEU), rye seed (code 1002 10 000 0 of the CN FEA EEU), barley seed (code 1003 10 000 0 of the CN FEA EEU) and corn seed (codes 1005 10 130 0, 1005 10 150 0, 1005 10 180 1, 1005 10 180 9 and 1005 10 900 0 CN FEA EEU), taken out from the territory of the Russian Federation to state members of the Eurasian Economic Union, in the presence of the export permits issued by the Ministry of Agriculture of the Russian Federation according to the procedure approved by the Ministry of Agriculture of the Russian Federation;
o) on grains of the corn bursting (Zea mays everta Sturt.) (from code 1005 90 000 0 of the CN FEA EEU).
3. To provide to the Federal Customs Service, Federal Service for Veterinary and Phytosanitary Surveillance, the Border service of Federal Security Service of the Russian Federation, the Ministry of Internal Affairs of the Russian Federation and the Federal Service of troops of national guard of the Russian Federation within competence control over the implementation of Items 1 and 2 of this resolution.
4. To the Ministry of Economic Development of the Russian Federation in accordance with the established procedure to notify the Eurasian economic commission on introduction of the temporary ban specified in Item 1 of this resolution.
5. This resolution becomes effective since March 15, 2022.
