According to part 2 and Item 8 of part 4 of article 18.1 of the Federal law "Charter of Road Transport and Urban Land Electric Transportation" Government of the Russian Federation decides:

1. Approve the enclosed Rules of exchange of the electronic carriage documents and data containing in them between participants of information exchange, the direction of such documents and data in the state information system of electronic carriage documents, and also submission of other information connected with processing of such documents and data from information system of electronic carriage documents in the state information system of electronic carriage documents at the request of the operator of the state information system of electronic carriage documents.

2. This resolution becomes effective since September 1, 2022 and is effective till September 1, 2028.

1. These rules determine procedure for exchange of the electronic carriage documents and data containing in them between participants of information exchange, the direction by the operator of information system of electronic carriage documents (further - information system) in the state information system of electronic carriage documents (further - the state information system), and also procedure for submission of other information connected with processing of the electronic carriage documents and data containing in them from information system in the state information system at the request of the operator of the state information system.

2. In these rules of the concept "participants of information exchange", "agreement on electronic document management of carriage documents", "electronic carriage documents", "consignor", "consignee", "carrier", "freighter", "freighter" and "container" are used in the values determined in the Federal Law "Charter of Road Transport and Urban Land Electric Transportation", the concept "driver" is used in the value determined in Rules of the carriages of goods by road transport approved by the order of the Government of the Russian Federation of December 21, 2020 No. 2200 "About approval of Rules of carriages of goods by road transport and about modification of Item 2.1.1 of Traffic regulations of the Russian Federation" the concept "the strengthened qualified digital signature" used in the value determined in the Federal Law "About the Digital Signature" and also the following concepts are used:

"identifier" - unique code of electronic carriage documents;

"the operator of the consignor" - the operator of information system who signed the agreement on electronic document management of carriage documents with the consignor;

"the operator of the consignee" - the operator of information system who signed the agreement on electronic document management of carriage documents with the consignee;

"the operator of carrier" - the operator of information system who signed the agreement on electronic document management of carriage documents with carrier;

"the operator of the freighter" - the operator of information system who signed the agreement on electronic document management of carriage documents with the freighter;

"the operator of the freighter" - the operator of information system who signed the agreement on electronic document management of carriage documents with the freighter;

"the file of exchange" - the XML file which is part of the electronic carriage document and consisting of separate data of the electronic carriage document.

3. The direction and receipt of files of exchange between participants of information exchange, and also the direction of files of exchange in the state information system are performed through information system in compliance:

a) with Rules of the direction of the electronic way bills and data containing in them in the state information system according to appendix No. 1 according to the scheme according to appendix No. 2;

b) with Rules of the direction of the electronic work orders and data containing in them in the state information system according to appendix No. 3 according to the scheme according to appendix No. 4;

c) with Rules of the direction of the electronic accompanying sheets and data containing in them in the state information system according to appendix No. 5 according to the scheme according to appendix No. 6.

4. Information exchange of participants of information exchange is performed on the basis of the principles of ensuring completeness, reliability, relevance and integrity of the information provided and received within information exchange, and also ensuring confidentiality of information, restriction of access to which is set by the legislation of the Russian Federation.

5. The state information system is operated on the basis of information provided by operators of information systems.

6. Representation in the state information system of information specified in Item 5 of these rules is performed from the moment of forming or correction of files of exchange on the established formats.

7. Operators of information systems provide compliance of information specified in Item 5 of these rules, to the established requirements to formats of files of exchange.

8. The operator of information system who signed the agreement with the participant of information exchange when obtaining from the participant of information exchange of the file of exchange performs verification of the file of exchange for compliance to format, on uniqueness of the identifier and check of validity of the strengthened qualified digital signature. In case of negative result of check to the participant of information exchange who constituted the file of exchange the notification on mistake then such file of exchange shall be created again goes.

9. The information system after submission of files of exchange in the state information system traces the status of processing of the file of exchange in the state information system. In case of identification by the state information system when processing the file of exchange of discrepancies (discrepancies, contradictions) in the data provided to the state information system by participants of information exchange, the operator of information system informs the participant of information exchange on need of entering of corrections into information containing in electronic carriage documents. In case of identification by the state information system of discrepancies in data participants of information exchange create the corresponding new (corrected) files of exchange no later than 5 calendar days from the date of receipt of information on need of introduction of corrections.

10. In electronic carriage documents corrections at the initiative of the participant of information exchange, except changes of the electronic way bill in part are allowed:

a) data of the consignor on transfer of load in case of cargo reception by carrier which structure is established by the format of the electronic way bill approved by the Federal Tax Service;

b) clauses and notes of carrier in case of cargo reception which structure is established by the format of the electronic way bill approved by the Federal Tax Service;

c) data on cargo reception by the consignee from carrier which structure is established by the format of the electronic way bill approved by the Federal Tax Service;

d) clauses and notes of carrier in case of issue of load which structure is established by the format of the electronic way bill approved by the Federal Tax Service.

11. Accuracy of the information, represented to the state information system, is confirmed by persons which signed documents by means of use of the strengthened qualified digital signature.

12. The operator of the state information system provides the round-the-clock processing of the electronic carriage documents and data containing in them and also the round-the-clock technical support, operation of program technical means of the state information system, smooth functioning of the state information system, possibility of information exchange with operators of information systems, accounting of the identifiers created and provided on requests of operators of information systems. Time of the answer of the state information system for data retrieval from information system constitutes no more than 10 seconds.
