About organ and tissue transplantation of the person

The purpose of this Law is regulation of the relations in the field of organ and tissue transplantation of the person.
Operation of this Law does not extend on:
organ and tissue transplantation, concerning reproduction of the person (ovum, sperm, ovaries, testicles or embryos);
autogenic (the living donor and the recipient are one person) organ and tissue transplantation;
the relations in the field of donorship of blood and its components.
The legislation on organ and tissue transplantation of the person consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about organ and tissue transplantation of the person then are applied rules of the international treaty.
In this Law the following basic concepts are applied:
brain death - the complete and irreversible cessation of all functions of brain;
human organ - the isolated set of various types of cages and fabrics performing certain function in human body;
tissue of the person - set of the cages and intercellular substance united by general origin, structure and the carried-out functions in human body;
the recipient - the person to whom transplantation of body and (or) tissue of the person is carried out;
the living donor - the person, voluntarily on a grant basis this the notarized written consent to withdrawal at it of bodies and (or) fabrics for transplantation;
transplantation - replacement at the recipient of the absent or damaged bodies and (or) fabrics not capable to perform the vital functions, the bodies and (or) fabrics withdrawn from the living donor or corpse of the person by carrying out surgery or manipulation.
Bodies and (or) the tissues of the person withdrawn from the living donor or corpse of the person whose list is determined by the Cabinet of Ministers of the Republic of Uzbekistan can be objects of transplantation.
Artificially grown up bodies objects of transplantation are not.
Cabinet of Ministers of the Republic of Uzbekistan:
provides realization of state policy in the field of organ and tissue transplantation of the person;
coordinates activities of relevant organs and organizations in the field of organ and tissue transplantation of the person;
determines the list of objects of transplantation, and also procedure for their transplantation;
establishes procedure for transportation of bodies and tissues of the person within the Republic of Uzbekistan, their storage, import to customs area of the Republic of Uzbekistan.
The Cabinet of Ministers of the Republic of Uzbekistan can perform also other powers according to the legislation.
Ministry of Health of the Republic of Uzbekistan:
participates in development of regulatory legal acts in the field of organ and tissue transplantation of the person;
creates and keeps the Unified state register of donors, recipients, and also bodies and (or) tissues of the person;
controls activities of the medical institutions of the state health care system performing withdrawal and organ and tissue transplantation of the person and also coordinates their activities and provides interaction;
provides interaction with the international and foreign organizations in the field of organ and tissue transplantation of the person.
The Ministry of Health of the Republic of Uzbekistan can perform also other powers according to the legislation.
Withdrawal and organ and tissue transplantation of the person are performed by medical institutions of the state health care system which list is determined by the Cabinet of Ministers of the Republic of Uzbekistan.
The medical certificate about need of organ transplantation and (or) tissues of the person is issued by specialists doctors as a part of the attending physician, the transplantologist, the anesthesiologist, the neuropathologist, in need of doctors of other specialties according to the procedure, established by the Ministry of Health of the Republic of Uzbekistan.
Organ transplantation and (or) fabrics from the living donor or corpse of the person can be applied only if other surgeries or manipulations cannot guarantee preserving life of the recipient or recovery of his health.
Organ transplantation and (or) tissues of the person to recipients is made on the basis of the medical certificate about need of organ transplantation and (or) tissues of the person.
Organ transplantation and (or) tissues of the person is performed from written consent of the recipient. At the same time the recipient shall be warned on receipt about possible complications for his health in connection with the forthcoming surgery or manipulation. This process is without fail fixed on video. If the recipient did not reach age of eighteen years or is acknowledged in accordance with the established procedure incapacitated or receipt of consent from the recipient is not possible, then organ transplantation and (or) tissues of the person is performed from written consent of his parents or other legal representative.
Removal of organs and (or) tissues of the person from its corpse is allowed in the presence of its lifetime notarized written consent.
The withdrawn bodies and (or) tissues of the person from its corpse can be used for transplantation to all needing persons.
Removal of organs and (or) tissues of the person from its corpse without the corresponding consent is illegal.
