1. Establish requirements to the legal entities performing activities for collection (procurement), storage, conversion and realization of scrap and waste of non-ferrous and ferrous metals in notifying procedure according to appendix to this order.

2. Declare invalid the order of the acting minister of the industry and infrastructure development of the Republic of Kazakhstan of May 4, 2020 No. 266 "About establishment of requirements to activities of the legal entities performing activities for collection (procurement), storage, conversion and realization of scrap and waste of non-ferrous and ferrous metals" (registered in the Register of state registration of regulatory legal acts for No. 20584).

3. To provide to committee of industrial development of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

5. This order becomes effective after sixty calendar days after day of its first official publication.

Requirements to the legal entities performing activities for collection (procurement), storage, conversion and realization of scrap and waste of non-ferrous and ferrous metals in notifying procedure

1. These Requirements to the legal entities performing activities for collection (procurement), storage, conversion and realization of scrap and waste of non-ferrous and ferrous metals in notifying procedure (further - Requirements), are developed according to the paragraph the second the subitem 39) of article 9 of the Law of the Republic of Kazakhstan "About industrial policy".

2. These Requirements include availability:

1) the specialized production base which is on the property right or other legal cause (the lease agreement, free use, trust management);

2) motor transport (load or other motor transport) which is on the property right or other legal cause (the lease agreement, free use, trust management) for transportation of scrap and waste of non-ferrous and ferrous metals;

3) the parcel of land with sidings for motor transport and/or access railway ways deadlocks on the property right and/or leases;

4) instructions for collection (procurement), storage, the conversion and realization of scrap and waste of non-ferrous and ferrous metals approved by the head of the legal entity;

3. The specialized production base includes:

1) places for storage of cylinders with oxygen and propane;

2) the enclosed space or places asphalted or having hard concrete or other surface for collection (procurement), storage and conversion of scrap and waste of non-ferrous and ferrous metals;

3) the storages or the closed metal containers for explosive scrap and waste of non-ferrous and ferrous metals equipped with fire extinguishing means;

4) service premises or portable cabins for accommodation of the working personnel;

5) the stationary or mobile weight lifting equipment which is on the property right or other legal cause (the lease agreement, free use, trust management), and also devices, on load-carrying capacity corresponding to the engineering procedure for carrying out these works approved at the company;

6) the equipment corresponding to engineering procedure at the company for cutting, cutting of scrap of non-ferrous and ferrous metals, and also the press and/or hydroscissors for conversion of scrap of non-ferrous and ferrous metals;

7) measuring instruments (automobile or railway scales and/or other measuring instruments) with the certificate on their checking in form according to the order of the Minister of investments and development of the Republic of Kazakhstan of December 27, 2018 No. 934 "About approval of Rules of carrying out checking of measuring instruments, establishments of frequency of checking of measuring instruments and form of the certificate on checking of measuring instruments" (it is registered in the Register of state registration of regulatory legal acts at No. 18094) (further - gages);

8) the dosimetric and radiometric equipment providing detection in scrap metal of the radioactive pollution exceeding the levels established in documents of regulation.
