About approval of Rules of rendering the state services in spheres of turnover of civil and office weapon and cartridges to it, civil pyrotechnic substances and products with their application

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Approve:

1) Rules of rendering the state services "Licensing for Implementation of Activities for Development, Production, Repair, Trade, Collecting, Exhibiting of Civil and Office Weapon and Cartridges to It" according to appendix 1 to this order;

2) Rules of rendering the state services "Licensing for Implementation of Activities for Development, Production, Trade, Use of Civil Pyrotechnic Substances and Products with Their Application", according to appendix 2 to this order;

3) Rules of rendering the state services "Issue of Permission to Opening and Functioning of Shooting Shooting Galleries (Shooting Ranges) and Stands", according to appendix 3 to this order;

4) Rules of rendering the state services "Issue of the Conclusion to Physical Persons on Import to the Territory of the Republic of Kazakhstan, Export from the Territory of the Republic of Kazakhstan, and also Transit through the Territory of the Republic of Kazakhstan of Single Copies of Civil Weapon and Cartridges to It", according to appendix 4 to this order;

5) Rules of rendering the state services "Issue of the Conclusion to Legal Entities on Import to the Territory of the Republic of Kazakhstan, Export from the Territory of the Republic of Kazakhstan and Transit through the Territory of the Republic of Kazakhstan of Civil and Office Weapon and Cartridges to It" according to appendix 5 to this order;

6) Rules of rendering the state services "Issue of Permission to Acquisition of Civil Weapon and Cartridges to It to Physical Persons", according to appendix 6 to this order;

7) Rules of rendering the state services "Issue of Permission to Acquisition of Civil and Office Weapon and Cartridges to It to Legal Entities", according to appendix 7 to this order;

8) Rules of rendering the state services "Issue of Permission to Storage, Storage and Carrying Civil Weapon and Cartridges to It to Physical Persons", according to appendix 8 to this order;

9) Rules of rendering the state services "Issue of Permission to Storage and Carrying Office Weapon and Cartridges to It to Workers of Legal Entities", according to appendix 9 to this order;

10) Rules of rendering the state services "Issue of Permission to Storage of Office Weapon and Cartridges to It to Legal Entities", according to appendix 10 to this order;

11) Rules of rendering the state services "Issue of the Authority for the Move of Civil Weapon and Cartridges to It to Physical Persons", according to appendix 11 to this order;

12) Rules of rendering the state services "Issue of the Authority for the Move of Civil and Office Weapon and Cartridges to It to Legal Entities", according to appendix 12 to this order;

13) Rules of rendering the state services "Issue of Permission to Acquisition of Civil Pyrotechnic Substances and Products with Their Application to Legal Entities", according to appendix 13 to this order;

14) Rules of rendering the state services "Issue of Permissions to Storage, Civil Pyrotechnic Substances and Products with Their Application", according to appendix 14 to this order.

2. Declare invalid some orders of the Minister of Internal Affairs of the Republic of Kazakhstan according to appendix 7 to this order.

3. To provide to committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

4. To impose control of execution of this order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Appendix 1

to the Order of the Minister of Internal Affairs of the Republic of Kazakhstan of March 27, 2020 No. 254

Rules of rendering the state service "Licensing for Implementation of Activities for Development, Production, Repair, Trade, Collecting, Exhibiting of Civil and Office Weapon and Cartridges to It"

Chapter 1. General provisions

1. These rules of rendering the state service "Licensing for Implementation of Activities for Development, Production, Repair, Trade, Collecting, Exhibiting of Civil and Office Weapon and Cartridges to It" (further – Rules) are developed according to subitem 1 of article 10 of the Law of the Republic of Kazakhstan "About the state services" and determine procedure for rendering the state service "Licensing for Implementation of Activities for Development, Production, Repair, Trade, Collecting, Exhibiting of Civil and Office Weapon and Cartridges to It" (further – the state service).

2. In these rules the following basic concepts are used:

1) the web portal of "the electronic government" www.egov.kz (further – the portal) – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

2) payment gateway of "the electronic government" (further – PShEP) – the information system automating processes of information transfer about carrying out payments within rendering the paid services rendered electronically;

3) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

Chapter 2. Procedure for rendering the state service

3. The state service appears territorial authorities of police (further – the service provider).

4. For receipt of the state service the physical person and legal entity (further - uslugopoluchatel) sends to the service provider by means of the portal the list of the main requirements to rendering the state service "Licensing for Implementation of Activities for Development, Production, Repair, Trade, Collecting, Exhibiting of Civil and Office Weapon and Cartridges to It" (further – the List of the main requirements) according to appendix 1 to these rules.

To Uslugopoluchatel by means of the portal the status about acceptance of request for rendering the state service, and also the notification with indication of date and time of receipt of result of the state service goes to "personal account".

5. The service provider in day of receipt of documents performs their acceptance and registration.

In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays reception of applications and issue of results of rendering the state service is performed the next working afternoon.

6. The employee of responsible structural division of the service provider (further – the worker of the service provider) within 2 (two) working days from the moment of document registration specified in subitems 1), 2), 3), 4), 5), 6) and 7) of Item 8 of the List of the main requirements checks completeness of the submitted documents and (or) data.

The data of identity documents, license for activities on development or production, either trade, or collecting, or exhibiting of civil and office weapon and cartridges to it, security activities, collection of money, about state registration of the legal entity, individual entrepreneur, about the documents confirming the property right to technological base, specialized workshop, specially equipped rooms for storage, realization of weapon and cartridges to it, hunting gunpowder, rooms for storage of collection weapon, the rooms equipped with the security alarm system with the locked show-windows, safes or metal cases, about lack of criminal record, administrative offenses, information on payment of the state fee, about availability of the higher technical education the service provider receives from the corresponding state information systems through "lock" of the electronic government.

In case of representation by uslugopoluchatel of incomplete document package and (or) documents the expired effective period, the worker of the service provider during the term specified in part one of this Item create motivated refusal in further review of the statement, according to appendix 2 (further – refusal) to these rules. The motivated refusal goes by means of the portal to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.

By provision uslugopoluchately complete document package and (or) data the worker of the service provider within 10 (ten) working days, performs check on compliance to their Qualification requirements and the list of the documents confirming compliance to them, for activities for development, production, repair, trade, collecting, exhibiting of civil and office weapon and the cartridges to it approved by the order of the Minister of Internal Affairs of the Republic of Kazakhstan of January 8, 2015 No. 5 (it is registered in the Register of state registration of regulatory legal acts No. 10352) (further – the Order No. 5).

At the same time within 1 (one) working day, inquiries are sent to territorial authorities of homeland security and territorial subdivisions by fight against extremism and terrorism and organized crime of the departments of police, for check of persons having access to weapon on accounting through fight against extremism, terrorism or organized crime it is performed on information systems of Committee on legal statistics and special accounting under the Prosecutor General's Office of the Republic of Kazakhstan and law-enforcement bodies, on availability of criminal record and administrative offenses.

Including check independently with departure is performed or inquiries are sent to city and district divisions of police agencies for carrying out inspection of rooms, in the order of storage conditions, safety and accounting of weapon and cartridges to it, on compliance to the established requirements of Rules of turnover of civil and office weapon and the cartridges to it approved by the Order of the Minister of Internal Affairs of the Republic of Kazakhstan of July 1, 2019 No. 602 (it is registered in the Register of state registration of regulatory legal acts No. 18961) (further – the Order No. 602), by results of check is drawn up the statement of check of object in form according to appendix 20 to the Instruction on the organization of activities of divisions of law-enforcement bodies for control in the field of turnover of civil and office weapon, the Minister of Internal Affairs of the Republic of Kazakhstan approved by the order of March 29, 2016 No. 313 (it is registered in the Register of state registration of regulatory legal acts No. 13694) (further – the Order No. 313).

In case of non-presentation by bodies of homeland security and divisions of police agencies of answers at the scheduled time of 10 (ten) working days according to article 25 of the Law of the Republic of Kazakhstan "About permissions and notifications" (further – the Law) licensing is considered approved.

7. The worker of the service provider within 3 (three) working days, considers results of checks and creates the license and (or) appendix to the license, in forms, according to appendix 3 and 4 to these rules.

In the presence of the bases provided in Item 9 of the List of the main requirements the service provider notifies uslugopoluchatel on the provisional solution about refusal in rendering the state service, and also time, date and the place (method) of carrying out hearing for opportunity to express to uslugopoluchatel line item according to the provisional solution.

The notification on hearing goes in advance, but not later than 3 (three) working days before completion of term of rendering the state service. Hearing is carried out no later than 2 (two) working days from the date of the notification.

By results of the hearing to uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider the positive result or motivated refusal in rendering the state service goes.

8. Aggregate term of rendering the state service by the service provider constitutes 15 (fifteen) working days from the moment of acceptance and registration of a statement.

9. Renewal of the license and (or) appendix to the license is performed in cases:

1) changes of surname, name, middle name (in case of its availability) physical person licensee;

2) re-registrations of the individual entrepreneur licensee, change of its name or legal address;

3) reorganization of legal person licensee in forms of merge, transformation, joining of legal person licensee to other legal entity, allocations and separations;

4) changes of the name and (or) the location of legal person licensee (in case of specifying of the address in the license);

5) address modifications of the location of object without its physical movement for the license granted on class "the permissions issued on objects" or for appendices to the license with indication of objects.

Renewal of the license and (or) appendix to the license is not performed in the cases specified in subitems 2), 4) and 5) to part one of this Item of Rules if changes of legal address of the individual entrepreneur licensee, location addresses of legal person licensee, the object location address for the license granted on class "the permissions issued on objects" or for appendices to the license with indication of objects occurred in connection with change of the name of settlements, names of streets according to requirements of the Law of the Republic of Kazakhstan "About the administrative-territorial device of the Republic of Kazakhstan".

Such address modifications of the licensees and objects specified in appendices to licenses are performed by means of integration of the state information systems.

10. For renewal of the license and (or) appendix to the license in the cases specified in subitems 1), 2), 3), 4) and 5) of Item 9 of these rules except for to reorganization of legal person licensee in forms of allocation and separation, the uslugopoluchatel sends to the service provider by means of the portal, the documents specified in the subitem 8) of Item 8 of the List of the main requirements.

In case of renewal of the license and (or) appendix to the license the worker of the service provider within 3 (three) working days from the moment of document registration specified in the subitem 8) of Item 8 of the List of the main requirements checks completeness of the submitted documents, data and (or) proper execution of the submitted documents.

In case of representation by uslugopoluchatel of incomplete document package and (or) documents the expired effective period, the worker of the service provider during the term specified in part two of this Item create motivated refusal in further review of the statement, according to refusal to these rules. The motivated refusal goes by means of the portal to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.

In case of completeness of the submitted documents the worker of the service provider, within 3 (three) working days from the moment of document registration, checks storage conditions of weapon and cartridges to him, by results of check the statement of check of object in form according to appendix 20 to the Order No. 313 is drawn up.

The worker of the service provider in the provided terms, considers results of checks and renews the license and (or) appendix to the license, in forms, according to appendix 3 and 4 to these rules, in case of circumstances, stipulated by the legislation the Republic of Kazakhstan, the permissions excluding possibility of obtaining creates motivated refusal in rendering the state service, with indication of causes of failure, on the basis stipulated in Item 9 Lists of the main requirements.

Results go by means of the portal to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.

Aggregate term renewal of the license and (or) appendix to the license by the service provider constitutes 3 (three) working days from the moment of acceptance and registration of a statement.

11. For renewal of the license and (or) appendix to the license in cases, reorganization of legal person licensee in forms of allocation and separation, the uslugopoluchatel sends to the service provider by means of the portal, the documents provided by subitems 1) 2), 3), 4), 5), 6) and 7) of Item 8 of the List of the main requirements.

Compliance or discrepancy of uslugopoluchatel to requirements of the Order No. 5, and also check and inspection of placements on compliance to requirements of the Order No. 602, is performed by the service provider according to the procedure, specified in Item 6 of these rules.

The worker of the service provider within 3 (three) working days, considers results of checks and renews the license and (or) appendix to the license, in forms, according to appendix 3 and 4 to these rules, in case of circumstances, stipulated by the legislation the Republic of Kazakhstan, the permissions excluding possibility of obtaining creates motivated refusal in rendering the state service, with indication of causes of failure, on the basis stipulated in Item 9 Lists of the main requirements.

Results go by means of the portal to "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the authorized person of the service provider.

Aggregate term of rendering by the service provider in case of renewal of the license and (or) appendix to the license by reorganization of legal person licensee in the form of allocation or separation, constitutes 15 (fifteen) working days from the moment of acceptance and registration of a statement.

12. If the license and (or) appendix to the license were issued in paper form, the uslugopoluchatel according to the statement transfers them to electronic format and receives electronic form of the license and (or) appendix to the license.

13. The worker of the service provider provides entering of data into information system of monitoring of rendering the state services on stage of rendering the state service according to the procedure, to the established requirements of Rules of entering of data into information system of monitoring of rendering the state services about stage of rendering the state service approved by the Order of the acting minister of transport and communications of the Republic of Kazakhstan of June 14, 2013 No. 452 (it is registered in the Register of state registration of regulatory legal acts No. 8555).

When rendering the state service by means of the portal, data on stage of its rendering arrive in the automatic mode in information system of monitoring of rendering the state services.

The authorized body the exercising state control of turnover of civil and office weapon sends information on the made changes and (or) additions to the subordinate regulatory legal acts determining procedure for rendering the state service in the organizations performing reception of applications and issue of results of rendering the state service and to service providers and also in Single contact center.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the central state bodies, and also service providers and (or) their officials concerning rendering the state services

14. Consideration of the claim concerning rendering the state services is made by higher administrative authority, the official, authorized body by assessment and control of quality of rendering the state services (further – the body considering the claim).

The claim is submitted to the service provider, the official whose decision, action (failure to act) are appealed.

The service provider, the official, whose decision, action (failure to act) are appealed, no later than three working days from the date of receipt of the claim send it and administrative case to the body considering the claim.

At the same time the service provider, the official whose decision, action (failure to act) are appealed, has the right not to send the claim to the body considering the claim if he within three working days makes the favorable decision, will make administrative action, completely meeting requirements specified in the claim.

The claim of uslugopoluchatel which arrived to the service provider who is directly rendering the state service according to Item 2 of article 25 of the Law of the Republic of Kazakhstan "About the state services" is subject to consideration within five working days from the date of its registration.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within fifteen working days from the date of its registration.

If other is not provided by the law, appeal to the court is allowed after appeal in pre-judicial procedure.

When rendering the state service in the budget for the location of uslugopoluchatel the license fee is paid for the occupation right by separate types of activity: 1) the license fee when licensing for the occupation right this type of activity constitutes 10 (ten) monthly settlement indicators (further – MRP); 2) the license fee for renewal of the license constitutes ten percent from rate when licensing, but no more than 4 (four) MRP. In case of electronic request for the portal for receipt of the state service, payment can be performed through PShEP
7	Working schedule of the service provider, and subjects of information	1) the portal – round the clock, except for technical breaks in connection with carrying out repair work. In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan. 21) concerning uslugopoluchatel there is judgment which took legal effect based on which the uslugopoluchatel is deprived of the special right connected with receipt of the state service; 22) is debtor on enforcement proceeding about eviction and demolition on the brought representation of the legal executive; 23) in case of lack of consent of the uslugopoluchatel provided according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access which are required for rendering the state service; 24) repeated loss of the registered weapon; 25) terminations of nationality of the Republic of Kazakhstan; 26) pronouncement of the protective instruction upon making of domestic violence; 27) if there are medical contraindications to ownership of weapon; 28) to persons having the removed or extinguished criminal record for making of the heavy, especially heavy crimes connected with arms trafficking, drugs, psychotropic substances, their analogs and precursors and also for making of terrorist, extremist crimes
