About establishment of features of import to the Russian Federation of the cryptography (cryptographic) tools and goods containing them

According to Item 1 of part 1 of article 18 of the Federal Law of March 8, 2022 "About modification of separate legal acts of the Russian Federation" the Government of the Russian Federation decides No. 46-FZ:

1. Determine that in 2022, 2023 and 2024 when importing to the Russian Federation of the cryptography (cryptographic) tools and goods containing them, provided by the Section 2.19 "The Cryptography (Cryptographic) Tools" of appendix No. 2 to the Decision of Board of the Eurasian economic commission of April 21, 2015 No. 30 "About measures of non-tariff regulation" (further - the cryptography (cryptographic) tools) which movement through customs border of the Eurasian Economic Union is performed according to the procedure, the determined Regulations on import to customs area of the Eurasian Economic Union and export from customs area of the Eurasian Economic Union of the cryptography (cryptographic) tools provided by appendix No. 9 to the specified Decision of Board of the Eurasian economic commission (further - the Provision), is allowed:

non-presentation to customs authorities of the Russian Federation of data on inclusion of notifications in the unified register of the notifications provided by the Provision concerning the cryptography (cryptographic) tools imported into the Russian Federation which are component parts for industrial production of the electronic machinery and equipment in the territory of the Russian Federation, the producers of such machinery and equipment included in the list of the systemically important organizations of the Russian economy;

the room of the cryptography (cryptographic) tools under customs procedure in the presence of the conclusion (the allowing document) issued by the Center for licensing, certification and protection of the state mystery of FSB of Russia for the form approved by the Decision of Board of the Eurasian economic commission of May 16, 2012 No. 45 "About single form of the conclusion (the allowing document) for import, export and transit of the separate goods included in the single inventory to which measures of non-tariff regulation in trade with the third countries, and methodical instructions for its filling", industry association or non-profit organization according to the list according to appendix are applied (further - the conclusion);

issue of the conclusion without specifying of goods quantity and the information about the receiver (sender) of goods;

release of the cryptography (cryptographic) tools by customs authorities according to the declared customs procedure on condition of availability in the customs declaration of data on the conclusion in case of receipt of data on such conclusion by means of single system of interdepartmental electronic interaction;

representation to customs authorities of data on the conclusion by any interested person for the purposes of the room of the cryptography (cryptographic) tools under customs procedure.

2. This resolution becomes effective from the date of its official publication.
