About some questions of transportation of scrap and waste of ferrous and non-ferrous metals

According to the subitem 11) of Item 1 of Article 6 and the subitem 1) of Item 2 of article 22 of the Law of the Republic of Kazakhstan "About homeland security of the Republic of Kazakhstan", article 29 of the Agreement on the Eurasian Economic Union, and also Section 10 of Appendix 7 to the Agreement on the Eurasian Economic Union, I ORDER:

1. Impose ban:

for a period of six months on export from the territory of the Republic of Kazakhstan all modes of transport: codes of the commodity nomenclature of foreign economic activity of the Eurasian Economic Union (further – codes of the CN FEA EEU) 7404 00 - waste and scrap copper, 7602 00 - waste and scrap aluminum, 7802 00 000 0 - waste and scrap lead, 8549 11 000 0 - the waste and scrap of lead accumulators which fulfilled lead accumulators, 8549 12 000 0 - the other, containing lead, cadmium or mercury, 8549 13 000 0 - the lead sorted by chemical type and not containing, cadmium or mercury, 8549 14 000 0 - the unassorted and not containing lead, cadmium or mercury, 8549 19 000 0 - other;

for a period of six months on export from the territory of the Republic of Kazakhstan automobile and by sea: code of the CN FEA EEU 7204 - waste and scrap of ferrous metals, ingots of ferrous metals for melting (burdening ingots), except for codes of the CN FEA EEU 7204 21 100 0 – waste and scrap of the alloyed steel, the stainless steel containing 8 Mas. % or more nickel, 7204 21 900 0 - other, 7204 29 000 0 – other;

for a period of six months on export from the territory of the Republic of Kazakhstan automobile and by sea the pipes which were in the use, rails, elements of railroad tracks and railway vehicles: codes of the CN FEA EEU 7302 - the products from ferrous metals used for railway or tram tracks, the rails, counterrails and gear rails, switch rails, crosspieces of deaf crossing, point rods and other cross connections, cross ties, joint slips and liners, wedges, support plates, hook rail bolts, pillows and extensions, beds, cross-pieces and other details intended for connection or fixture of rails, 7303 00 - pipes, tubes and profiles hollow, from iron casting, 7304 - pipes, tubes and profiles hollow, seamless, from ferrous metals (except iron casting), pipes for oil or gas pipelines, 7305 - pipes and tubes other (for example, welded, riveted or connected by similar method), with round section, which outer diameter more 406,4 of mm, from ferrous metals, pipe for oil or gas pipelines, 7306 - pipes, tubes and profiles hollow other (for example, with open seam or welded, riveted or connected by similar method), from ferrous metals, pipe for oil or gas pipelines, 8607 - parts of railway locomotives or motor cars of the tram or railway vehicles, the cart, axis and wheel, and their part which except for was in the use of the elements of railway vehicles imported on the territory of the Republic of Kazakhstan for repair and exported back, and also exported from the territory of the Republic of Kazakhstan for repair and imported by back automobile mode of transport: codes of the CN FEA EEU 8607 19 100 1 - being in the use, 8607 19 100 9 - other, 8607 19 900 9 - other, 8607 21 100 9 - other, 8607 21 900 9 - other, 8607 30 000 0 - hooks and other coupling devices, buffers, their parts, other, 8607 99 800 0 - other, 8607 29 000 0 - other, 8607 12 000 0 – carts other.

2. On the goods specified in paragraph three of this order, participants of foreign economic activity in five working days prior to expected date of movement of goods through frontier of the Republic of Kazakhstan represent to Committee of industrial development of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan agreements (contracts) for carrying out repair of elements of railway vehicles, the declaration on goods (if necessary), and also acts of the performed works within five working days after import of the specified goods to the territory of the Republic of Kazakhstan. Submission of documents is followed with indication of date and the name of the check point on frontier of the Republic of Kazakhstan through which movement of goods is planned.

The committee of industrial development of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan within three working days from the date of receipt from participants of foreign economic activity of the documents specified in part one of this Item notifies Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan on participants of foreign economic activity, goods, date and the check point on frontier of the Republic of Kazakhstan through which movement of goods is planned.

3. To committee of industrial development, Committee of transport of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan, and also Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in case of interaction with the Border service of Committee of homeland security of the Republic of Kazakhstan, to joint-stock company "The Kazakstan Tem_r of Zhola national company within the competence to provide control on execution of Item 1 of this order in the procedure established by the legislation of the Republic of Kazakhstan.

4. To committee of industrial development together with Committee of transport of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan, Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan, and also the Border service of Committee of homeland security of the Republic of Kazakhstan to determine order of interaction by ensuring execution of Item 1 of this order.

5. To provide to committee of industrial development of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan;

3) informing the Eurasian economic commission on introduction of this order of prohibition specified in Item 1.

6. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

7. This order becomes effective after ten calendar days after day of its first official publication.
