About some questions of export of separate goods from the territory of the Republic of Kazakhstan

According to Item 2 of Article 17 and Item 3 of article 18 of the Law of the Republic of Kazakhstan "On regulation of trading activity" I ORDER:

1. Approve:

1) Rules for apportionment of quantitative restrictions (quotas) according to appendix 1 to this order;

2) the Inventory concerning which export from the territory of the Republic of Kazakhstan quantitative restrictions (quotas), according to appendix 2 to this order are introduced.

2. And conversions of agricultural products of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation to provide to department of the agrofood markets:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after day of its first official publication and is effective till June 15, 2022.

Rules for apportionment of quantitative restrictions (quotas)

Chapter 1. General provisions

1. These rules of distribution of quantitative restrictions (quotas) (further – Rules) are developed according to Item 3 of article 18 of the Law of the Republic of Kazakhstan "On regulation of trading activity" and determine procedure for distribution of quantitative restrictions (quotas).

2. In these rules the following concepts are applied:

1) the operator on the grain market (further – the operator) – the national company in the field of agro-industrial complex participating in ensuring food security by means of implementation of stabilization function in the grain market and powers on management of reserve stock of grain;

2) participants of foreign trade activity (further – the applicant) – the physical persons performing foreign trade activity including registered as individual entrepreneurs according to the legislation of the Republic of Kazakhstan and the legal entities created according to the legislation of the Republic of Kazakhstan, and also the organization not being legal entities;

3) goods – the goods specified in the inventory concerning which export from the territory of the Republic of Kazakhstan quantitative restrictions (quotas) according to appendix 2 to this order are introduced;

4) authorized body – territorial subdivisions of Committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan.

Chapter 2. Procedure for distribution of quantitative restrictions (quotas)

Distribution of amounts of quotas for commodity exportation from the territory of the Republic of Kazakhstan is performed in single automated control system for industries of agro-industrial complex "e-Agriculture" (further – IS EASU) automatically in case of issue of phytosanitary certificates according to the Rules on protection of the territory of the Republic of Kazakhstan from quarantine objects and alien types approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of June 29, 2015 No. 15-08/590 (it is registered in the Register of state registration of regulatory legal acts No. 12032).

4. After enforcement of these rules in IS EASU the quantitative limit of amount of quota of types of goods is created.

5. The applicants who implemented to the operator of 10 (ten) percent from wheat amount declared to export from the territory of the Republic of Kazakhstan on fixed price by means of signing of the order on sale/purchase of the grain receipt in the state electronic register of holders of grain receipts on the cereal-receiving companies are allowed to distribution of quota for export of wheat from the territory of the Republic of Kazakhstan.

6. The operator on daily basis sends to authorized body the list of the applicants who realized 10 (ten) percent from the amount of wheat declared for export to export from the territory of the Republic of Kazakhstan soft (Triticum aestivum L. 3 classes) on fixed price.

7. Fixed price and qualitative indexes of wheat, the list and addresses of the cereal-receiving companies to which wheat soft (will be delivered to Triticum aestivum L. 3 classes) are published, on official Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan by www.gov.kz (further – Internet resource).

8. Distribution of amount of quota for commodity exportation from the territory of the Republic of Kazakhstan between applicants is performed before complete exhaustion of amount of quota by each type of goods then the authorized body refuses issue of the phytosanitary certificate.

9. For action of quota the admissible limit on export of wheat soft on one applicant constitutes 50 (fifty) thousand tons, torments – 10 (ten) thousand tons.

10. The authorized body on daily basis places the following information on Internet resource:

1) the number of the issued quota amount by each type of goods;

2) the available amount of quota which is subject to distribution by each type of goods.
