About approval of Rules of maintaining the state inventory of especially protected natural territories in the Republic of Kazakhstan

1. Approve the enclosed Rules of maintaining the state inventory of especially protected natural territories in the Republic of Kazakhstan.

2. Recognize to invalid:

1) the order of the Government of the Republic of Kazakhstan of July 18, 2001 No. 973 "About approval of Rules of conducting the state accounting and the state inventory of especially protected natural territories in the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2001, No. 27, the Art. 337);

2) Item 2 of the order of the Government of the Republic of Kazakhstan of September 8, 2003 No. 910 "About approval of Rules of reference of lands to especially protected natural territories and reservations of lands under these territories" (SAPP of the Republic of Kazakhstan, 2003, No. 36, the Art. 369);

3) the subitem 1) Item 1 of the order of the Government of the Republic of Kazakhstan of December 29, 2004 No. 1417 "About modification and amendments in the orders of the Government of the Republic of Kazakhstan of July 18, 2001 No. 973 and of September 8, 2003 No. 910" (SAPP of the Republic of Kazakhstan, 2004, No. 50, the Art. 661).

3. This resolution becomes effective after ten calendar days from the date of its first official publication.

Rules of maintaining the state inventory of especially protected natural territories in the Republic of Kazakhstan

1. General provisions

1. These rules are developed according to article 7 of the Law of the Republic of Kazakhstan of July 7, 2006 "About especially protected natural territories" and determine procedure for maintaining the state inventory of especially protected natural territories (the daleegosudarstvenny inventory).

2. The state inventory contains system of data on legal status of especially protected natural territories (further - OOPT) in the Republic of Kazakhstan, their location, the sizes and borders, geographical coordinates, the quantity and quality characteristic of objects of the state natural and reserved fund, ecological, scientific, historical and cultural, recreational value, protection mode types, target use and the permitted types of activity.

The state inventory is kept by authorized body in the field of especially protected natural territories (further - authorized body) on permanent basis based on the data represented by territorial authorities of authorized body and regional (the city of republican value, the capital) executive bodies, for the purpose of use for development of development programs of the OOPT system, forming of ecological network and planning of rational use of lands and placement of productive forces of regions taking into account preserving biological diversity, unique natural landscapes.

2. Procedure for maintaining the state inventory

4. The state inventory contains the republican cadastral book and cadastral cases of OOPT.

5. Cadastral case is drawn up on each OOPT separately and includes:

1) the decision of the Government of the Republic of Kazakhstan or regional (the cities of republican value, the capital) executive bodies about creation of OOPT;

2) the passport of OOPT which is drawn up according to article 25 of the Law of the Republic of Kazakhstan "About especially protected natural territories";

3) natural-science and feasibility statement on creation or OOPT expansion;

4) the positive conclusion of the state environmental assessment on natural-science and technical and economic reasons for creation or the OOPT expansion;

5) the data of authorized state bodies on reflection of OOPT in the state inventories of natural resources (land, water, forest, fauna, fields and shows of minerals) represented at the request of authorized body;

6) the list of the objects of the state natural and reserved fund revealed on this OOPT.

In the republican cadastral book OOPT created according to the legislation of the Republic of Kazakhstan on each area separately with indication of type of the mode of their protection, the decision of the Government of the Republic of Kazakhstan or regional (the city of republican value, the capital) of executive bodies about creation of OOPT are specified all.

Cadastral number is assigned to each OOPT brought in the republican cadastral book. The same number identifies the cadastral case which is drawn up on the corresponding OOPT.

7. The state inventory is kept on paper and electronic carriers, with use of electronic systems of collection, processing and storage of information.

8. Processing, entering in the state inventory of data, including registration of cadastral cases, is made according to the procedure, the determined authorized body.

9. Territorial authorities of authorized body and regional (the cities of republican value, the capital) executive bodies represent to authorized body annually, till January 10, on electronic and paper carriers the documents and data specified in Item 5 of these rules concerning OOPT created in the corresponding administrative and territorial units.

10. In case of modification of documents or data from which cadastral case is drawn up territorial authorities of authorized body and regional (the cities of republican value, the capital) executive bodies notify authorized body on such changes without delay, with appendix of the relevant documents and data on electronic and paper carriers.

3. Final provisions

11. Maintaining the state inventory is financed according to the budget legislation.

12. At the request of the interested state bodies of the Republic of Kazakhstan, data from the state inventory on the required territories according to the procedure, established by the legislation of the Republic of Kazakhstan can be represented to appeals of legal entities and physical persons.
