Some questions of ensuring functioning of effective purchasing system of medicines, medical products and supportive applications to them and the state compensation of harm

Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure of the state compensation of the harm connected with the complications which arose after use of medicines or vaccination against sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus which is applied.

2. Determine that:

1) in case of establishment to face of group of the disability connected with the complications which arose after use of medicines or vaccination against sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus payment according to this resolution is carried out one-timely in the following sizes:

The 400-fold size of the subsistence minimum for able-bodied persons established for January 1 of calendar year - for persons with disability of the I group;

The 350-fold size of the subsistence minimum for able-bodied persons established for January 1 of calendar year - for persons with disability of the II group;

The 300-fold size of the subsistence minimum for able-bodied persons established for January 1 of calendar year - for persons with disability of III group;

2) in case of the death of person which came owing to use of medicines or vaccination against sharp respiratory disease of COVID-19, SARS-CoV-2, caused by coronavirus to family members, parents, dependents of the dead, makes payment in connection therewith by the resolution in 750-fold size of the subsistence minimum for able-bodied persons established for January 1 of calendar year;

3) in case of receipt of payment on compensation of the damage connected with the complications which arose owing to use of medicines or vaccination against sharp respiratory disease of COVID-19, of SARS-CoV-2, of medicines, vaccines or other medical immunobiological supplies caused by coronavirus for specific prevention of sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus according to the procedure of the World Health Organization within global initiative of COVAX, the payments of the state compensation provided by this resolution are not performed;

4) delivery of health care to persons owing to emergence of complications after use of medicines or vaccination against sharp respiratory disease of COVID-19, of SARS-CoV-2, caused by coronavirus it is performed within accomplishment of the program of medical guarantees within packets of the medical services provided for the corresponding year, or at the expense of others, the sources which are not forbidden by the legislation.

3. Bring in resolutions of the Cabinet of Ministers of Ukraine of December 3, 2009 No. 1317 "Questions of medico-social examination" (The Official Bulletin of Ukraine, 2009, No. 95, Art. 3265; 2021, No. 35, the Art. 2065) and of March 17, 2011 No. 298 "About approval of the Procedure for use of the means provided in the government budget for accomplishment of programs and implementation of centralized actions for health care" (The Official Bulletin of Ukraine, 2011, No. 22, Art. 917; 2020, No. 10, Art. 373, No. 54, Art. 1657; 2021, No. 2, the Art. 91, No. 19, the Art. 813, No. 68, the Art. 4262, No. 86, the Art. 5481) - with the changes made by the resolution of the Cabinet of Ministers of Ukraine of December 23, 2021 No. 1389, changes which are applied.

4. Recognize invalid Item 1 and subitems 2 - the 5th Item 2 of the resolution of the Cabinet of Ministers of Ukraine of March 31, 2021 as No. 371 "Some questions of the state compensation of the harm connected with complications which can arise after vaccination against sharp respiratory disease of COVID-19, of SARS-CoV-2 caused by coronavirus" (The Official Bulletin of Ukraine, 2021, No. 35, of the Art. 2065).
