About approval of the Procedure for submission by insurance company of the reporting under non-state pension provision

According to Item 13 parts one of article 8 of the Law of Ukraine "About state regulation of the capital markets and the organized goods markets", Article part four 52, parts one and the second article 53 of the Law of Ukraine "About non-state pension provision" the National commission on securities and the stock market solved:

1. Approve the Procedure for submission by insurance company of the reporting under non-state pension provision which is applied.

2. Declare invalid the order of State commission on regulation of the markets of financial services of Ukraine of February 15, 2007 No. 6817 "About approval of the Regulations on promulgation of information by insurers concerning the insurance contracts signed in system of non-state pension provision", registered in the Ministry of Justice of Ukraine on March 02, 2007 for No. 179/13446.

3. Determine that:

the first accounting period for creation and submission of the reporting under non-state pension provision which moves in NKTsBFR is 1 quarter 2022;

the first accounting period for creation and submission of the annual accounts represented to persons who signed with the insurer insurance contracts in system of non-state pension provision is 2021.

4. To department of methodology of regulation of professional participants of the security market () provide Kurochkin I.:

submission of this decision for implementation of examination on compliance of the Convention on human rights protection and fundamental freedoms in the Secretariat of the Representative for cases of the European Court of Human Rights of the Ministry of Justice of Ukraine;

submission of this decision on state registration in the Ministry of Justice of Ukraine;

promulgation of this decision on the official website of the National commission on securities and the stock market.

5. This decision becomes effective from the date of its official publication.

6. Control over the implementation of this decision to assign to the member of the National commission on securities and the stock market Baramiya I.

Procedure for submission by insurance company of the reporting under non-state pension provision

I. General provisions

1. This Procedure determines structure of the reporting of non-state pension provision on activities of insurance company (further - the insurer), procedure and terms of its submission by the insurer to the National commission on securities and the stock market, physical persons and legal entities, with which are concluded provided by the Law of Ukraine "About non-state pension provision" (further - the Law), insurance contracts in system of non-state pension provision, and also procedure for promulgation by the insurer of information on its activities for non-state pension provision.

2. In this Procedure terms are used in such values:

activities for non-state pension provision - provision by the insurer having the license for implementation of insurance activity on voluntary insurance of life, services in non-state pension provision based on the signed insurance contracts of life pension and insurance contracts of approach of disability or the death of the member of non-state pension fund (further - the Pension fund) according to the Law and the legislation on insurance;

insurance contracts in system of non-state pension provision - the insurance contract of life pension signed at the expense of the pension funds (their part) transferred to the insurer belonging to the member of the pension fund and considered on its individual retirement account according to which payments of life pension (life annuities), and the insurance contract of risk of approach of disability or the death of the member of the pension fund according to which insurance payments (awards, fees) are paid by transfer to the insurer regarding the paid pension contributions by investors of the pension fund or the pension fund for benefit of his participants are performed and are performed insurance payments;

the reporting under non-state pension provision - the reporting of the insurer (other, than financial and consolidated financial statements) constituted based on accounting data for the corresponding period contains indicators of activities for non-state pension provision of the insurer, determined by the Law, and moves in form and in amount and the terms determined by this Procedure;

person insured according to the insurance contract of life pension - the participant of non-state pension provision to which it agrees to the insurance contract of life pension signed with the insurer payments of life pension (life annuities) in the amount of, calculated by the insurer on the basis of actuarial calculations, proceeding from the amount determined by person with whom the insurance contract of life pension, and the reference issued by the administrator of the pension fund on availability at such person of this amount of pension means is signed are performed;
