About order of interaction of state members of the Eurasian Economic Union and Eurasian economic commission in case of introduction and cancellation by state members of the Eurasian Economic Union of restrictions in mutual trade in goods on the bases specified in article 29 of the Agreement on the Eurasian Economic Union of May 29, 2014

Council of the Eurasian economic commission solved:

1. Approve the enclosed Order of interaction of state members of the Eurasian Economic Union and Eurasian economic commission in case of introduction and cancellation by state members of the Eurasian Economic Union of restrictions in mutual trade in goods on the bases specified in article 29 of the Agreement on the Eurasian Economic Union of May 29, 2014.

2. This Decision becomes effective after 30 calendar days from the date of its official publication, but not earlier than the date of entry into force of the Protocol on introduction of amendments to the Agreement on the Eurasian Economic Union of the May 29, 2014 signed on March 31, 2022.

Order of interaction of state members of the Eurasian Economic Union and Eurasian economic commission in case of introduction and cancellation by state members of the Eurasian Economic Union of restrictions in mutual trade in goods on the bases specified in article 29 of the Agreement on the Eurasian Economic Union of May 29, 2014

1. This Procedure is developed according to item 4 of article 29 of the Agreement on the Eurasian Economic Union of May 29, 2014 (further - the Agreement) and for the purpose of realization of Item 3 of article 28 of the Agreement and establishes rules of interaction of state members of the Eurasian Economic Union and the Eurasian economic commission (further respectively - state members, the Commission) in case of introduction and cancellation by state members of restrictions in mutual trade in goods on the bases specified in article 29 of the Agreement (further - restrictions).

Interaction of authorized bodies of state members in case of introduction of temporary sanitary, veterinary and sanitary and quarantine phytosanitary measures is performed according to the Procedure approved by the Decision of Council of the Eurasian economic commission of May 16, 2016 No. 149.

2. The public authority of state member authorized on interaction with the Commission (further - authorized body), sends to the Commission the list of e-mail addresses for exchange of electronic copies of notifications on the entered, changed and cancelled restrictions (further - notifications). Exchange of the received lists of e-mail addresses between authorized bodies is provided with Department of functioning of the domestic markets of the Commission (further - authorized department).

3. In case of introduction of restrictions the authorized body of state member which introduces restrictions in writing notifies on it the Commission, and also sends to authorized department the electronic copy of the notification on acceptance of such regulatory legal act with reasons for need of its acceptance not later than 10 working days before date of its entry into force, except as specified, when circumstances require urgent introduction of restrictions. In such cases the notification goes no later than the date of entry into force of the specified regulatory legal act. The authorized department sends the received notification to the governments of other state members and to the interested departments of the Commission no later than 3 working days from the date of receipt. For the purpose of ensuring efficiency the authorized department sends the electronic copy of the notification to authorized bodies of other state members by e-mail.

4. The notification includes the following data:

a) description of goods (goods) concerning which, (which) restrictions are introduced;

b) Date of Introduction of restrictions;

c) effective period of restrictions;

d) content (description) of the introduced restrictions;

e) the basis for introduction of restrictions specified in Item 1 of article 29 of the Agreement;

e) the data confirming need of introduction of restrictions, and reasons for term of their action.

5. The member of Board of the Commission supervising questions of functioning of the domestic markets within 3 working days from the date of receipt of the notification initiates carrying out consultations with participation of deputy managers of authorized bodies, including for discussion of feasibility of realization by all or separate state members of joint rationing measures.

Consultations do not interfere with introduction by state member of restrictions.

6. Following the results of the held consultations the authorized department constitutes the protocol of consultations and within 3 working days from date of consultations sends it to authorized bodies and the interested departments of the Commission (including by e-mail).

7. In case of need of receipt of the additional information for the introduced restrictions authorized bodies and (or) the interested departments of the Commission send the corresponding inquiries to authorized department. The authorized department within 3 working days from the date of receipt of the corresponding request provides its direction in authorized body of state member which introduces restrictions, and in authorized bodies of other state members, including by e-mail.

8. The authorized body of state member which introduces restrictions directs the reply to the request specified in Item 7 of this Procedure, in time, not exceeding 10 working days from the date of its obtaining.
