About approval of Veterinary sanitary standard for the offal of animal origin and derivative products which are not intended for consumption by the person
Based on article 4 of the Law No. 129/2019 on the offal of animal origin and derivative products which are not intended for consumption by the person (The official monitor of the Republic of Moldova, 2019, 315-319, Art. 459), the Government DECIDES:
1. Approve Veterinary sanitary standard for the offal of animal origin and derivative products which are not intended for consumption by the person it (is applied).
2. Declare invalid the Order of the Government No. 315/2010 about approval of the Veterinary health regulations concerning the offal of animal origin which is not intended for consumption by the person (The official monitor of the Republic of Moldova, 2010, Art. No. 64-65, 385), with subsequent changes.
3. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

This Veterinary sanitary standard for the offal of animal origin and derivative products which are not intended for consumption by the person shifts Regulations of the Commission (EU) No. 142/2011 of February 25, 2011 about application of Regulations (EU) No. 1069/2009 of the European Parliament and Council establishing sanitary standards for the offal of animal origin and derivative products which are not intended for consumption by the person and about application of the Directive of Council 97/78/EU for the certain samples and products exempted from veterinary health control on border according to this Directive (the text is related to the EEA) published in the Official magazine of the European Union by L 54 of February 26, 2011 with the last changes made according to Regulations of the Commission (EU) 2021/1891 of October 26, 2021.
1. The veterinary sanitary standard for the offal of animal origin and derivative products which are not intended for consumption by the person (further - Veterinary sanitary standard), establishes measures for application:
1) requirements of public health and health of animals for the offal of animal origin and derivative products provided by the Law No. 129/2019 on the offal of animal origin and derivative products which are not intended for consumption by the person;
2) requirements for the certain samples and products exempted from veterinary health control on border check-points of control according to subitems c) and d) Item 4) the Veterinary sanitary standard establishing certain fundamental principles of the organization of veterinary checks during the importing and the sales of products of animal origin approved by the Order of the Government No. 1408/2008.
2. In this Veterinary sanitary standard the concepts used in the Law No. 129/2019 on the offal of animal origin and derivative products which are not intended for consumption by the person and also the following concepts are applied:
fur animals - the animals divorced for production of fur and who are not intended for consumption by the person;
blood - fresh whole blood;
fodder raw materials - the fresh or preserved foods of vegetable or animal origin and products received as a result of their industrial conversion, and also the organic and inorganic substances which are containing or not containing the feed additives intended for feeding of animals are direct to or after conversion or for preparation of the combined forage or as basis for premixes, including the processed animal protein, products from blood, melted fats, yaytseprodukta, cod-liver oil, derivatives of fats, collagen, gelatin and the hydrolyzed proteins, dikaltsiyfosfat, trikaltsiyfosfat, milk, products on the basis of milk, derivative products from milk, colostrum, products from colostrum and waste of centrifuging or separation;
products from blood - the products received from blood or fractions of blood, except for blood meal; the dry / refrigerated / liquid plasma, whole dry blood, the dry / refrigerated / liquid erythrocytes or their fractions and mixes concern to them;
the processed animal protein - the protein of animal origin received from material of 3rd category including blood and fish meal, for the purpose of conversion for direct use as fodder material or other use in sterns, including forages for unproductive animals, or for use in organic fertilizers or improvers of the soil. Do not include products from blood, milk, products on the basis of milk, derivative dairy products, colostrum, products from colostrum, waste of centrifuging or separation, gelatin, the hydrolyzed proteins and dikaltsiyfosfat, eggs and products from eggs, including egg shell, trikaltsiyfosfat and collagen;
blood meal - the processed animal protein received in case of heat treatment of blood or other fractions of blood;
fish meal - the processed animal protein received as a result of conversion of water animals, except for the marine mammals including who are grown up on farms of water invertebrates and any:
1) fishes of superclass of Agnatha and classes Chondrichthyes and Osteichthyes;
2) mollusks like Mollusca;
3) crustaceans of the Crustacea subtype;
4) starfishes of type of Asterias rubens caught in zone of production of mollusks;
melted fats - the fats received from conversion:
1) offal of animal origin;
2) the products intended for consumption by the person which the operator intended for the purposes, except for consumption by the person;
cod-liver oil - the fat received as a result of conversion of water animals, except for marine mammals including the divorced water invertebrates and any:
1) fishes of superclass of Agnatha and classes Chondrichthyes and Osteichthyes;
2) mollusks like Mollusca;
3) crustaceans of the Crustacea subtype;
4) starfishes of type of Asterias rubens which catch is made in zone of production of mollusks; or the fat received as a result of conversion of the fish intended for consumption by the person which the operator determined for the purposes, others than consumption by the person;
beekeeping offal - the honey, beeswax, uterine milk, propolis or pollen which is not intended for consumption by the person;
collagen - the proteinaceous products received from skins, skin, bones and veins of animals;
gelatin - natural soluble protein, gel-forming or not, received by partial hydrolysis of the collagen made from bones, skins, skin, veins and sinews of animals;
shkvara - the remaining balance containing protein, received when melting after partial separation of fat from water;
the hydrolyzed proteins - polypeptides, peptides and amino acids, and also their mixes received by hydrolysis of offal of animal origin;
white water - mix of milk, products on the basis of the milk or products received from them with the water collected when washing the equipment of the dairy industry before cleaning and disinfection;
tinned forage for unproductive animals - thermally processed forages for unproductive animals placed in hermetically sealed reservoirs;
chewing products for dogs - the products for chewing intended for pets, made of the raw skins and leather of hoofed animals or of other materials of animal origin;
the flavored offal of animal origin - the liquid or dehydrated derivative animal product used for improvement of tastes of forages for unproductive animals;
forage for unproductive animals - forage for unproductive animals and chewing products for dogs who consist of offal of animal origin or derivative products and which:
Materials of 3rd category contain 1);
2) may contain the imported material of the 1st category received from animals who underwent to illegal processing;
the crude forage for unproductive animals - forage for unproductive animals which contains material of 3rd category and was not exposed to any processes of conservation, except chilling or freezing;
the processed forage for pets - forage for unproductive animals, except crude forage for unproductive animals;
fermentation remaining balance - remaining balance, including the liquid fractions received as a result of transformation of offal of animal origin on installation for receipt of biogas;
content of digestive tract - content of digestive tract of mammal and beskilevy birds;
fat derivatives - the derivative products received from the melted fats coming from the materials 1 or 2nd of category which underwent conversion according to this Veterinary sanitary standard;
guano - the natural product collected from excrement of bats and wild sea birds, which is not mineralized;
meat and bone meal - the protein of animal origin received as a result of conversion of materials 1 or 2nd of category according to one of the methods of conversion provided in this Veterinary sanitary standard;
the processed skins and leather - derivative products from the raw skins and skin, except for chewing products for dogs who were:
1) are dried up;
2) are subjected to dry or wet salting within at least 14 days before sending;
3) are subjected to salting within at least 7 days in sea salt with addition of 2% of carbonate of sodium;
4) are subjected to drying within at least 42 days at temperature at least 20 °C;
5) tanning is subjected to conservation process, except for;
the raw skins and skin - all skin and hypodermic fabrics which underwent to any processing, except cutting, chilling and freezing;
the raw feathers and parts of feathers - feathers and parts of feathers, except for feathers and parts of feathers which were processed:
1) ferry boat: or
2) by other method providing elimination of all unacceptable risks;
the raw wool - wool, except for wool, which:
1) underwent to factory washing;
2) it was received as a result of tanning; or
3) it was processed by other method providing elimination of all unacceptable risks;
4) it was received from other animals, except pork type, and it is subject to factory washing which consists in wool immersion in a row of water bathtubs with soap and potassium hydroxide or sodium hydroxide;
5) it was received from other animals, except type pork, and it is intended for sending directly for the facility for production of derivative products from wool for the textile industry and it was subject at least to one of the following methods of processing:
a) chemical epilation extinguished lime or sulfide of sodium;
b) fumigation by formaldehyde in hermetically enclosed space within at least 24 hours;
c) factory washing which consists in immersion of wool in water-soluble detergent at temperature of 60-70 °C;
d) warehousing which can include transportation time at temperature of 37 °C within eight days, 18 °C within 28 days or 4 °C within 120 days;
the raw hair - hair, except for hair, which:
1) underwent to factory washing;
2) it was received as a result of tanning; or
3) it was processed by other method providing elimination of all unacceptable risks;
4) it was received from other animals, except type pork, and it is subject to factory washing which consists in immersion of hair in a row of water bathtubs with soap and potassium hydroxide or sodium hydroxide;
4) it was received from other animals, except type pork, and it is intended for sending directly for the facility for production of derivative products from hair for the textile industry and it was subject at least to one of the following methods of processing:
a) chemical epilation extinguished lime or sulfide of sodium;
b) fumigation by formaldehyde in hermetically enclosed space within at least 24 hours;
c) factory washing which consists in immersion of wool in water-soluble detergent at temperature of 60-70 °C;
d) warehousing which can include transportation time at temperature of 37 °C within eight days, 18 °C within 28 days or 4 °C within 120 days;
the raw bristle of pigs - the bristle of pigs not subject to tanning, factory washing and processed by other method providing elimination of all unacceptable risks;
sample for exhibitions - the offal of animal origin or derivative products intended for exhibitions or art actions;
intermediate product - derivative product:
1) held for use in production processes of medicines, veterinary medicines, medical products for the medical and veterinary purposes, the active implanted devices, medical products for diagnostics of in vitro in the medical and veterinary purposes, laboratory reagents or cosmetics which is used:
a) as material in production process or final production of end product;
b) in processes of validation or check during production process;
c) in case of quality check of end product;
2) development stages which processings and productions were fully complete to be considered as derivative product and to qualify material directly or as component of the product intended for the purposes specified in the subitem 1);
3) which requires certain additional processes, such as mixing, wrapping, assembly or packaging for placement of product in the market in quality:
a) medicine;
b) medicine of veterinary appointment;
c) medical product for the medical and veterinary purposes;
d) the active implanted products;
e) medical products for diagnostics of in vitro in the medical and veterinary purposes;
f) laboratory reagents;
g) cosmetics;
laboratory reagent - the packed product ready to application containing the offal of animal origin or derivative products intended separately or in combination with substances of not animal origin for special laboratory use as reagent or chemical product, calibrating or control material for identification, measurement, research or production of other substances;
product for diagnostics of in vitro - the packed product ready to application containing the product of blood or other offal of animal origin used as reagent, chemical product, the calibrating device, set or any other system used autonomous or in total, held for use in vitro in researches of samples of human or animal origin for the purpose of diagnostics of physiological condition, the state of health, disease or genetic disorder or for determination of level of safety and compatibility with reagents; does not include donor organs or donor blood;
samples for scientific and diagnostic testings - the offal of animal origin and products of their conversion intended for the diagnostic or analytical activities promoting development of science and technology, educational process or research activities;
trade samples - the offal of animal origin or derivative products intended for certain researches or analyses, for production process implementation including conversion of offal of animal origin or derivative products, production of forages for animals, including unproductive animals or derivative products, or for testing of machines or the equipment;
burning - the process including oxidation or burning for the purpose of use of energy value of offal of animal origin or derivative products if they are not waste;
burning - destruction as waste on installation on burning of offal of animal origin or derivative products;
waste of burning and joint burning - any remaining balance which is formed on installations on burning or joint burning on which offal of animal origin or derivative products are processed;
color code - systematic use of colors for display of information according to this Veterinary sanitary standard, on surface or part of surface of packaging, container or the vehicle or on the label or symbol applied on them;
intermediate transactions - transactions, except for storages;
tanning - increase in hardness of skins by means of vegetable tannins, chromic salts or other substances, such as aluminum salts, salts of iron, silicon salt, aldehydes and quinones or other synthetic hardeners;
taxidermy - method of preparation and stuffing of leather of animals for reproduction of form of live animal so that unacceptable risks for health of the population and animals were not transmitted through their effigies;
conversion methods - the methods listed in Items 149-155;
batch - the production unit produced on one installation with use of identical production parameters, such as source of materials, the quantity of such units made in continuous procedure on one installation and stored together as unit of cargo;
hermetically closed container - the container designed and held for use so that to provide protection against penetration of microorganisms;
biogas installation - installation in which offal of animal origin or derivative products are the minimum part of the material which is subject to biological decomposition under anaerobic conditions;
the centers of collection - the room, the installations except for overworking where offal of animal origin for feeding of animals gathers;
installation on compost production - installation in which offal of animal origin or derivative products are the minimum part of the material which is subject to biological decomposition under anaerobic conditions;
installation on joint burning - any stationary or mobile installation which main objective is development of energy or production of material products which uses waste as the main or additional fuel or in which waste is exposed to heat treatment for their destruction;
installation on burning - any stationary or mobile technical installation and the equipment intended for heat treatment of waste with recuperation or without recuperation of heat which is formed in case of combustion;
installation on production of forages for unproductive animals - rooms or objects for production of forages for unproductive animals or the flavored offal of animal origin;
the overworking installation - rooms or installations in which offal of animal origin according to this Veterinary sanitary standard is processed;
environment for cultivation - materials, including the pottery soil, except the soil of in situ in which grow up plants and which are used irrespective of the soil of in situ.
3. The following derivative products, except imported according to parts can be placed in the market without restrictions (3) and (4) article 7 of the Law No. 129/2019 on the offal of animal origin and derivative products which are not intended for consumption by the person:
1) the biodiesel fuel meeting the requirements for destruction and use of derivative products specified in the subitem 2) of Item 170;
2) the processed forages for unproductive animals meeting the special requirements specified in the subitem 1) of Item 366;
3) the chewing products for dogs conforming to the special requirements specified in the subitem 2) of Item 366;
4) the skins of hoofed animals meeting the special requirements of final point for these products specified in Items 376, 377 and 378;
5) the wool and hair meeting the special requirements of final point for these products specified in Items 385, 386 and 387;
6) the feathers and down meeting the special requirements of final point for these products specified in Item 388;
7) the furs corresponding to the special conditions applied to final point of production chain of the corresponding product, specified in Item 395;
8) the cod-liver oil intended for production of the medicines meeting the special requirements applied to final point of production chain of this product, specified in Section 11 of Chapter XIV;
9) the gasoline and fuel meeting the special requirements imposed to the products received by the catalytic process in several stages for production of renewable fuel established in the subitem 3) of Item 170;
10) the oleokhimichesky products received from melted fats and conforming to the requirements established in Section 10 of Chapter XIV;
11) the renewable diesel fuel, renewable aviation fuel, renewable propane and renewable gasoline meeting the special requirements to the products of multistage catalytic hydrotreating for production of renewable fuels provided in the subitem 6) of Item 170.
4. The diseases listed in the list of diseases, infections and infestation of land and water animals according to World Organization on health protection of animals (appendix 1), are considered as the serious inoculable diseases concerning health of animals.
5. The operators specified in Chapter III shall observe:
1) conditions of feeding of fur animals the certain materials received from hulks or parts of animals of the same type;
2) restrictions on feeding of farm animals with grass from the parcels of land in which certain organic fertilizers and improvers of the soil were introduced.
7. The environmental protection agency issues to installations for burning and joint burning permission, according to article 25 of the Law No. 209/2016 on waste, irrespective of their capacity if they conform to the requirements established in Chapter IV and also according to article 12 of the Law No. 1422/1997 on protection of atmospheric air.
8. Operators of installations on burning and joint burning shall observe the general requirements stated in Section 1 to Chapter IV.
9. Operators of installations on burning and joint burning of big capacity shall comply with the special conditions stated Section 2 of Chapter IV.
10. Operators of installations on burning and joint burning of low power shall comply with the special conditions stated Section 3 of Chapter IV.
12. The environmental protection agency issues permissions to the installations for burning or joint burning specified in Item 11, according to article 25 of the Law No. 209/2016 on waste and article 12 of the Law No. 1422/1997 on protection of atmospheric air for use of offal of animal origin or derivative products in fuel quality provided that they conform to the general and special requirements stated in Sections 4 and 5 of Chapter IV.
13. The following requirements are applied to use of manure of farm animals or meat and bone meal in fuel quality for burning, according to Sections 4 and 5 of Chapter IV, in addition to the stated provisions:
1) the application on the receipt of permission submitted by the operator to Environmental protection agency shall contain proofs that installation for burning on which in fuel quality manure of farm animals is used completely conforms to the special requirements stated in Section 5 of Chapter IV;
2) the procedure of authorization by Environmental protection agency is performed according to article 25 of the Law No. 209/2016 on waste and article 12 of the Law No. 1422/1997 on protection of atmospheric air, including necessary measurements concerning temperature and emissions. Permission is issued after results of these checks show compliance to the specific requirements stated in Section 5 of Chapter IV;
3) combustion of meat and bone meal on the installations on burning or joint burning specified in Section 5 of Chapter IV is not allowed.
14. Operators shall provide that the overworking installations and other objects which are under their control conformed to the requirements stated in Section 1 of Chapter V.
15. The national agency on safety of foodstuff (further - the Agency) issues veterinary and sanitary permission, according to article 18 of the Law No. 221/2007 on veterinary and sanitary activities, to the installations meeting the requirements provided in Section 1 of Chapter V only overworking; the relevant allowing act is included in the List of allowing documents approved by the Law No. 160/2011o regulation of business activity by permission.
16. Operators shall provide that the processing enterprises which are under their control carried out:
1) the hygienic and production requirements stated in Section 2 of Chapter V;
2) the standard methods of conversion provided in Section 3 of Chapter V provided that the corresponding methods are used in this object or installation;
3) the alternative methods of processing provided in Section 4 of Chapter V provided that the corresponding methods are used in this object or installation.
17. Operators provide that the installations and objects which are under their control conformed to the requirements for conversion of offal of animal origin and derivative products stated in Chapter VI in biogas or compost.
18. Transportation, use and destruction of samples for researches and diagnostics are allowed on condition of ensuring risk control for human health and animals and in case of observance by operators of the requirements stated in Section 1 of Chapter VII.
19. Operators follow special rules concerning samples for researches and diagnostics stated in Section 1 of Chapter VII.
20. Transportation, use and destruction of trade samples as the offal of animal origin or derivative products intended for certain researches or analyses, for production process implementation including conversion of offal of animal origin or derivative products, production of forages for animals, forages for unproductive animals or derivative products or for testing of machines, the equipment or products for exhibitions in the conditions providing risk control for human health and animals and observance of requirements of Section 1 of Chapter VII by operators are permitted.
21. Operators are allowed to feed animals of zoo, fur animals, farmer dogs (from acknowledged packs), dogs and cats from shelters, larvae and worms for fishing bait, circus animals with the materials of 2nd or 3rd categories occurring from animals who were not killed or do not fire as a result of availability or suspicion on availability of disease, inoculable for people or animals, on condition of observance of requirements of Section 2 of Chapter VII.
22. Use of the materials of the 1st category consisting of the whole hulks or parts of the fallen animals containing material with certain risk for feeding is allowed:
1) in feeding points, according to the requirements stated in Section 2 of Chapter VII, wild animal of the types which are under the threat of disappearance or protected species of the birds deathbirds and other types living in their native habitat for the purpose of assistance to preserving biodiversity;
2) out of feeding points, as necessary, without preliminary collection of the fallen animals, wild animal endangered species or protected species of the birds deathbirds and other types living in their native habitat for the purpose of assistance to preserving biodiversity, on condition of observance of the requirements provided in Section 2 of Chapter VII.
23. Use of the material of the 1st category consisting of the whole hulks or parts of the fallen animals containing material of extra risk, and the material received from animals of zoo for feeding of animals of zoo on condition of observance of requirements of Item 210 is allowed.
24. Destruction of offal of animal origin, in departure from provisions of Items and), c), c) and d) and e) article 19 of the Law No. 129/2019 on the offal of animal origin and derivative products which are not intended for consumption by the person on condition of observance of the requirements stated in Section 3 of Chapter VII is allowed.
25. Operators shall provide that offal of animal origin and derivative products conformed to requirements for collection, transportation and identification, established in Sections 1 and 2 of Chapter IX, and were followed, during transportation by the veterinary sanitary certificate, according to requirements of Section 3 of Chapter IX, and the allowing act shall be included in the List of allowing documents approved by the Law on regulation of business activity by permission No. 160/2011.
26. The operators performing sending, transportation or receipt of offal of animal origin or derivative products store transport records and sanitary and veterinary certificates, and the allowing act shall be included in the List of allowing documents approved by the Law on regulation of business activity by permission No. 160/2011, according to the requirements provided in Section 4 of Chapter IX.
27. Operators shall observe requirements to marking of certain derivative products, according to Section 5 of Chapter IX.
28. The agency issues veterinary and sanitary permission, according to article 18 of the Law No. 221/2007 on veterinary and sanitary activities, included in the List of the allowing documents approved by the Law No. 160/2011 on regulation of business activity by permission, to several objects or installations, located in one place provided that their arrangement and method of the address with offal of animal origin and derivative products excludes transfer of risks for human health and animals between objects or installations.
29. Operators shall provide that the objects and installations which are under their control, authorized by the Agency conformed to the requirements established in:
1) Item 257, if they make forages for animals;
2) Items with 258 on 264 if they store offal of animal origin and handle offal of animal origin after their collection, by means of the following transactions:
a) sorting;
b) cutting;
c) chilling;
d) freezing;
e) salting;
f) conservation by means of other processes;
g) removal of skins and skin or removal of materials of extra risk;
h) the transactions including the address with offal of animal origin;
i) gigiyenization / pasteurization of the offal of animal origin intended for conversion in biogas/composting before their conversion or pledging in compost on other objects or installations, according to Chapter VI;
j) sifting;
3) Items 265-270, in case of storage of the derivative products intended for the particular purposes established in Item j) parts (2) article 22 of the Law No. 129/2019 on the offal of animal origin and derivative products which are not intended for consumption by the person;
4) Items 273-283, in case of storage on object of the offal of animal origin intended for the subsequent destruction according to article 6 of the Law No. 129/2019 on the offal of animal origin and derivative products which are not intended for consumption by the person.
30. Operators of installations or objects shall handle the offal of animal origin and derivative products in accordance with the terms stated in Items 271 and 272.
31. The operators transporting offal of animal origin or derivative products, except for transportations between two Items of the same operator shall comply with the conditions stated in Item 272.
32. Items 30 and 31 are not applied to:
1) to operators for whom transportation of offal of animal origin or derivative products is minor activities;
