About approval of the Procedure for creation of monitoring groups and carrying out monitoring

According to Item 6-1 of article 104 of the Code of the Republic of Kazakhstan "About health of the people and health care system", PRIKAZYVAYU:

1. Approve the enclosed Procedure for creation of monitoring groups and carrying out monitoring according to appendix to this order;

2. To provide to committee of sanitary and epidemiologic control of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on the Internet resource of Committee of sanitary and epidemiologic control of the Ministry of Health of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Legal support division of Committee of sanitary and epidemiologic control of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-chairman of Committee of sanitary and epidemiologic control of the Ministry of Health of the Republic of Kazakhstan

4. This order becomes effective after ten calendar days after day of its first official publication.

Procedure for creation of monitoring groups and carrying out monitoring

Chapter 1. General provisions

1. This Procedure for creation of monitoring groups and carrying out monitoring (further – the Procedure) is developed according to Item 6-1 of article 104 of the Code of the Republic of Kazakhstan "About health of the people and health care system" (further – the Code) and determines procedure for creation of monitoring groups and carrying out monitoring.

2. In this Procedure the following basic concepts are used:

1) local executive body (akimat) – the collegiate executive body headed by the akim of area, city of republican value and the capital, area (city of regional value), exercising within the competence local public administration and self-government in the corresponding territory;

2) restrictive actions, including quarantine (further – rationing arrangements) – the measures directed to prevention of spread of infectious and parasitic diseases and providing specific mode of business and (or) other activity;

3) electronic information resources (further - information resource) – information in electronic and digital form containing on the electronic medium and in objects of informatization.

Chapter 2. Procedure for creation of monitoring groups

3. For the purpose of ensuring compliance with restrictive actions, including quarantine, monitoring groups (further – MG) are created on the corresponding administrative and territorial units by local executive bodies according to Item 6-1 of article 104 of the Code.

4. The head of MG provides coordination of activities of MG, registration of acts of purpose of carrying out monitoring, introduction of data by results of its carrying out on information resource intended for registration of carrying out monitoring.

Chapter 3. Procedure for carrying out monitoring

5. MG perform carrying out monitoring of respect by physical persons and legal entities of public order, the sanitary and anti-epidemic, sanitary and preventive and rationing arrangements connected with the prevention of threat of spread of infectious diseases.

6. The list of the physical persons and legal entities which are subject to monitoring is determined taking into account epidemiological situation on the corresponding administrative and territorial unit and the addresses of physical (legal) persons, and (or) information which arrived from law enforcement agencies, and also other state bodies, messages of mass media.

7. The head of MG on daily basis creates the list of physical persons and legal entities according to Item 8 of this Procedure.

8. Before carrying out monitoring the head of MG performs:

1) creation of the act of purpose of carrying out monitoring of physical person or legal entity in form according to appendix 1 to this order;

2) registration of the act of purpose of carrying out the monitoring on information resource intended for registration of carrying out monitoring by filling of the relevant data (structure of monitoring group, the site of the territory which is subject to monitoring, details of physical person and legal entity in case of their availability, the term of carrying out monitoring, other data on possible risks of violation of rationing arrangements).

9. Carrying out monitoring of physical persons and legal entities is performed within 24 hours from the moment of registration of the act of purpose of carrying out monitoring.

10. In case of visit of the physical person and legal entity which is subject to monitoring, members of MG provide for acquaintance to physical person and legal entity or its representative the act of purpose of carrying out monitoring.

Opportunity to make sure about registration carrying out monitoring on information resource according to unique number of the act of purpose of carrying out monitoring is explained to physical person and legal entity.

11. The MG carries out monitoring of observance of requirements of regulatory legal acts by physical persons and legal entities in the sphere of sanitary and epidemiologic wellbeing of the population, the officials identified according to competence when implementing the state control and supervision in the sphere of sanitary and epidemiologic wellbeing of the population, stipulated in Article 38 Codes, namely:

1) observance of requirements to activities restriction (operating mode);

2) observance of requirements of restriction of holding festive, commemorative, family events (banquets, commemoration) and other actions with mass accumulation of people;

3) observance of limit of number of visitors;

4) observance of social distance;

5) wearing medical or fabric masks, except for children under five years, meal cases in places of public catering and persons who are engaged in individual, group sports activities in case of observance of social distance.
