ORDER OF THE STATE COMMITTEE OF NUCLEAR REGULATION OF UKRAINE

About approval of Rules of physical protection of nuclear installations and nuclear materials

(as amended on 27-05-2021)

According to the international obligations following from the Convention on physical protection of nuclear material of 1980 which participant is Ukraine, the Law of Ukraine "About use of nuclear energy and radiation safety", the Law of Ukraine "About physical protection of nuclear installations, nuclear materials, radioactive waste, other sources of ionizing radiation", the Regulations on the State committee of nuclear regulation of Ukraine approved by the Presidential decree of Ukraine of 06.03.2001 of N 155, and also for the purpose of ensuring regulation of activities in the field of physical protection of nuclear installations and nuclear materials of PRIKAZYVAYU:

1. Approve Rules of physical protection of nuclear installations and nuclear materials (further - Rules) which are applied.

2. To the head of department of regulation of physical protection Cnut Yu. M. after signing of this order to submit it within five-day term on state registration in the Ministry of Justice of Ukraine.

3. In a month after entry into force of this order to provide to the director of the State company of GNTTs YaRB Vasilchenko V. M. its replication.

4. Declare invalid the order of Public administration of nuclear regulation of Ukraine of 27.09.99 N34 "About Approval of Rules of Physical Protection of Nuclear Material and Nuclear Installations" registered in the Ministry of Justice of Ukraine on November 2, 1999 for N748/4041.

5. I reserve control over the implementation of the order.

Rules of physical protection of nuclear installations and nuclear materials

Rules of physical protection of nuclear installations and nuclear materials (further - Rules) are developed according to the provisions "Conventions on Physical Protection of Nuclear Material", the Laws of Ukraine "About use of nuclear energy and radiation safety", "About physical protection of nuclear installations, nuclear materials, radioactive waste, other sources of ionizing radiation", "About fight against terrorism", "About the permitting activities in the field of use of nuclear energy", "About information", "About the state secret", "About transportation of dangerous goods", resolutions of the Cabinet of Ministers of Ukraine, other regulatory legal acts of rather physical protection of nuclear installations and nuclear materials (further - physical protection), taking into account recommendations of the information circular letter of IAEA "Physical protection of nuclear material and nuclear installations" of INFCIRC/225/Rev.4.

Rules extend to the nuclear materials and installations which are used in the peace purposes and are obligatory for all executive bodies, legal entities who:

- perform production, processing, storage, transportation of nuclear materials and operate nuclear installations;

- develop regulations on physical protection, control their accomplishment, carry out inspections and testing of technical means of physical protection;

- provide realization and undertake measures for physical protection.

Provisions of Rules do not extend to ensuring physical protection of nuclear materials in quantities, smaller the lower bound of III category of nuclear materials, and also on ensuring physical protection of products which contain the grown poor uranium.

1. General provisions

1.1. Activities of the operating organization and the licensee at stages of lifecycle of nuclear installation are forbidden, in case of the treatment of nuclear materials and in transit nuclear materials without ensuring physical protection according to the legislation.

1.2. In these Rules terms and determinations are used in such value:

identification - function of system of physical protection which consists in factual determination of unauthorized penetration into zones of restriction of access and identification of other illegal actions of rather nuclear installations and nuclear materials;

the internal offender - person who performed or tries to perform illegal action (or failure to act) rather nuclear installation and nuclear material, and also person helping it which have the authorized access to nuclear installation;

the zone of interior - zone in the protected zone where nuclear material I of category is used and/or stored;

intervention - any intentional action directed to removal from system of technical means of system of physical protection and especially important technical elements of nuclear installation;

glubokoeshelonizirovanny protection - the principle according to which offender for accomplishment of the task it is necessary to overcome or bypass consistently numerous similar or different obstacles and methods of physical protection (constructional, technical, personnel and organizational);

the differentiated approach - the principle according to which the level of physical protection is established proceeding from categories of nuclear material and nuclear installation, project threat, potential effects of making of diversions or theft of nuclear material;

the prohibited zone - the site located between external and internal barrier of perimeter of the protected zone;

means of identification - the technical device intended for automatic giving of alarm signal in case of illegal actions;

access control facility - the means intended for management of access to access restriction zone;

delay - function of system of physical protection which consists in delay of actions of the offender in case of accomplishment of the task by it;

the protected zone - the territory surrounded with physical barrier which is under protection in which internal and especially important zones, nuclear installations and nuclear materials II of category are placed;

the balanced protection - the principle according to which the offender will meet effective elements of system of physical protection irrespective of the methods of accomplishment of the task chosen by it;

the external offender - person who performed or tries to perform illegal action (or failure to act) rather nuclear installation and nuclear material, and also person helping it which have no the authorized access to nuclear installation;

identification of person - establishment of compliance of the identification signs of the person entered in documents or the database, to the actual signs of the person;
