Based on item 4 of article 21 of the Law of the Republic of Belarus of June 18, 2019 No. 198-Z "About radiation safety", the paragraph of the fourth of part three of article 6 of the Law of the Republic of Belarus of July 30, 2008 No. 426-Z "About use of atomic energy", subitem 7.4 of Item 7 of the Regulations on the Ministry of Emergency Situations of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 29, 2006 No. 756, the Ministry of Emergency Situations of the Republic of Belarus DECIDES:

1. Approve regulations and rules on ensuring nuclear and radiation safety "Requirements to ensuring physical protection of nuclear materials in transit" (are attached).

2. This resolution becomes effective after its official publication.

Chapter 1. General provisions

1. Regulations and rules on ensuring nuclear and radiation safety "Requirements to ensuring physical protection of nuclear materials in transit" (further - Rules) establish technical requirements to safe handling of sources of ionizing radiation and radiation objects, including of subjects to use of atomic energy, regarding ensuring the physical protection connected with safe transportation of nuclear materials I, II and III of categories (further if other is not determined, - YAM) automobile and by rail on the territory of the Republic of Belarus.

2. Transportation of YAM air and inland water transport are performed according to the legislation in the field of use of airspace and aircraft and the legislation in the field of inland water transport.

3. Requirements of these rules do not extend to inside transportation of YAM on the territory of the operating organization (further - EO) if such transportations are performed without exit to highways and railway tracks public.

4. Requirements for ensuring physical protection in case of inside transportation of YAM on the territory of EO are established by local legal acts EO by results of the carried-out analysis of vulnerability and efficiency evaluation of system of physical protection.

5. HOLES on the territory of the Republic of Belarus are transported on condition of ensuring their physical protection, compliance with law in the field of transportation of dangerous goods and the legislation in the field of ensuring nuclear and radiation safety.

6. For the purposes of these rules terms and their determinations in the values established by the Law of the Republic of Belarus of July 30, 2008 No. 426-Z "About use of atomic energy", the Regulations on physical protection of subjects to use of atomic energy approved by the resolution of Council of Ministers of the Republic of Belarus of June 14, 2019 No. 385 (further - Regulations on physical protection), and also the following terms and their determinations are used:

the consignor - the legal entity performing departure of YAM and specified in carriage documents;

the consignee - the legal entity authorized on receipt of YAM and specified in carriage documents;

transportation of YAM - movement of YAM by the vehicle from the point of departure of the consignor (from nuclear installation or Item of storage of YAM) and to destination of the consignee (on nuclear installation or Item of storage of YAM);

carrier - the organization transporting YAM according to the signed transportation agreement;

employees (personnel) of divisions of physical protection - employees (personnel) of security service and (or) internal troops of the Ministry of Internal Affairs (further - internal troops).

Chapter 2. Ensuring physical protection of YAM in transit

7. Ensuring physical protection of YAM is in transit reached in the way:

realization of organizational measures;

uses of technical means of physical protection (further - ITSFZ), locks and seals;

actions of workers (personnel) of divisions of physical protection and response forces.

8. Accomplishment of tasks of physical protection of YAM in transit, stipulated in Item 18 Regulations on physical protection, are reached:

8.1. regarding the prevention of unauthorized actions (further - NSD):

the organization of the admission of persons involved in transportation of YAM;

restriction of information access, YAM connected with transportation;

equipment of the ITSFZ vehicle;

transportation of YAM in the closed vehicle, special cargo section and (or) shipping protective container (transport packaging set);

taking measures, the persons involved in preparation of NSD directed to identification;

8.2. regarding timely detection of NSD:

ensuring control of the vehicle with YAM along the line;
