About purchases of goods (works, services) by the organizations which are a part of the system Energy ministries

Based on part one of Item 2 and Item 3 of article 13 of the Law of the Republic of Belarus of July 13, 2012 No. 419-Z "About public procurements of goods (works, services)", parts one of subitem 2.13 of Item 2 of the resolution of Council of Ministers of the Republic of Belarus of March 15, 2012 No. 229 "About enhancement of the relations in the field of purchases of goods (works, services) at the expense of own means", Item 7 of the Regulations on the Department of Energy of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1595, the Department of Energy of the Republic of Belarus DECIDES:

1. Establish the following features of implementation of purchases of goods (works, services) at the expense of own means the organizations which are a part of the system Energy ministries (further if other is not determined, - the Ministry of Energy organizations), except for purchases of goods (works, services) at the expense of own means according to appendix 1 to the resolution of Council of Ministers of the Republic of Belarus of March 15, 2012 No. 229:

1.1. the organizations of the Ministry of Energy apply preferential amendments to the prices of proposals of potential suppliers (contractors, contractors) in the amount of:

20 percent to bid price of the supplier (the contractor, the contractor) offering goods (works, services) self-produced the organizations of public association of disabled people in which the number of disabled people constitutes at least 50 percent of payroll number of workers;

15 percent to bid price of the supplier (the contractor, the contractor) offering goods (works, services) origins of the Republic of Belarus;

1.2. centralization of purchases of goods for needs of the organizations of the Ministry of Energy is performed:

in Belenergosnabkomplekt open joint stock company according to the inventory determined taking into account specifics of energy industry;

in Beltopgazkomplekt open joint stock company according to the inventory determined taking into account specifics of gas and peat industries;

1.3. the preferential amendments to the prices of proposals of potential suppliers (contractors, contractors) specified in subitem 1.1 of this Item:

1.3.1. are not applied in the relation:

parts of goods (works, services) which are purchase subject, including its lot (part);

goods (works, services) which are purchase subject in case of submission of offers only the participants having the right to application of the preferential amendment of the identical size;

1.3.2. are applied in case of provision by the potential supplier (the contractor, the contractor) of the following documents confirming the right to application of the preferential amendment:

in the amount of 20 percent - the document signed by the head of the organization of public association of disabled people in which the number of disabled people constitutes at least 50 percent of payroll number of workers, or person authorized by it not earlier than before five working days about day of submission of the offer for participation in procurement procedure, with indication of total quantity of workers, number of disabled people, numbers of certificates of the disabled person and terms of their action, and also the certificate of products (works, services) of own production issued by the Belarusian Chamber of Commerce and Industry or its unitary enterprises, their representations and branches or its copy;

in the amount of 15 percent for goods - one of the following documents:

the document on goods origin issued by the Belarusian Chamber of Commerce and Industry or its unitary enterprises according to the criteria of determination of the country of goods' origin provided by the Rules of determination of the country of goods' origin which are integral part of the Agreement on Rules of determination of the country of goods' origin in the Commonwealth of Independent States of November 20, 2009 or its copy;

the certificate of self-produced products issued by the Belarusian Chamber of Commerce and Industry or its unitary enterprises, their representations and branches or its copy. In case of submission of the specified document by the participant who is not the producer of the goods offered in procurement procedure also the document (the agreement, the power of attorney or other document) confirming competence to use of such certificate by the participant is submitted;

in the amount of 15 percent for works (services) - the certificate on state registration of the legal entity or the individual entrepreneur issued by authorized body of the Republic of Belarus.

2. Determine that:

2.1. the Belenergosnabkomplekt open joint stock company is organizatorom1 centralized public procurements of goods for needs of the organizations of the Ministry of Energy for the inventory determined taking into account specifics of energy industry;

2.2. the Beltopgazkomplekt open joint stock company is organizatorom1 centralized public procurements of goods for needs of the organizations of the Ministry of Energy for the inventory determined taking into account specifics of gas and peat industries;

2.3. services of the organizers specified in subitems 2.1 and 2.2 of this Item are paid by the organizations of the Ministry of Energy at the expense of own means of these organizations.

3. Operation of this resolution does not extend to purchases if contracts are signed or procedures of purchases are begun to its introduction in force. The specified purchases come to the end according to the legislation existing before entry into force of this resolution.

4. This resolution becomes effective in month after its official publication.
