This resolution partially shifts the Directive 2006/126/EU of the European Parliament and Council of December 20, 2006 about car driver licenses (new edition) (the text concerns the EEA) published in the Official magazine of the European Union by L 403 of December 30, 2006 with the last amendments made by the Directive (EU) 2020/612 Commissions of May 4, 2020.

1. Approve Regulations on the procedure of holding examination for receipt of the right to control of vehicles, about procedure for issue and effective period of the car driver license it (is applied).

2. To provide to the Ministry of Internal Affairs, public institution "Agency of the state services", the Ministry of Health, the Ministry of Education and Research, National inspectorate for probation and the Agency of electronic control application of the Regulations on the procedure of holding examination for receipt of the right to control of vehicles, about procedure for issue and effective period of the car driver license, according to industries of competence and the established procedures.

3. Declare invalid the Order of the Government No. 1452/2007 about approval of the Regulations on the car driver license, the organization and holding examination on receipt of the car driver license and admission conditions to traffic (The official monitor of the Republic of Moldova, 2008, Art. No. 8-10, 42), with subsequent changes.

Regulations on the procedure of holding examination for receipt of the right to control of vehicles, about procedure for issue and effective period of the car driver license

I. General provisions

1. The regulations on the procedure of holding examination for receipt of the right to control of vehicles, about procedure for issue and effective period of the car driver license (further - the Provision) establish the procedure of holding examination for receipt of the right to control of vehicles, and also conditions of receipt of the car driver license.

2. Public institution "Agency of the state services" is authorized body in the area connected with the organization and process of holding examination for receipt of the right to control of vehicles, documentation by the car driver license with centralized accounting of these documents, their status and owners.

Functioning of technical and applied complex of public institution "Agency of the state services" is integrated into the Automated information system "State Register of Transport Drivers" which holder is Public institution "Agency of the state services".

3. Examination for receipt of the right to control of vehicles is held in competent territorial subdivisions of public institution "Agency of the state services" (further - competent divisions).

The quantity, territorial arrangement of competent divisions and procedure for servicing of the population when rendering services in holding examination and to documentation by the car driver license are determined by public institution "Agency of the state services".

4. It is not allowed to examination and/or it is not documented by the car driver license, including the international car driver license, person whose examination file is incomplete contains documents which are not authentic and/or reliable, and also in cases when when checking the applicant through accounting records of public institution "Agency of the state services" about restrictions for documentation with the car driver license, and also accounting records of the Ministry of Internal Affairs about the restrictions applied concerning the rights to control of vehicles the restrictions registered on his name concerning deprivation of the right to control of vehicles, cancellation of the right to control of vehicles and also in cases of temporary withdrawal of the car driver license as the measure of restraint applied by court, except as specified come to light when person petitions for recovery in the right to control of vehicles after the term of withdrawal or for recovery of the cancelled right to control of vehicles according to this Provision.

When checking persons through accounting records of the Ministry of Internal Affairs public institution "Agency of the state services" uses data on the restrictions applied concerning the right of control of vehicles in information systems of this ministry.
