1. Approve the enclosed Rules of maintaining the register of authorized representatives.

2. In the procedure established by the legislation to provide to department of economic concentration and control of the state companies of the Agency on protection and development of the competition of the Republic of Kazakhstan (further – the Agency):

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Agency after its official publication.

3. To impose control of execution of this order on the supervising vice-chairman of the Agency.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining register of authorized representatives

Chapter 1. General provisions

1. These rules of maintaining the register of authorized representatives (further – Rules) are developed according to Item 10 of article 210-1 of the Entrepreneurial code of the Republic of Kazakhstan (further – the Code) and determine procedure for maintaining the register of authorized representatives (further – the Register).

2. In these rules the following concepts are used:

1) the authorized representative – person who has special scientific or practical knowledge of the questions which are subject of economic concentration;

2) the candidate – person offered by consolidation of subjects of entrepreneurship for inclusion in the Register.

3. Other concepts used in these rules are determined in the Entrepreneurial code of the Republic of Kazakhstan.

Chapter 2. Procedure for maintaining register of authorized representatives

4. The antimonopoly authority creates and keeps the Register in form according to appendix to these rules.

5. The Register joins the candidates offered by associations of subjects of entrepreneurship.

6. For inclusion in the Register of consolidation of subjects of entrepreneurship send the following documents to antimonopoly authority:

1) idea of inclusion of the candidate for the Register;

2) written consent of the candidate for inclusion in the Register;

3) copy of the identity document of the candidate;

4) record of service (list of data on education, work, labor activity of the candidate).

7. The basis for exception of the authorized representative of the Register is violation of requirements of article 210-1 of the Code by it.

8. The decision on inclusion (exception) of authorized representatives in the Register (from the Register) is drawn up by the order of the head of the antimonopoly authority or person fulfilling its duties no later than ten working days from the date of receipt in antimonopoly authority of idea of inclusion of the candidate for the Register or data on violation by the authorized representative of requirements of article 210-1 of the Code.

9. Information on inclusion (exception) of the authorized representative in the Register (from the Register) goes to this person no later than five working days from the date of adoption of the relevant decision.

10. The register, is published on official Internet resource of antimonopoly authority.
