The State Parties of the Commonwealth of Independent States on behalf of the governments (further - the Parties),

aiming at further development of humanitarian cooperation between them,

proceeding from provisions of the Declaration on humanitarian cooperation of the State Parties of the Commonwealth of Independent States of May 8, 2005 and the Agreement on humanitarian cooperation of the State Parties of the Commonwealth of Independent States of August 26, 2005,

agreed as follows:

Article 1

1. Create Interstate fund of humanitarian cooperation of the State Parties of the Commonwealth of Independent States (далееФонд).

2. Approve the Fund charter which is integral part of this Agreement it (is applied).

Article 2

1. The fund is legal entity.

2. Founders of Fund are the Parties.

3. The place of stay of Fund - the city of Moscow.

4. The fund can create the departments, branches, representations in the territories of the Parties according to their legislation.

Article 3

1. The property of Fund is created for the account:

voluntary contributions of the Parties on joint actions (projects) in the field of culture, educations, sciences, archiving, information and mass communications, sport, tourism and work with youth in the form of financial and appliances, resources, works and services;

voluntary contributions and donations of legal entities and physical persons;

receipts from holding charitable and cultural actions, lotteries;

other sources which are not prohibited by the current legislation of the state of residence of Fund and the current legislation of the states in the territory of which authorized activities of Fund are performed.

2. Voluntary contributions and revenues to holding joint actions (projects) of humanitarian cooperation are performed in national currencies of the Parties, currencies of other states, and also in the form of financial and appliances, resources, works and services.

3. The property of Fund goes for accomplishment of the purposes determined by the Fund charter.

4. The fund annually publishes the report on use of the property in official publication according to the legislation of the state of its residence.

Article 4

1. The supreme body of Fund is the Board.

2. Executive body of Fund is the Executive directorate.

3. Supervisory authority of Fund is the Board of trustees.

4. The procedure for forming and activities of the specified bodies is regulated by the Fund charter.

Article 5

This Agreement becomes effective from date of delivery to depositary of the third written notice of accomplishment by the Parties of the interstate procedures necessary for entry into force which signed it.

For the Parties which performed interstate procedures later the Agreement becomes effective from date of delivery to depositary of adequate notices.

Article 6

By mutual consent of the Parties changes and additions which are drawn up by the separate protocols which are its integral part and becoming effective according to the procedure, stipulated in Article the 5th this Agreement can be made to this Agreement.

Article 7

This Agreement is open for accession to it of other State Parties of the Commonwealth of Independent States ready to assume liabilities following from this Agreement by transfer to depositary of documents on such accession.

Article 8

Each Party can withdraw from this Agreement, having sent to depositary the written notice of the intention to withdraw from the Contract. For this Party the Agreement terminates after six months from the date of receipt by depositary of the written notice.

It is made in the city of Dushanbe on May 25, 2006 in one authentic copy in Russian. The authentic copy is stored in Executive committee of the Commonwealth of Independent States which will send to each state which signed this agreement, its verified copy.
