About appointment and leave of the compensated drugs and/or medical products from funds of compulsory medical insurance

Based on part provisions (5) Article 5 and part (2) article 7-1 of the Law No. 1585/1998 on compulsory medical insurance (The official monitor of the Republic of Moldova, 1998, Art. No. 38-39, 280), with subsequent changes, DECIDES: the Government

1. Approve:

1) Regulations on appointment and leave of the compensated drugs and medical products from funds of compulsory medical insurance, according to appendix No. 1;

2) Criteria of the conclusion of contracts with suppliers of pharmaceutical services in system of compulsory medical insurance, according to appendix No. 2;

3) the Standard agreement about leave of the drugs and/or medical products compensated from funds of compulsory medical insurance according to appendix No. 3.

2. Provide to national medical insurance company the conclusion of contracts with suppliers of pharmaceutical services according to provisions of this resolution.

3. Declare invalid the Order of the Government No. 1372/2005 about procedure for compensation of medicines according to conditions of compulsory medical insurance (The official monitor of the Republic of Moldova, 2005, Art. No. 176-181, 1477), with subsequent changes.

4. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

Regulations on appointment and leave of the compensated drugs and/or medical products from funds of compulsory medical insurance

I. General provisions

1. Regulations on appointment and leave of the compensated drugs and medical products from funds of compulsory medical insurance (further – the Provision) establish procedure for appointment and leave of the compensated drugs and medical products for out-patient treatment of persons registered at the family doctor according to the Single program of compulsory medical insurance.

2. Purpose of the compensated drugs and medical products is performed in electronic form according to this Provision by means of the Information system "The Electronic Recipe on the Compensated Drugs and Medical Products" (further – IS "eReteta") which represents module/subsystem of the Integrated information system "Compulsory medical insurance".

3. IS "eReteta" is operated by National medical insurance company. Its main objective is digitalization of process of writing out of the recipe on the compensated drugs and medical products and their leaves.

4. The list of the drugs and medical products compensated from funds of compulsory medical insurance (further – the List), including fixed amounts of their compensation, affirms the order of the Minister of Health and CEO of National medical insurance company and is published in the Official monitor of the Republic of Moldova.

5. Compensation of drugs and medical products from the List is performed within the financial resources provided in the law on funds of compulsory medical insurance the current year.

II. Purpose of the compensated drugs and medical products

6. The compensated drugs and medical products are appointed to persons registered at the family doctor for application in out-patient conditions.

7. Have the right to appoint the compensated drugs and medical products:

1) family doctors and specialists doctors – to persons registered at the supplier of medical services of primary medical care;

2) specialists doctors within specialized out-patient medical care on condition of registration of visit of the patient in the Information system "Primary Medical Care";

3) the specialists doctors of the receptions of emergency medical service (REMS) owning information system of accounting of medical services – after consultation of insured persons without indications to hospitalization;

4) the doctors rendering communitarian medical care and home care, and also palliative care at home (further – the doctors having the appointment right), from the medical institutions which signed with National medical insurance company the agreement on rendering medical services within compulsory medical insurance (further – suppliers of medical services).

8. Family doctors have the right to appoint all range of medicines according to the International classification of diseases (MKB-10), and specialists doctors – only according to the MKB-10, codes characteristic of profile.

9. Suppliers of medical services by the internal order appoint as a part of organization of the administrator who manages the list of users of IS "eReteta" and bears responsibility for updating of data on their employment, the translation, resignation/dismissal, etc. within 3 days from the moment of emergence of changes.

10. After establishment of the diagnosis and the scheme of treatment the doctor having the appointment right checks whether drugs enter the List and whether correspond to the therapeutic indication for which compensation is provided. Further the doctor appoints drugs in IS "eReteta" and applies the qualified digital signature.

11. In case of departure the doctor appoints the compensated drugs and medical products on the prescription form which is previously printed out from IS "eReteta" in duplicate on which he applies the sign manual and personal seal to the house.

12. In case of children aged up to 16 years or at the request of the patient the doctor having the appointment right in addition specifies in the recipe of IDNP of the legal representative or person designated by the patient for receipt of drugs / medical products from drugstore, on condition of provision of written consent to processing of personal data of person designated by the patient.

13. The compensated drugs are appointed only according to the international name, and medical products – according to the general name from the List, without specifying of the producer, model or other specifications.
