1. Approve the enclosed Standard of delivery of health care in stationary conditions in the Republic of Kazakhstan according to appendix 1 to this order.

2. Recognize invalid some orders of the Ministry of Health of the Republic of Kazakhstan according to appendix 2 to this order.

3. To provide to department of the organization of medical care of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation to the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

The standard of delivery of health care in stationary conditions in the Republic of Kazakhstan

Chapter 1. General provisions

1. This Standard of the organization of delivery of health care in stationary conditions in the Republic of Kazakhstan (further – the Standard) is developed according to the subitem 32) of article 7 of the Code of the Republic of Kazakhstan "About health of the people and health care system", the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" and establishes procedure for rendering the state services "Issue of the Direction to Patients on Hospitalization in Hospital", "Issue of the Statement from the Medical Record of the Inpatient", "Issue of the Conclusion about Needs in Sanatorium Treatment" in case of delivery of health care in stationary conditions.

2. The terms and determinations used in this Standard:

1) the organization of health care – the legal entity performing activities in the field of health care;

2) authorized body in the field of health care (further – authorized body) – the central executive body performing management and cross-industry coordination in the field of protection of public health of the Republic of Kazakhstan, medical and pharmaceutical science, medical and pharmaceutical education, sanitary and epidemiologic wellbeing of the population, drug circulation and medical products, qualities of rendering medical services (help);

3) the portal of Bureau of hospitalization (further – the Portal) – single system of electronic registration, accounting, processing and storage of the directions of patients for planned hospitalization in hospital within the guaranteed amount of free medical care (further – GOBMP) in system of compulsory social medical insurance (further – OSMS);

4) high-technology medical care (further – VTMP) – part of the specialized medical care provided by profile specialists in case of the diseases requiring application of innovative and (or) unique methods of diagnostics and treatment with scientifically proved efficiency and safety and the technologies developed on the basis of achievements of medical science and allied industries of science and technology;

5) consultation – research of person for the purpose of establishment of the diagnosis, determination of tactics of treatment and the forecast of disease with participation at least three doctors;

6) uslugopoluchatel – physical persons and legal entities, except for the central state bodies, foreign institutions of the Republic of Kazakhstan, local executive bodies of areas, the cities of republican value, the capital, areas, the cities of regional value, akims of areas in the city, the cities of district value, settlements, villages, rural districts;

7) the service provider – the central state bodies, foreign institutions of the Republic of Kazakhstan, local executive bodies of areas, cities of republican value, the capital, areas, cities of regional value, akims of areas in the city, the cities of district value, settlements, villages, rural districts, and also the physical persons and legal entities rendering the state services according to the legislation of the Republic of Kazakhstan;

8) specialized medical care (further – SMP) – the medical care provided by profile specialists in case of the diseases requiring ad hoc methods of diagnostics, treatment, medical rehabilitation including with use of means of remote medical services;

9) the state service – one of the forms of realization of the separate state functions performed in individual procedure according to the address or without address of uslugopoluchatel and directed to realization of their rights, freedoms and legitimate interests, provision of the corresponding material or non-material benefits by it;

10) medical care in stationary conditions – the medical care providing the round-the-clock medical observation, treatment, leaving, and also provisions of bed with food including in case of the cases of therapy and surgery of "one day" providing the round-the-clock observation within the first days after initiation of treatment;

11) the informed consent – the procedure of written voluntary confirmation by person of the consent to receipt of medical care and (or) participation in specific research after receipt of information on all significant for adoption of the decision by it aspects of medical care and (or) research. The informed written consent is drawn up in the form approved by authorized body;

12) the subject of digital health care – the physical persons and legal entities, state bodies performing activities or entering the public relations in the field of digital health care;

13) service of digital documents – the object of information and communication infrastructure of "the electronic government" assigned to the operator and intended for creation, storage and use of electronic documents for the purpose of realization of the state functions and the state services following from them and also in case of interaction with physical persons and legal entities, obtaining and rendering services electronically.

Chapter 2. Procedure for rendering the state services in case of delivery of health care in stationary conditions

Paragraph 1. Procedure for rendering the state service "Issue of the Direction to Patients on Hospitalization in Hospital"

3. Indications for hospitalization – rendering pre-medical, specialized medical care, including using high-technology medical services, with the round-the-clock medical observation of patients in the organizations of health care.

4. Hospitalization of the patient in the organization of health care within GOBMP and (or) in the OSMS system is performed:

1) in planned procedure – in the direction of specialists of primary health care (further – PHC) or the organizations of health care according to the order of the Minister of Health of the Republic of Kazakhstan of December 11, 2020 No. KR DSM-258/2020 "About approval of the list of diseases in case of which specialized medical care in stationary conditions is provided in planned form" (it is registered in the Register of state registration of regulatory legal acts at No. 21784);

2) according to the emergency indications (including days off and holidays) according to the labor law – regardless of direction availability.

5. Planned hospitalization with registration of the direction in the Portal is performed by determination of the planned date of hospitalization taking into account the patient's right to the free choice of the organization of health care:

1) the specialist of hospital with the round-the-clock observation in the direction of the specialist of PHC or the organization of health care irrespective of patterns of ownership;

2) automatic detection in the direction of the specialist of PHC or the organization of health care;

3) the specialist of reception of the organization of health care in case of the independent appeal of patients and the decision of the head on hospitalization of the patient to this organization of health care.

6. Planned hospitalization in hospital on paid basis is performed with obligatory execution of the medical record of the stationary patient approved by the order of the acting minister of health care of the Republic of Kazakhstan of October 30, 2020 No. KR DSM-175/2020 "About approval of forms of accounting documentation in the field of health care" (it is registered in the Register of state registration of regulatory legal acts at No. 21579) (further – the order No. KR DSM-175/2020) and implemented in the Portal in electronic format for the organizations of health care providing medical care on paid basis.
