Section 1. General provisions

Article 1. Purpose and tasks of this Law

The purpose of this Law is ensuring safety, protection and comprehensive effective use of objects of historical and cultural heritage.

Task of this Law is regulation of social legal relations in the field of protection and use of historical and cultural heritage, namely:

- fixing of legal status of objects of historical and cultural heritage;

- regulation of the rights and obligations of public authorities, companies, organizations and organizations, public associations, and also individuals before the people in the field of preserving historical and cultural heritage;

- differentiation of competence of state bodies in protection of historical and cultural heritage;

- establishment of measures of responsibility for the actions or failure to act bringing direct or consequential damage to historical and cultural heritage.

Article 1-1. Subject of regulation of this Law

 This Law establishes precepts of law in the field of protection and use of the objects of historical and cultural heritage in the territory of the Kyrgyz Republic representing unique value for the people.

The law is obligatory for all legal entities and physical persons, determines their rights and obligations in the field of protection and use of objects of historical and cultural heritage.

Article 2. Legislation of the Kyrgyz Republic on protection and use of historical and cultural heritage

The legislation of the Kyrgyz Republic on protection and use of historical and cultural heritage consists of this Law and other regulatory legal acts of the Kyrgyz Republic published according to it and also which came in the procedure established by the law into force of international treaties which participant is the Kyrgyz Republic (further - the international agreements).

Article 3. Historical and cultural heritage

Historical and cultural heritage are the historical and cultural monuments connected with historical events in the life of people, development of society and state, performing material and spiritual creativity representing historical, scientific, art or other value.

The historical and cultural monuments which are in property of the Kyrgyz Republic and subjects of the Kyrgyz Republic are protected by the state.

Article 4. Types of objects of historical and cultural heritage

Material historical evidences can be recognized as objects of historical and cultural heritage immovable and movable (entirely or in the stipulated part):

1. Immovable, including:

- monuments history: buildings, constructions, memorial places, historical necropolises and memorials connected with the major historical events in the life of people, development of society and state, science and technology, culture and life of the people and also with life of outstanding figures of the republic;

- archeology monuments: caves, parking, ancient settlements, tepa, tortkul, remaining balance of ancient settlements, strengthenings, fortification constructions both land, and underwater, ancient productions and mines, channels and irrigating systems, roads and bridges, separate barrows and necropolises, rock drawings and petroglyphic epigrafika;

- monuments of town planning and architecture: architectural complexes and complexes, historic centers, quarters, areas, streets, remaining balance of the ancient layout and building of the cities and other settlements, constructions of civil, industrial, military, cult architecture, national architecture, and also related works monumental, graphic, arts and crafts, landscape gardening and other art forms.

2. Movable, including:

- single objects: archeological finds, objects of antiquity, coin, the elements of immovable monuments which are exposed to partition, anthropological and ethnological materials, historical relics, works of art (painting, graphics, applied art, art of the film and photos), the documentary monuments which are part of National Archive Fund - hand-written, typewritten, graphical, film, documentary photographs, video and sound recordings, and also rare printing editions;

- complex objects: historically developed complexes, funds and collections of the specified single objects taken as a unit and also the complexes, funds and collections of natural-science values having (as whole) the historical importance.

3. Other monuments representing historical, scientific, art and other cultural value also can be carried to objects of historical and cultural heritage.
