About approval of the Procedure for inclusion (exception) of explosive materials of industrial function in (from) the List of the explosive materials of industrial function allowed to permanent production and application

According to article 10 of the Law of Ukraine "About the treatment of explosive materials of industrial function" and for the purpose of safety in case of the treatment of explosive materials of industrial function of PRIKAZYVAYU:

1. Approve the Procedure for inclusion (exception) for explosive materials of industrial function in (from) the List of the explosive materials of industrial function allowed to permanent production and application which is attached.

2. To legal support division (Sukhar A. V.) in accordance with the established procedure to provide provision of this order on state registration in the Ministry of Justice of Ukraine.

3. To State department of industrial safety, labor protection and mountain supervision of the Ministry of Emergency Situations of Ukraine (Savarin M. V.) to include the specified order in the State register of regulatory legal acts on labor protection.

4. To impose control of execution of this order on the chairman of the Gospromgornadzor of the Ministry of Emergency Situations of Ukraine Savarin M. V.

Procedure for inclusion (exception) for explosive materials of industrial function in (from) the List of the explosive materials of industrial function allowed to permanent production and application

1. This Procedure is developed in pursuance of requirements of article 10 of the Law of Ukraine "About the treatment of explosive materials of industrial function".

2. Developed, imported into Ukraine and conversion explosive materials are included in the List of the explosive materials of industrial function allowed to permanent production and application which affirms the order of specially authorized central executive body concerning supervision of labor protection and the state mountain supervision, (further - the List), on condition of carrying out in accordance with the established procedure reception testing and receipt of the certificate of conformity.

3. For inclusion of explosive materials in the List the subject of housekeeping submits to specially authorized central executive body concerning supervision of labor protection and the state mountain supervision the statement on sample which is applied.

Verified copies of the specifications approved and registered in accordance with the established procedure by territorial authorities of Gospotrebstandart of Ukraine on explosive material and the certificate of conformity of explosive material are enclosed to the application properly.

4. Specially authorized central executive body concerning supervision of labor protection and the state mountain supervision within 30 working days after registration of a statement in writing reports to the subject of housekeeping about inclusion of explosive materials in the List or about refusal with proper reasons.

5. The decision on refusal concerning inclusion of explosive materials in the List is made by specially authorized central executive body concerning supervision of labor protection and the state mountain supervision in case of failure to provide necessary documents by the subject of housekeeping and (or) their wrong registration.

6. The exception of explosive materials of the List is performed in case of the termination of effective period of specifications, the certificate of conformity or establishment of discrepancy of characteristics of explosive material to requirements of specifications by the order of specially authorized central executive body concerning supervision of labor protection and the state mountain supervision.

7. Orders on inclusion (exception) of explosive materials in (from) the List of the explosive materials of industrial function allowed to permanent production and application are issued at least once in half a year and published in the Newsletter on labor protection of National research institution of labor protection, the Labor protection magazine and on the website of State department of industrial safety of labor protection and mountain supervision of the Ministry of questions of emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash.
