Based on the Law of the Republic of Belarus of July 22, 2002 "About state registration of real estate, the rights to it and transactions with it" and for the purpose of enhancement of procedure for remote access to the single state register of real estate, the rights to it and transactions with it the State committee on property of the Republic of Belarus DECIDES:

1. Approve the enclosed Instruction about procedure for remote access to the single state register of real estate, the rights to it and transactions with it.

2. Declare invalid the resolution of Committee on land resources, geodesy and cartography under Council of Ministers of the Republic of Belarus of July 17, 2003 No. 7 "About approval of the Instruction about procedure for remote access to the single state register of real estate, the rights to it and transactions with it" (The national register of legal acts of the Republic of Belarus, 2003, No. 91, 8/9845).

1. The instruction about procedure for remote access to the single state register of real estate, the rights to it and transactions with it (further - the Instruction) is developed according to the Law of the Republic of Belarus of July 22, 2002 "About state registration of real estate, the rights to it and transactions with it" (The national register of legal acts of the Republic of Belarus, 2002, No. 87, 2/882) and establishes procedure for provision to state bodies, legal entities and physical persons (further - users) remote access to the single state register of real estate, the rights to it and transactions with it (further - the register of the real estate) for the purpose of receipt of information on real estate, the rights to it containing in it and transactions with it in the amount provided by legal acts.

For the purposes of this Instruction remote access to the register of the real estate is understood as possibility of obtaining by users of the real estate of information on real estate, the rights to it containing in the register and transactions with it from remote electronic computers in real time.

Information obtained with use of remote access to the register of the real estate is provided in the form of electronic messages, and also in the form of electronic documents.

3. Remote access is provided to persons who according to legal acts of the Republic of Belarus have the right to obtain information from the register of the real estate.

4. Users perform information search in the database of the register of the real estate to the address, cadastral (inventory) number, geographical code of the real estate unit, the minimum and maximum coordinates of part of the territory concerning which search is performed. The users having the right to the summarized information according to legal acts of the Republic of Belarus perform information search in the database of the register of the real estate on identification information about owners: surnames, to name, middle name, identification number, birth date, nationality, the residential address of the citizen or full name, number and date of issue of the certificate on state registration of the legal entity or the individual entrepreneur, accounting number of the payer - the legal entity or the individual entrepreneur, to the location address of the legal entity or the residential address of the individual entrepreneur.

5. Users get access to the register of the real estate on paid and non-paid basis according to the legislation of the Republic of Belarus.

6. Remote access to the register of the real estate is provided to users based on the service provision agreement on provision of the remote access to the register of the real estate (daleedogovor) concluded with the republican organization for state registration of real estate, the rights to it and transactions with it (further - the republican organization for state registration).

In the agreement requirements to the electronic computer of the user, data on addresses of the websites on the Internet and about interval of time during which remote access to the register of the real estate, data on procedure for change of passwords of access, phone numbers, names of users, about form and structure of the provided information and other data, stipulated by the legislation or the agreement of the parties is provided to the user are specified.

7. The republican organization for state registration based on the agreement:

establishes on the electronic computer of the user the software for remote access to the register of the real estate or reports what means need to use for receipt of remote access to the register of the real estate;

can change the password of access, having timely informed on it the user.

8. In attempt of access to the register of the real estate with the inadequate password of access or user name information is not provided to the user.

9. Users have the right to use information obtained from the register of the real estate based on the agreement only for own needs and bear responsibility for distribution of such information according to the legislation of the Republic of Belarus.

10. The republican organization for state registration shall provide at the request of the owner to him information on persons and bodies which received data on real estate on which it has the rights.
