About National fund of regional and local development
The parliament adopts this organic law.
This law establishes the general principles of organization, organization, financing and functioning of National fund of regional and local development.
For the purposes of this law the concepts determined in the Law on regional development in the Republic of Moldova No. 438/2006, and also the following basic concepts are used:
executive unit - the public organization providing execution of programs and projects of regional and local development;
the annual plan of financing - the list of programs and projects of regional and local development with indication of the cost of the resources approved by annually National coordination council on regional and local development on each of programs and projects within the available resources.
(1) For financing of the programs and projects of regional and local development included in the Single program document the National fund of regional and local development (further - National fund is established).
(2) the Amount of National fund affirms the annual law on the government budget according to provisions of the Law on public finance and budget and tax responsibility No. 181/2014. The national fund is created of the assignments which are annually approved by the law on the government budget, of sources of the external help and of other sources which are not contradicting the law.
(3) the National fund is operated by the body developing policy of regional development who performs assignment of fund from prior consent of National coordination council for regional and local development.
(4) the Regulations on management of means of National fund affirm the Government.
(5) Annual distribution of the funds allocated to National fund is made separately on accomplishment of the annual plan of financing in the field of regional development and on accomplishment of the annual plan of financing in the field of local development according to the decision of National coordination council in regional and local development.
(6) the Financial resources received by the agencies of regional development from budgets components of the national public budget are controlled through the single treasurer account of the Ministry of Finance, and financial operations on execution of the investment project with financing at the expense of sources of the external help are performed by the agencies of regional development through commercial banks.
(1) Means of National fund are used on the following activities:
1) within programs of regional development:
a) increase in competitiveness of labor power and growth of employment in regions of development;
b) city development, social and economic revival of the cities;
c) improvement of regional technical infrastructure;
2) within programs of local development:
a) improvement of local technical infrastructure;
b) construction and updating of social infrastructure;
c) joint financing of the projects realized at the expense of sources of the external help.
(2) Conditions of assignment of National fund according to activities are provided in regulations on management of means of National fund.
(3) Means of National fund are used for the program implementation and projects provided by the Single program document including for mechanisms of joint financing of the projects realized at the expense of sources of the external help.
Assignment from National fund is performed based on the principles stated in part (2) article 2 of the Law on regional development in the Republic of Moldova No. 438/2006.
(1) Financing of programs and projects of regional development is performed based on tenders on selection of projects which are carried out according to the provision approved by the Government.
(2) the List of the selected programs and projects is generalization of regional operational programs and provides priority programs and projects of regional development the next years.
(3) the List of the programs and projects of regional development approved for financing from resources of National fund joins in the Single program document which affirms the Government.
(1) Financing of programs and projects of local development is performed based on tenders on selection of projects which are carried out based on the provision approved by the Government.
(2) the List of the programs and projects of local development approved for financing from resources of National fund joins in the Single program document.
In the course of forming, use and management of the National Government fund has the following powers:
a) suggests Parliament to approve by means of the annual law on the government budget of assignment in National fund;
b) approves procedure for forming and use of means of National fund;
c) approves regulations on selection and approval of programs and projects of regional and local development;
d) approves the concept and Regulations on management information system by programs and projects of regional and local development;
e) provides technical and methodological support in program implementation and projects of regional and local development.
The national coordination council on regional and local development has the following powers:
a) carries out the powers listed in part (6) article 5 of the Law on regional development in the Republic of Moldova No. 438/2006;
b) approves the decision on distribution of the funds allocated to National fund for annual plans of financing of programs and projects of regional and local development;
c) approves annual plans of separate financing of programs and projects of regional and local development within the approved resources;
d) approves the acceptable fields of financing for tenders on selection of projects, and also the minimum and maximum limit of the financial resources approved for each program and the project on the basis of requirements analysis of development at regional and local level;
e) considers and monitorirut procedure for use of means of National fund.
