About implementation of systems of energy management

According to parts two and the fourth article 12 of the Law of Ukraine "About energy efficiency" the Cabinet of Ministers of Ukraine decides:

1. Approve enclosed:

Procedure for implementation and ensuring functioning of systems of energy management of the public authorities, companies, organizations and organizations relating to the sphere of their management;

Approximate procedure for use of the economy of means which resulted from functioning of system of energy management in public authority.

2. To the public authorities, the companies, organizations and the organizations relating to the sphere of their management till December 31, 2024:

enter and provide functioning of systems of energy management according to the Procedure approved by this resolution;

provide provision to the State agency on energy efficiency and energy saving of information on condition and results of implementation of systems of energy management in the form determined by it;

concerning the buildings which are in ownership and/or use (economic maintaining, operational management) to provide:

initiation of carrying out state registration of the corporeal rights to the respective buildings and the rights of permanent use of the parcels of land on which such buildings are located, according to requirements of the Law of Ukraine "About state registration of the corporeal rights to real estate and their encumbrances";

production of technical data sheets of such buildings;

representation to the State agency on energy efficiency and energy saving of information on production of technical data sheets;

carrying out certification of energy efficiency of buildings according to article 7 of the Law of Ukraine "About energy efficiency of buildings".

To inform on functioning of systems of energy management every half-year till January 31 and till July 31 the State agency on energy efficiency and energy saving in the form determined by it.

2-1. To the ministry of development of communities, territories and infrastructures together with the State agency on energy efficiency and energy saving to perform information and educational activities for implementation and ensuring functioning of systems of energy management, implementation and implementation of energy efficient actions.

3. Recommend to local government bodies to be guided by the Procedure approved by this resolution in case of introduction of systems of energy management (within powers).

4. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

5. To the state agency on energy efficiency and energy saving to submit every half-year till February 20 and till August 20 to the Cabinet of Ministers of Ukraine information on condition of accomplishment of this resolution.

Procedure for implementation and ensuring functioning of systems of energy management of the public authorities, companies, organizations and organizations relating to the sphere of their management

This Procedure determines the mechanism and the principles of implementation and ensuring functioning of systems of energy management and establishes requirements to:

1) stages of implementation of systems of energy management;

2) organizational structure and mechanism of implementation of systems of energy management;

3) energy policy and ensuring its realization by bodies of implementation of systems of energy management;

4) the energy planning performed by bodies of implementation of systems of energy management;

5) procedures of realization of obligatory powers for energy planning, functioning of systems of energy management;

6) monitoring and assessment of indicators of functioning of systems of energy management;

7) forming, maintaining and publication of the national database of energy and operational characteristics of buildings, exchange of information with other electronic systems.

The terms used in this Procedure have the following value:

1) responsible for system of energy management - official (office) person, responsible for the implementation and functioning of system of energy management, from among heads (their deputies) of body of implementation of system of energy management determined according to Item 8 of this Procedure;

2) the declaration of energy policy document, determining intentions of body of implementation of system of energy management by implementation, ensuring further functioning and development of system of energy management, and also the purpose of functioning of system of energy management;

3) energy monitoring (further - energy monitoring) - process of data collection of nodes of commercial, distribution, technological accounting and other means of the measuring equipment, accumulating, processing and reflection of such data with the purpose of efficiency analysis of consumption and energy production (energy carriers) and utilities;

4) the power manager-person, realizing powers on energy monitoring, energy planning, functioning of system of energy management, responsible for the organization of effective use of energy (energy carriers) and utilities, and ensuring implementation of energy efficient projects and actions, implementation of actions for development of renewable energy resources or their set;
