RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

About implementation of systems of energy management

According to part two of article 12 of the Law of Ukraine of October 21, 2021 "About energy efficiency" the Cabinet of Ministers of Ukraine decides No. 1818-IX:

1. Approve the Procedure for implementation of systems of energy management which is applied.

2. To the ministries, other central executive bodies, other state bodies which jurisdiction extends to all territory of Ukraine, Council of Ministers of the Autonomous Republic of Crimea, executive bodies of the Autonomous Republic of Crimea, regional, Kiev and to the Sevastopol city, district, district public administrations, the companies, organizations and the organizations in Kiev relating to the sphere of management of public authorities to provide:

1) within nine months from the date of entry into force of this resolution:

reduction of organizational structure of central offices and territorial authorities of the ministries, other central executive bodies, other state bodies which jurisdiction extends to all territory of Ukraine, the office of Council of Ministers of the Autonomous Republic of Crimea, central offices of executive bodies of the Autonomous Republic of Crimea, devices regional, Kiev and the Sevastopol city, district, district public administrations, the companies, organizations and the organizations in Kiev belonging to the sphere of management of public authorities in compliance with requirements of the Procedure approved by this resolution;

approval and promulgation on own official websites of plans of activities of systems of energy management;

provision of information to the State agency on energy efficiency and energy saving about condition and results of implementation of systems of energy management on the form determined by the Agency;

To provide 2) within 24 months from the date of entry into force of this resolution concerning buildings which are in ownership and/or use (economic maintaining, operational management):

initiation of carrying out state registration of the corporeal rights to the respective buildings and the rights of permanent use of the parcels of land on which these buildings are located, according to requirements of the Law of Ukraine "About state registration of the corporeal rights to real estate and their encumbrances";

production of technical data sheets of such buildings;

submission of information on production of technical data sheets to the State agency on energy efficiency and energy saving;

carrying out certification of energy efficiency of buildings according to article 7 of the Law of Ukraine "About energy efficiency of buildings".

3. Recommend to local government bodies to implement systems of energy management taking into account requirements of the Procedure approved by this resolution and to determine heads (deputy managers) of relevant organs, responsible for implementation and functioning of system of energy management in such bodies.

4. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

5. To the state agency on energy efficiency and energy saving to give each half a year till February 20 and till August 20 to the Cabinet of Ministers of Ukraine information on condition of accomplishment of this resolution, and also to provide informing the Secretariat of Energy Community on condition of accomplishment of the international obligations of Ukraine concerning providing indicative role of the central executive bodies in increase in level of energy efficiency.

Procedure for implementation of systems of energy management

General provisions

1. This Procedure determines mechanisms and the principles of implementation of systems of energy management and establishes requirements to:

1) to stages of implementation of systems of energy management;

2) to organizational structure and mechanisms of implementation of systems of energy management;

3) to energy policy and its realization of implementation of systems of energy management by bodies;

4) to the energy planning performed by bodies of implementation of systems of energy management;

5) to procedures of realization of obligatory powers of rather energy planning, functioning (current management) of systems of energy management;

6) to monitoring and assessment of indicators of activities and ensuring improvement of systems of energy management;

7) to forming, maintaining and the publication of the national database of energy and operational characteristics of buildings of budgetary institutions, exchange of information with other electronic systems.

2. The terms used in this Procedure have the following value:

1) responsible for system of energy management - the official, responsible for the implementation and functioning of systems of energy management, from among heads (their deputies) of body of implementation of systems of energy management determined according to Item 6 of this Procedure;

2) the declaration of energy policy - the document which determines intentions of body of implementation of systems of energy management concerning implementation, ensuring further functioning and development of systems of energy management, the indicative purposes of body of implementation of systems of energy management and the list of key measures for their achievement;

3) energy monitoring (further - energy monitoring) - system of collection, accumulating, processing and display of data concerning energy consumption amounts / energy resources and utilities by buildings;

4) the power manager - person realizing powers concerning energy planning, functioning of systems of energy management responsible for the organization of effective use of energy / energy resources and utilities;

5) the inventory list of buildings of executive bodies - the structured data set which is created on the basis of data of rather energy and operational characteristics of the heated and conditioned buildings, which joins data on buildings which are in state-owned property and in which the Secretariat of the Cabinet of Ministers of Ukraine and offices of the central executive bodies is placed and the heated area of the building or parts of the building/room in which the Secretariat of the Cabinet of Ministers of Ukraine and offices of the central executive bodies which constitutes more than 250 sq.m is placed, and do not join data on buildings which are carried to objects of cultural heritage or are used during the church services, religious practices and ceremonies; bodies of military management, connections, military units, the highest military educational institutions, military educational units of institutions of higher education, organizations and organizations;
