About introduction of export ban of separate types of manufactured goods
According to articles 29 and 47 of the Agreement on the Eurasian Economic Union of May 29, 2014, subitem 1.5 of Item 1 of the Presidential decree of the Republic of Belarus of April 5, 2016 "About state regulation of foreign trade activity" the Council of Ministers of the Republic of Belarus DECIDES: No. 124
1. Establish temporary ban on export:
out of limits of the Republic of Belarus in state members of the Eurasian Economic Union (further - EEU) goods according to the list according to appendix regardless of country of source (further - goods);
out of limits of customs area of EEU from the Republic of Belarus to the states which are not state members of EEU, the goods placed under customs procedures of export, temporary export, outward processing and re-export (further if other is not determined, - customs procedures).
2. The measure of non-tariff regulation specified in Item 1 of this resolution extends including to goods which are placed under customs procedures in the Republic of Belarus before entry into force of this resolution and whose actual evacuation out of limits of the Republic of Belarus according to customs procedures is performed after entry into force of this resolution.
3. Action of Item 1 of this resolution does not extend to goods:
the Republic of Belarus occurring from the territory, the Russian Federation accompanied with the certificate of origin of the ST-1 form or other certificate confirming the Belarusian or Russian goods origin, the drawn-up authorized on issue of these certificates by the organization, or the conclusion about confirmation of production of industrial output in the territory of the Republic of Belarus or the Russian Federation issued in accordance with the established procedure by the relevant state body;
received (formed) as a result of transactions on conversion on customs area of EEU in Republic of Belarus according to customs procedure conversions on customs area;
made (received) with use of the goods which are earlier placed under customs procedure of free customs zone;
the Republic of Belarus which is exported out of limits under the one-time licenses granted by the Ministry of anti-monopoly regulation and trade in coordination with regional executive committees (The Minsk Gorispolkom) according to the procedure, similar the established Rules of issue of licenses and import permits and (or) commodity import provided by appendix to the Protocol on measures of non-tariff regulation concerning the third countries (appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014) (further - licenses);
being spare parts and the special equipment which is temporarily exported from the territory of the Republic of Belarus, intended for processing, lading protection, maintenance or operation of vehicles of international delivery;
being the multireusable tare (wooden, metal, glass, plastic, special or other) placed under customs procedure of re-export for completion of action of customs procedure of temporary import (admission) or under customs procedure of temporary export;
ATA exported from the Republic of Belarus, earlier imported into the Republic of Belarus using cornet;
placed under customs procedure of temporary export, including using ATA cornet, workers of legal entities to which functions of editorial office of mass media, are assigned by the faces included in structure of sports delegations of the Republic of Belarus, the Belarusian participants of foreign economic activity for the organization of exposure on exhibition and fair actions abroad;
being the vehicles of international delivery which are exported from customs area of EEU;
moved within the international transit carriages which are beginning and coming to an end outside customs area of EEU;
placed under the customs procedures in the state member of EEU other than the Republic of Belarus which are exported from the territory of the Republic of Belarus out of limits of customs area of EEU;
moved within the international transit carriages which are beginning outside customs area of EEU and coming to an end in state member of EEU;
the territories of the Russian Federation moved between parts en route through the territory of the Republic of Belarus;
the Republic of Belarus which is exported out of limits in state members of EEU, and also the states which are not state members of EEU for rendering the international humanitarian assistance to foreign states based on decisions of the Government of the Republic of Belarus, and also as supplies;
exported from the Republic of Belarus to the Russian Federation within the Union State (including en route through the territories of other states);
exported out of limits of customs area of EEU concerning which the State Customs Committee is informed by the interested republican state body or other state organization subordinated to the Government of the Republic of Belarus, regional executive committee (The Minsk Gorispolkom) or administration of free (special) economic zone about need of their export.
4. The interested person (his representative) for receipt of approval of licensing addresses to regional executive committee (The Minsk Gorispolkom) with submission of the following documents:
the letter in any form to approve licensing with reasonable request;
the statement (in duplicate) according to the Instruction about execution of the statement on licensing for export and (or) import of separate types of goods and about execution of such license approved by the Decision of Board of the Eurasian economic commission of November 6, 2014 No. 199;
the document certifying the right to representation of interests of the interested person.
Approval of licensing is performed by regional executive committee (The Minsk Gorispolkom) free of charge within 10 working days.
The bases for refusal in approval by regional executive committee (The Minsk Gorispolkom) of licensing are:
liquidation cases (activities termination), death of the interested person;
submission by the interested person of the documents and (or) data which are not conforming to requirements of the legislation, including false, forgery or invalid documents;
cases when commodity exportation creates threat of homeland security of the Republic of Belarus.
Approval of licensing is performed by regional executive committee (The Minsk Gorispolkom) by putting down on the statement on licensing of the signature of person authorized on approval and impress of a seal of regional executive committee (The Minsk Gorispolkom).
Licensing approval effective period - before date of issue of the license.
5. The license is subject to submission to customs authority when placing under customs procedures.
6. To the Ministry of Foreign Affairs in accordance with the established procedure to notify the Eurasian economic commission on introduction of the measure of non-tariff regulation specified in Item 1 of this resolution.
7. This resolution becomes effective after its official publication and is effective within six months, except for Item 6 and this Item which are becoming effective from the date of adoption of this resolution.
