About approval of Rules of implementation of tourist and recreational activities in the state national natural parks

According to subitem 14-1) of article 8 of the Law of the Republic of Kazakhstan "About especially protected natural territories", I ORDER:

1. Approve the enclosed Rules of implementation of tourist and recreational activities in the state national natural parks.

2. To provide to committee of forestry and fauna of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of implementation of tourist and recreational activities in the state national natural parks

Chapter 1. General provisions

1. These rules of implementation of tourist and recreational activities in the state national natural parks (further - Rules) are developed according to subitem 14-1) of article 8 of the Law of the Republic of Kazakhstan "About especially protected natural territories" and determine procedure of tourist and recreational activities in the state national natural parks (further - national parks).

2. In these rules the following basic concepts are used:

1) the master plan of development of infrastructure (further - the master plan) - the site planning of especially protected natural territory and its infrastructure which is feasibility statement component on creation and expansion of especially protected natural territories;

2) tourist route (further - route) - the transit of the tourist for satisfaction of his requirements which is developed by the tourist operator and includes visit of objects of tourist activities with detailed regulation of such visit (the used transport, places of stop, subjects to visit, the place of lodging for the night, medical care in case of emergency and other conditions);

3) tourist track - the extended land area intended for pedestrian, bicycle or horse (top) type of movement;

4) construction objects - subjects to tourist and recreational appointment which construction is provided by the master plan.

5) ecological tourism - the travel to natural places for the purpose of acquaintance with natural objects and traditional cultures without destruction and withdrawal of their components promoting development of business activity of the citizens living in nearby settlements.

Chapter 2. Procedure of tourist and recreational activities in national parks

Tourist and recreational activities in national parks are performed by placement of subjects to administrative appointment, conducting the economic activity necessary for ensuring protection and functioning of the state national natural park, servicing of his visitors, including the organization of amateur (sports) fishery, fauna public, implementation of construction and operation of the recreational centers, open-air cages for cultivation and content of wild animals, hotels, campings, the museums and other objects of servicing of tourists, the device of camp parking and observation decks, beaches, boat stations, rental centers of water activities of transport and beach stock taking into account regulations of recreational loadings, in zones of tourist, recreational and limited economic activity.

4. Tourist and recreational activities in national parks are performed by directly national park, and also the physical persons and legal entities rendering tourist services.

5. For implementation of tourist and recreational activities sites of national parks (further - sites) are provided to the physical persons and legal entities rendering tourist services in long-term use for a period of five up to twenty five years and short-term use for a period of one year up to five years.

According to Item 3 of article 46 of the Law of the Republic of Kazakhstan "About especially protected natural territories" sites for implementation of tourist and recreational activities are provided according to the master plan of development of infrastructure of the state national natural park and only in zones of tourist, recreational and limited economic activity both with the existing infrastructure, and for creation of new infrastructure.

7. For implementation of tourist and recreational activities national parks place information on the tourist capacity of national parks on official Internet resources of national park and authorized body in the field of especially protected natural territories (further - authorized body).

8. For the organization and use of the device of camp parking and observation decks physical persons and legal entities sign with national park the agreement of short-term use by the site of national park according to Article 393 of the Civil code of the Republic of Kazakhstan.
