Some questions of ensuring functioning of information and communication systems, electronic communication systems, public electronic registers in the conditions of warlike situation

According to the Presidential decree of Ukraine of February 24, 2022 "About introduction of warlike situation in Ukraine" the Cabinet of Ministers of Ukraine decides No. 64:

1. Determine that for action of warlike situation of the ministry, others central and the local executive bodies, the state and utility companies, organizations, the organizations relating to the sphere of their management for ensuring proper functioning of information, information and communication and electronic communication systems, public electronic registers, owners (holders) and/or administrators of which they are, and the information security processed in them, and also protection of the state information resources, can apply such additional measures:

1) to place the state information resources and public electronic registers on cloudy resources and/or in data-processing centers which are located outside Ukraine and to register domain names in the gov.ua domain for such placement;

2) to create additional backup copies of the state information resources and public electronic registers with observance of the requirements established for such resources concerning integrity, confidentiality and availability;

3) to keep backup copies of the state information resources and public electronic registers in encrypted form, including outside Ukraine, on cloudy resources and/or separate physical carriers, and/or in the isolated segment of data-processing centers with observance of the requirements established for such resources concerning integrity, confidentiality and availability;

4) to stop, limit work of information, information and communication and electronic communication systems, and also public electronic registers.

2. Prohibit use of the cloudy resources and/or data-processing centers located in temporarily occupied territory of Ukraine, or those which belong to the state recognized by the Verkhovna Rada of Ukraine the state aggressor or the state invader, or belonging to the state or subjects which activities fall under operation of the Law of Ukraine "About sanctions", on which the decision on application of sanctions in Ukraine and/or other state and in the territories of the states which are included into the custom and military alliances with such states is made.

3. The ministries, others central and the local executive bodies, the state and utility companies, organizations, the organizations relating to the sphere of their management can use the cloudy resources and/or data-processing centers located outside frontier of Ukraine on free or paid basis.

4. To the ministries, another central and to local executive bodies:

without delay to report to Administration of Public service of special communication and information security and the Ministry of digital transformation about use of the cloudy resources and/or data-processing centers located outside Ukraine;

within six months after the termination or cancellation of warlike situation to stop implementation of actions, the stipulated in Item 1 this resolution and to report instantly about the termination of acceptance of the specified measures of Administration of Public service of special communication and information security and to the Ministry of digital transformation.

5. Recommend to other state bodies and local government bodies to be guided in the activities by the provisions provided by this resolution and whenever possible to report to Administration of Public service of special communication and information security and the Ministry of digital transformation about use of the cloudy resources and/or data-processing centers located outside frontier of Ukraine.

6. This resolution becomes effective from the date of its publication and is applied before the termination or cancellation of warlike situation.
