1. Approve Regulations on procedure for compensation of difference in the price for consumption of natural gas for not residential customers in connection with increase in regulated prices for natural gas.

2. This order becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

3. Provisions of this order extend to the period from January to March, 2022.

4. To impose control of execution of this order on the Ministry of Economics and the Ministry of Finance.

Regulations on procedure for compensation of difference in the price for consumption of natural gas for not residential customers in connection with increase in regulated prices for natural gas

Chapter I General provisions

1. The regulations on procedure for compensation of difference in the price for consumption of natural gas for not residential customers in connection with increase in regulated prices for natural gas (further - the Provision) are developed for the purpose of accomplishment of Item 2 of the Order No. 3 of February 1, 2022 of the Commission on emergency situations of the Republic of Moldova.

2. This Provision regulates the mechanism of partial compensation of increase in regulated prices for supply of natural gas for not residential customers of natural gas.

3. Compensation of difference in the price for consumption of natural gas for not residential customers in connection with increase in regulated prices for natural gas is performed monthly for the cold period of year - from November 1, 2021 to March 31, 2022.

The difference entitlement to compensation in the price owing to increase in regulated prices for supply of natural gas in the context of the obligation on rendering public service is granted to not residential customers of natural gas.

5. In the context of this Provision the used concepts mean the following:

not residential customer - physical person or legal entity which buys natural gas from suppliers of natural gas for the purposes other than own domestic needs, except for state bodies and organizations;

the supplier of natural gas - the gas company owner of the license for supply of natural gas delivering natural gas according to the Law No. 108/2016 on natural gas;

regulated price for supply of natural gas in the context of the obligation on rendering public service - the price approved by National regulation agency in power according to the profile legislation and valid at the time of delivery natural gas to not residential customers.

The difference in the price as a result of increase in regulated price for supply of natural gas in the context of the obligation on rendering public service compensated for not residential customers represents difference between the regulated price for supply of natural gas in the context of the obligation on rendering public service in settlement month and the corresponding price in December, 2021.

6. Compensation is provided on one not residential customer irrespective of whether he has one delivery agreement of gas with several places of consumption or several delivery agreements of gas in different places or regions of the Republic of Moldova. Compensation is provided only once in month on one not residential customer, irrespective of the number of suppliers of natural gas with whom delivery agreements of gas are signed.

Chapter II the Method of determination of the amount of compensation of difference in the price

7. Compensation of difference in the price owing to increase in regulated prices for supply of natural gas in the context of the obligation on rendering public service for each not residential customer is calculated as follows:

1) Compensation of difference in the price owing to increase in regulated prices for supply of natural gas in the context of the obligation on rendering public service for each not residential customer constitutes 100% of difference owing to increase in the regulated prices for supply of natural gas in the context of the obligation on rendering public service for the first 500 CBM consumed in month.

2) Calculation of compensation is perfromed proceeding from amount of the consumed gas in all points of consumption (counters) of not residential customer, since the greatest amount of consumption and further on decreasing.

3) Summing of amount of the consumed gas which is subject to compensation is made since the amounts consumed with low pressure and if the consumed amount does not reach value of 500 CBM, the amount consumed with average pressure then the amount is considered with high pressure is considered.

8. Monthly, no later than the 4th of current month, the supplier of natural gas determines the size of the amounts for compensation for the natural gas delivered last month based on provisions of Item 2 of the Order No. 3 of February 1, 2022 of the Commission on emergency situations of the Republic of Moldova and this provision.

9. In the tax delivery notes which are written out addressed to not residential customers total amount for the delivered natural gas according to the prices which are regulated/approved by NARE, compensation amount and the amount which each consumer after recalculation shall pay separately is specified.

10. Compensation of difference in the price is performed to not residential customers who signed delivery agreements of natural gas, suppliers of natural gas with exclusive specifying in the invoice for payment of the separate record giving to the legal entity the grounds for inclusion of this amount of accounting records.

11. The compensation amount for difference in the price is subtracted from the amount due calculated by the supplier of natural gas and is included in the invoice for payment sent to not residential customers.

12. The money provided as compensation of difference in the price is paid to suppliers of natural gas and not issued to not residential customers.
