About approval of the Regulations on territorial administrations of Bureau of economic safety of Ukraine

According to article 21 of the Law of Ukraine "About the central executive bodies", article 14 of the Law of Ukraine "About Bureau of economic safety of Ukraine", to Item 14 of the Regulations on Bureau of economic safety of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of October 06, 2021, No. 1068, for the purpose of ensuring proper work of territorial administrations of Bureau of economic safety of Ukraine, PRIKAZYVAYU:

1. Approve Regulations on territorial administrations of Bureau of economic safety of Ukraine which are applied.

2. Provide to legal department submission of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

3. This order becomes effective from the date of its official publication.

4. I reserve control of execution of this order.

Regulations on territorial administrations of Bureau of economic safety of Ukraine

1. Territorial administrations of Bureau of economic safety of Ukraine (further - territorial administration) are territorial authorities of Bureau of economic safety of Ukraine and submit to it.

2. The territorial administration in the activities is guided by the Constitution of Ukraine, the Law of Ukraine "About Bureau of economic safety of Ukraine", other laws of Ukraine, Presidential decrees of Ukraine, Resolutions of the Verkhovna Rada of Ukraine, acts of the Cabinet of Ministers of Ukraine, orders and orders of BEB, this Provision.

3. The main objectives of territorial administration are:

1) identification of zones of risks in the sphere of economy by the analysis of the structured and unstructured data;

2) risks assessment and threats of economic safety of the state, development of methods of their minimization and elimination;

3) submission of offers on modification of regulatory legal acts concerning elimination of prerequisites of creation of schemes of unlawful activity in the sphere of economy;

4) ensuring economic safety of the state by the prevention, identifications, suppression, investigation of criminal offenses which encroach on functioning of economy of the state in the territory of the respective area;

5) collection and information analysis about the offenses influencing economic safety of the state, and determination of methods of their prevention in the future;

6) planning of actions in the sphere of counteraction to the criminal offenses carried by the law to competence of BEB in the territory of the respective area;

7) identification and investigation of the offenses connected with obtaining and use of the international technical assistance in the respective area;

8) creation of the analytical conclusions and recommendations for state bodies and local government bodies for the purpose of increase in efficiency of acceptance of management decisions by them on regulation of the relations in the sphere of economy.

4. Territorial administration according to the tasks assigned to it:

1) performs operational search activities and pre-judicial investigation within the competence provided by the law in the respective area;

2) carries out information retrieval and analytical and information work with the purpose of identification and elimination of the reasons and conditions promoting making of the criminal offenses carried to competence of BEB in the respective area;

Collects 3), processes and analyzes information concerning the criminal offenses carried by the law to competence of BEB in the respective area;

4) creates analytical materials for the purpose of assessment of threats and risks of making (growth of quantity) of the criminal offenses carried by the law to competence of BEB in the respective area;

5) takes part in forming of banks (bases) of data and takes part in creation on their basis based on modern information and communication technologies of unified information system of BEB;

6) for the purposes of operational search activities and pre-judicial investigation creates information and communication systems (networks) and keeps operational account in amount and procedure, stipulated by the legislation;

7) within the powers provided by the law performs processing of personal data;

8) performs information exchange with other territorial administrations, public authorities, local government bodies, judicial bodies, other state bodies, the companies, organizations and the organizations;

Receives 9), processes and uses information from the automated information and help systems, registers, banks (bases) of data of public authorities, local government bodies, access to which is provided taking into account provisions of article 7 of the Law of Ukraine "About Bureau of economic safety of Ukraine";

10) participates in creation and functioning of the interdepartmental information and analytical systems necessary for accomplishment of the tasks assigned to law enforcement agencies;

11) is performed by implementation and technical maintenance of information, telecommunication and information and communication systems and technologies;

12) is provided by provision to state bodies of information from banks (bases) of data according to the law;

Provides 13) within the powers provided by the law, cryptographic information security which is available in property of territorial administration in the respective area, or information with limited access which requirement concerning protection is determined by the law;

14) takes measures for identification and suppression of the criminal offenses carried to powers of BEB in the territory of the respective area;

15) is performed by timely response to statements and messages on criminal, administrative offenses or events in the limits determined by the law in the respective area;

16) is performed by search of the persons disappearing from bodies of pre-judicial investigation, the investigative judge, court or evading from serving of criminal penalty for making of the criminal offenses carried by the law to competence of BEB in the territory of the respective area;

17) involves within competence with stipulated by the legislation method, including on a contract basis, qualified specialists and experts, including foreigners;

18) ensures safety of persons taken under protection on the bases and according to the procedure, determined by the law, and within its powers;
