For the purpose of ensuring execution of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About protection of atmospheric air" of June 11, 2001 No. 501 of the Cabinet of Ministers of the Azerbaijan Republic decides:

1. Approve "Rules of the state accounting air of the hazardous substances and harmful physical impacts on it which are thrown out in atmospheric", "Rules of issue of special permission to emission of hazardous substances in atmospheric air and harmful physical impacts on it" and "The size and Rules of use of payments for receipt of special permission to emission of hazardous substances in atmospheric air and harmful physical impacts on it" (are attached).

2. Declare invalid the resolution of Council of Ministers of the Azerbaijani SSR "About the resolution of Council of Ministers of the USSR "About approval of the Provision on the state accounting of harmful effects on atmospheric air" of August 12, 1982 No. 746" of August 26, 1982 N396.

3. This resolution becomes effective from the date of signing.

Rules of the state accounting of the hazardous substances and harmful physical impacts on it which are thrown out in atmospheric air

These rules are prepared in connection with execution of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About protection of atmospheric air" of June 11, 2001 No. 501 and establish rules of the state accounting of the hazardous substances and physical impacts on it which are thrown out in atmospheric air.

1. Main objective of the state accounting of harmful effects on atmospheric air is receipt of data on the objects making harmful effects on it, quantity and structure of the hazardous substances released into the atmosphere and also types and scale of harmful physical impacts on the atmosphere.

2. Conducting the state accounting of harmful effects on atmospheric air shall provide the solution of the following questions:

2.1. creation of territorial complex schemes on environmental protection;

2.2. implementation of the actions following from the international obligations of the Azerbaijan Republic on protection of atmospheric air;

2.3. limiting establishment of standard rates of emission of hazardous substances in atmospheric air and harmful physical impacts on it;

2.4. settlement of emission in atmospheric air of hazardous substances and harmful physical impacts on it;

2.5. placement and design of objects, constructions and the equipment, other sources making harmful effects on atmospheric air;

2.6. construction and development of the cities and other settlements;

2.7. forecasting of high-quality change of atmospheric air;

2.8. carrying out the state supervision of protection of atmospheric air;

2.9. informing the population, state bodies and the interested organizations on impurity of atmospheric air;

2.10. other circumstances, stipulated by the legislation on protection of atmospheric air.

3. The state account of harmful effects on atmospheric air is kept by the Ministry of Ecology and Natural Resources of the Azerbaijan Republic and the State committee of statistics of the Azerbaijan Republic.

4. The legal entities and physical persons which are sources of the hazardous substances and harmful physical impacts on it which are thrown out in atmospheric air are put on the state accounting with indication of quantity and structure of the hazardous substances which are thrown out in atmospheric air, types and scale of harmful physical impacts, including gases with greenhouse effect, the substances and physical impacts destroying ozone layer.

5. Lists of the sources of the hazardous substances which are thrown out in atmospheric air put on the state accounting and normalized and physical impacts on it on the companies and the organizations, the cities and other settlements are established and affirm the Ministry of Ecology and Natural Resources of the Azerbaijan Republic and the State committee of statistics of the Azerbaijan Republic based on the sources of the hazardous substances and physical impact on it which are thrown out in atmospheric air this to inventory count.

6. The Ministry of Ecology and Natural Resources performs following in the field of conducting the state accounting of harmful effects on atmospheric air:

6.1. registers the objects making harmful effects on atmospheric air, exercises supervision of the correct conducting by legal entities and physical persons primary accounting of harmful effects on atmospheric air, including of availability and functioning of the constructions and the equipment intended for catching and neutralization of the hazardous substances which are thrown out (orderly and unorganized) from emission sources;

6.2. records the objects making harmful effects on atmospheric air, structure and quantity of the hazardous substances which are thrown out in it on these objects and also types and the scale of harmful effects;

6.3. also the analytical research of statistic reports on harmful effects on atmospheric air performs;

6.4. notifies the State committee of statistics on the list of the companies to which special permission to emission of hazardous substances in atmospheric air and harmful physical impacts is provided.

7. The state committee of statistics performs following in the field of conducting the state accounting of harmful effects on atmospheric air:

7.1. approves the forms of the state statistic reports approved with the Ministry of Ecology and Natural Resources on harmful effects on atmospheric air in the instruction for their filling;

7.2. provides collection and storage of the state statistic reports on harmful effects on atmospheric air;

7.3. performs accounting and research of statistical data in the field of protection of atmospheric air;

7.4. prepares and represents to the Ministry of Ecology and Natural Resources and to other closing state statistic reports interested the organizations for protection of atmospheric air.

8. Legal entities and physical persons have the following obligations in the field of accounting of harmful effects on atmospheric air:
