About approval of Service regulations and uses Pos-terminalov in the territory of the Azerbaijan Republic

1. Approve "Service regulations and uses Pos-terminalov in the territory of the Azerbaijan Republic" (are applied).

1. These rules are prepared according to the Order of the President of the Azerbaijan Republic "About additional measures in the field of enhancement of payment systems in the Azerbaijan Republic" of November 22, 2005 No. 1114.
2. For the purposes of these rules the following basic concepts are used:
2.1. Payment card - plastic (debit or credit) the card used by the card holder for payment of goods, works and services, and also for receipt of cash.
2.2. Transaction - complete or partial payment of goods, works and services to Pos-terminale by means of the international or local payment card.
2.3. The international payment card - the card emitted by the banks operating in the Azerbaijan Republic and being members of the international organizations (Visa, Master Card, etc.), or foreign banks, bearing logo of the international card organizations, used for carrying out transactions within the country and outside the country.
2.4. The local payment card - the card emitted by the banks operating in the Azerbaijan Republic only for use in the territory of the country.
2.5. Pos-terminal - the equipment intended for payment of goods, works and services and also for receipt of cash by means of payment card.
2.6. Service fee - the amount paid to merchant acquirer by business entity for the operation performed through Pos-terminal.
2.7. Business entity - the retail organization for trade, food or other services.
2.8. Merchant acquirer - the bank which provided the Pos-terminala installation on business entity and opened the account for business entity for implementation of transactions through Pos-terminal.
2.9. The user of Pos-terminala - business entity where Pos-terminal is established.
2.10. Service center - the processing center of cards providing processing of the operations performed through Pos-terminal.
2.11. PIN code - the special hidden code identifying the card holder when carrying out transaction to Pos-terminale and issued only to the card holder.
2.12. The stop-list - the list which includes cards according to which transactions are suspended or cancelled.
3. Pos-terminaly, used in the Azerbaijan Republic (further - terminals), shall meet the following technical requirements:
3.1. the terminal shall have the appropriate certificate for acceptance of the international payment cards;
3.2. on the terminal there shall be devices for carrying out transactions by means of cards as on the basis of magnetic tape, and chip (chip);
3.3. on the terminal there shall be PIN keyboard (established in the terminal or as the separate equipment), intended for carrying out transactions by means of the payment cards requiring introduction of the PIN code;
3.4. the terminal can be used in the form of the independent equipment or in the form of integrated into the control cash register.
4. For installation of the terminal:
4.1. the business entity addresses any merchant acquirer and signs the agreement reflecting service fee, the principles of activities and so forth with merchant acquirer. Based on this agreement the merchant acquirer or business entity can be the owner of Pos-terminala;
4.2. the merchant acquirer depending on type of activity of business entity for the user of the terminal will organize training courses on carrying out transactions on the terminal by means of payment cards, and by determination of false cards and provides to features of the international cards the user of the terminal with the written instruction for carrying out daily transactions;
4.3. the merchant acquirer signs the contract with service center on installation of the terminal and servicing of the terminal and represents the copy of the certificate of the established terminal issued by the producer and provided in Item 3.1 of these rules to service center;
4.4. the service center within 1 (one) working day for receipt of registration number sends to the Ministry of taxes of the data, determined by National Bank of the Azerbaijan Republic and the Ministry of taxes of the Azerbaijan Republic;
4.5. The ministry of taxes of the Azerbaijan Republic within 1 (one) working day sends registration number of the terminal to service center;
4.6. after receipt of registration number the service center within 2 (two) working days sends to merchant acquirer the registration leaf of the terminal reflecting the following data:
4.6.1. name and code of business entity;
4.6.2. the address where Pos-terminal is located;
4.6.3. name of ekvayer;
4.6.4. serial number of the terminal;
4.6.5. the registration number issued to the terminal by the Ministry of taxes.
4.7. the merchant acquirer within 3 (three) working days sends the registration leaf of the terminal received by it from service center to business entity;
4.8. after receipt of registration leaf by business entity carrying out transactions on the terminal begins;
4.9. for replacement of the terminal with other terminal or installation of the additional terminal the new terminal shall be registered according to the procedure, provided by these rules;
4.10. in case of liquidation of business entity the service center sends to the Ministry of taxes of the Azerbaijan Republic information that the registration number issued to the terminal is considered invalid.
5. Use of the terminal:
5.1. before transaction the user of the terminal shall check reality of payment card and if necessary shall demand from the card holder to show the document proving his identity;
5.2. in the following cases the user of the terminal shall take measures according to the instruction noted in Item 4.2 of these rules:
5.2.1. if discrepancy between the signature of the card holder on the receipt printed when carrying out transaction on the terminal and the signature which is available on payment card is found;
5.2.2. if when carrying out transaction on the terminal because of technical defect completion of transaction is not possible;
5.2.3. if the user of the terminal determines that the payment card is included in the stop-list.
