About ensuring participation of civilians in protection of Ukraine

Stating the act of the armed aggression of the Russian Federation against sovereignty of Ukraine,

in view of aspiration of civilians to active participation in national resistance,

aiming to protect life and health, honor and advantage, immunity and safety of the person as supreme social value,

considering provisions of part one of article 65 of the Constitution of Ukraine according to which protection of the Fatherland, independence and territorial integrity of Ukraine is obligation of citizens of Ukraine,

The Verkhovna Rada of Ukraine adopted this Law.

Article 1. During action of warlike situation citizens of Ukraine, and also foreigners and stateless persons which on legal causes are in the territory of Ukraine (further - civilians) can participate in repulse and control of the armed aggression of the Russian Federation and/or other states, including to receive firearms and ammunition to it according to the procedure and requirements established by the Ministry of Internal Affairs of Ukraine.

Article 2. Application by civilians of the firearms received according to this Law is performed similar to use of weapons by the military personnel of tasks during execution of them on repulse of the armed aggression against Ukraine according to the procedure, approved by the Cabinet of Ministers of Ukraine.

Article 3. Civilians shall hand over the firearms received by them and unused ammunition to it in bodies of National police of Ukraine no later than 10 days after the termination or cancellation of action of warlike situation in Ukraine.

For violation of the requirement provided by this Article, civilians bear criminal liability.

Article 4. During action of warlike situation citizens of Ukraine can participate in repulse and control of the armed aggression of the Russian Federation and/or other states, using own award weapon, sports weapon (guns, revolvers, rifles, smooth-bore guns), the hunting cut, smooth-bore or combined weapon and ammunition to it.

Article 5. Civilians do not bear responsibility for use of firearms against persons who perform the armed aggression against Ukraine if such weapon is used on the basis and according to the procedure, determined by Article 1 and article 4 of this Law.

Article 6. Final and transitional provisions

1. This Law becomes effective from the date of, its publication following behind day.

2. Operation of this Law extends to all persons who received firearms and ammunition to it in case, of the stipulated in Article 1 this Law, irrespective of date of their issue and is applied during action of warlike situation and 10 days after its termination or cancellation.

3. The Section II "Final and transitional provisions" of the Criminal code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131) to add with Item 22 following of content:

"22. Civilians do not bear criminal liability for use of firearms against persons who perform the armed aggression against Ukraine if such weapon is used according to requirements of the Law of Ukraine "About ensuring participation of civilians in protection of Ukraine".
