Some questions of entering of data into the passport of the citizen of Ukraine for trip abroad

According to article 64 of the Constitution of Ukraine, articles 12-1, 20 of the Law of Ukraine "About legal regime of warlike situation", to the Presidential decree of Ukraine of February 24, 2022 "About introduction of warlike situation in Ukraine" the Cabinet of Ministers of Ukraine decides No. 64:

1. Approve the Temporary procedure for entering of data into the passport of the citizen of Ukraine for trip abroad which is applied.

2. Determine that for action of warlike situation and within year from the date of its termination or cancellation:

1) crossing of border can be performed by citizens of Ukraine at check points through frontier and control Items based on the passport of the citizen of Ukraine for trip abroad which validity is extended, and also children based on the passport of the citizen of Ukraine for trip abroad of their legal representatives in which data on the child are entered;

1-1) The temporary procedure approved by this resolution is applied by the Public migratory service in case of absence in its territorial authorities territorial subdivisions of technical capability of registration (including instead of lost or stolen), exchange and issue of the passport of the citizen of Ukraine to trip abroad of means of the Unified state demographic register, and also due to the need of urgent trip abroad, connected with compelling need in treatment driving off, departure of person who accompanies the seriously ill patient, or the death of the relative who lived abroad;

2) the resolution of the Cabinet of Ministers of Ukraine of May 7, 2014 No. 152 "About approval of sample of the form, technical description and the Procedure for registration, issue, exchange, transfer, withdrawal, return to the state, recognitions invalid and destructions of the passport of the citizen of Ukraine" can be applied to trip abroad with the features provided by this resolution.

2. This resolution becomes effective since March 1, 2022 and is effective within one year from the date of the termination or cancellation of warlike situation.

Temporary procedure for entering of data into the passport of the citizen of Ukraine for trip abroad

1. This Temporary procedure determines the procedure of entering into the passport of the citizen of Ukraine for trip abroad (further - the passport for trip abroad) information on prolongation of term of its action, and also the passport for trip abroad of parents (one of parents), other legal representative of the child (further - legal representatives) information on the child.

2. Information on the child entered in the passport for trip abroad of the legal representative proves the identity and confirms citizenship of Ukraine such child.

3. Entering into the passport for trip abroad of the legal representative of information on the child is performed based on the statement of the legal representative in which passport such information is entered.

4. Documents for entering into the passport for trip abroad of the legal representative of information on the child are filed by it to territorial body / GMS territorial subdivision for the place of the address.

In case of permanent residence or temporary stay of person abroad documents are filed to embassy or consular establishment of Ukraine.

5. In the passport for trip abroad of the legal representative such information on the child is entered:

1) surname and own name;

2) photo of the child;

3) birth date;

4) unique number of entry in the Unified state demographic register (in the presence);

5) date of introduction of information on the child;

6) data of territorial body / GMS territorial subdivision, embassy or consular establishment of Ukraine which entered information (code);

7) the name of position, the signature, surname and initials of person which performed introduction of information.

6. Introduction of information on the child is performed in day of the address of the legal representative free of charge.

7. The legal representative for entering into the passport for trip abroad of information on the child submits the following documents:

1) the passport for trip abroad;

2) the statement for entering into passports for trip abroad of information on the child (further - the statement for introduction of information) in form according to appendix 1;

3) the certificate of birth or the document confirming the birth fact issued by competent authorities of foreign state.

In case of lack of the certificate of birth the legal representative can give extraction from the State register of acts of civil status of citizens about state registration of the birth or show the e-certificate of birth;

4) two photos of the child the size 3, x confirm with 4,5 of centimeter on which image conforms to requirements imposed to photos which move for registration or exchange of identity documents citizenship of Ukraine or the special status of person, and the photographic image on them, the approved order of the Ministry of Internal Affairs of October 18, 2019 to No. 875;

5) the document confirming powers of the person as the legal representative.

Due to the need of urgent trip abroad, connected with compelling need in treatment driving off, departure of person who accompanies the seriously ill patient, or the death of the relative who lived abroad person or his legal representative also files the document confirming need of urgent trip abroad.

The documents issued by competent authorities of foreign state which are filed for entering into the passport for trip abroad of information on the child make sure of the procedure established by the legislation if other is not provided by international treaties of Ukraine. Such documents are filed with the translation into Ukrainian certified notarially.

8. The employee of territorial body / GMS territorial subdivision, embassy or consular establishment of Ukraine performs copying of the data of originals of documents enclosed to the application for introduction, returns them to the legal representative, and encloses copies to the application.

9. Account of statements for introduction of data is kept in register of statements for entering into the passport of the citizen for trip abroad of information on the child (further - register of statements for introduction of data) in form according to appendix 2.
