According to subitem 20-9) of article 11 of the Law of the Republic of Kazakhstan "About tourist activities in the Republic of Kazakhstan" I ORDER:

1. Approve the enclosed Rules of forming, functioning of the priority tourist territories and management by them.

2. To provide to committee of the industry of tourism of the Ministry of Culture and sport of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within three working days after enforcement of this order placement it on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan;

3) within three working days after execution of the actions provided by this Item, submission to Department of legal service of the Ministry of Culture and sport of the Republic of Kazakhstan of data on execution of actions.

3. To impose control of execution of this order on the supervising vice-Minister for Culture and Sports of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming, functioning of the priority tourist territories and management of them

Chapter 1. General provisions

1. These rules of forming, functioning of the priority tourist territories and management are developed by them (further - Rules) according to subitem 20-9) of article 11 of the Law of the Republic of Kazakhstan "About tourist activities in the Republic of Kazakhstan" (further - the Law) and determine procedure for forming, functioning of the priority tourist territories and management of them.

2. In these rules the following basic concepts are used:

1) the priority tourist territory - the territory with special potential of tourist development included in the list of objects of republican level of the card of turistifikation;

2) local executive body (further - MIO) - the collegiate executive body headed by the akim of area, city of republican value and the capital, area (city of regional value), exercising within the competence local public administration and self-government in the corresponding territory;

3) the card of turistifikation - the territories of republican and regional levels which are of interest to tourists;

4) authorized body - the central executive body performing functions of public administration in the field of tourist activities.

Chapter 2. Procedure for forming, functioning of the priority tourist territories and management of them

3. Participants priority tourist the territories are the physical persons and legal entities performing business activity according to the legislation of the Republic of Kazakhstan (further - participants).

4. The priority tourist territories are created by authorized body on the basis of the offered MIO of the tourist territories of republican level included in the Card of turistifikation approved by the order of the Minister for Culture and Sports of the Republic of Kazakhstan of October 27, 2021 No. 332 (it is registered in the Register of state registration of regulatory legal acts at No. 24950), on analysis results of tourist potential (further - the analysis).

5. For carrying out the analysis the authorized body within two working days from the date of receipt of offers of MIO sends them to the organization created by the order of the Government of the Republic of Kazakhstan of July 14, 2017 No. 428 "About creation of joint-stock company "The Kazakh Tourism national company (further - the organization).

6. The organization within fifteen working days from the date of obtaining from authorized body of offers of MIO carries out the analysis and sends its results to authorized body.

7. The analysis includes determination of special value and availability of potential of the priority tourist territory.

8. The authorized body within two working days from the date of receipt of analysis results submits them for consideration of the permanent commission created by authorized body for forming of the list of the priority tourist territories (further - the list).

9. The commission consists of the odd number of members, at least seven people from among whom the chairman and the vice-chairman are appointed.

The commission chairman directs its activities, holds commission sessions. During absence of the chairman of its function the vice-chairman carries out.

Preparation of protocols of commission sessions is performed by the secretary who is not member of the commission.

The chairman, the vice-chairman, the secretary of the commission are appointed from number of persons employed of authorized body.

Representatives of National chamber of entrepreneurs of the Republic of Kazakhstan of Atameken, industry associations, representatives of business also are part of the commission.

The commission holds meetings in process of receipt of offers of MIO, but at least once a year.

10. The commission within two working days from the date of introduction of analysis results by authorized body, considers them and takes out one of the following decisions:

1) about inclusion in the list;

2) about refusal in inclusion in the list;

3) about exception of the list.

11. The basis for refusal in inclusion in the list is unsatisfactory analysis results, carried out by the organization.

12. The decision of the commission is made by vote and deemed accepted if for it the majority of votes from total quantity of the members of the commission participating in meeting is given. In case of equality of votes the decision for which the chairman voted is deemed accepted.

13. The made decision of the commission is drawn up by the protocol.

14. Based on the decision of the commission on inclusion in the list, authorized body enters the territories offered MIO in the list and places them on the Internet resource within two working days from the date of decision making by the commission.

15. For functioning of the priority tourist territories of MIO conditions are created to participants for development of business activity and the investment climate in the territory of the area, the city of republican value, the capital by provision of the investment preferences provided by the Entrepreneurial code of the Republic of Kazakhstan.
