About approval of Rules of accounting of persons containing in pre-trial detention centers of criminal executive system of the Ministry of Internal Affairs of the Republic of Kazakhstan

According to item 4 of article 7 of the Law of the Republic of Kazakhstan of March 30, 1999 "About procedure and conditions of keeping of persons in the special facilities, special rooms providing temporary isolation from society" I ORDER:

1. Approve the enclosed Rules of accounting of persons containing in pre-trial detention centers of criminal executive system of the Ministry of Internal Affairs of the Republic of Kazakhstan.

2. To provide to committee of criminal executive system of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of accounting of persons containing in pre-trial detention centers of criminal executive system of the Ministry of Internal Affairs of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of accounting of persons containing in pre-trial detention centers of criminal executive system of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - Rules) determine procedure for accounting of persons containing in pre-trial detention centers of criminal executive system of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - the SI).

The SI contain persons determined by the subitem 11) of article 2 of the Law of the Republic of Kazakhstan "About procedure and conditions of keeping of persons in the special facilities, special rooms providing temporary isolation from society".

Accounting of persons containing in the SI implies itself:

1) implementation of personal and quantitative accounting;

2) registration and maintaining accounting documents;

3) document creation on convoy;

4) issue of accounting documents.

2. Accounting of persons containing in the SI is performed by departments (departments, groups) of special accounting of the SI (further - department of special accounting).

3. Accounting documents go to persons containing in the SI according to the order of the Attorney-General of the Republic of Kazakhstan of February 27, 2018 No. 29 "About approval of Rules of maintaining and use of special accounting of the faces which made criminal offenses, brought to trial, persons brought to trial for making of criminal offense and dactyloscopic accounting of the detainees who are held in custody and condemned persons" (it is registered in the Register of state registration of regulatory legal acts for No. 16667) in territorial authorities of Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan.

4. All work of department of special accounting will be organized by his chief according to the plan approved by SI management.
