About development of republican monitoring system of public safety

(Extraction)

For the purpose of ensuring functioning and further development of republican monitoring system of public safety (further - monitoring system):

1. Determine that:

1.1. creation of monitoring system is performed at the expense of own means of RUP "Beltelekom" (further - the operator). The operator is contractor (services) in content and operation of monitoring system;

1.2. financing of expenses on acquisition at the operator of works (services) in content and operation of monitoring system is performed proceeding from economically reasonable costs of cost of these works (services) taking into account profitability and quantity of the monitoring system elements which are subject to connection at the expense of the means of the republican budget which are annually provided to the Ministry of Internal Affairs on the specified purposes;

1.3. the organizations and individual entrepreneurs, in property, operational management or economic maintaining which are objects (installation sites) which are subject to the equipment means of elements of monitoring system, except for state-financed organizations, compensate expenses of the republican budget on financing of works (services) in content and operation of monitoring system by money transfer in the income of the republican budget;

1.4. procedure for determination of economically reasonable costs of cost of works (services) in content and operation of monitoring system taking into account profitability, the sizes of cost of such works (services), quantity of the monitoring system elements which are subject to connection, and also procedure and the amount of compensation for expenses of the republican budget on financing of such works (services) by the organizations and individual entrepreneurs specified in subitem 1.3 of this Item are established by Council of Ministers of the Republic of Belarus;

1.5. calculation of cost of the financed works (services) in content and operation of monitoring system do not join the expenses on placement, electric utility service, ensuring safety of the equipment of monitoring system performed at the expense of means of state bodies, other organizations and individual entrepreneurs in property, operational management or economic maintaining which there are buildings, constructions, engineering designs and other objects (installation sites) which are subject to the equipment the means of elements of monitoring system connected to monitoring system;

1.6. the expenses performed by the organizations and individual entrepreneurs according to subitem 1.3 of this Item for the purposes of the taxation are included non-operating expenses in that accounting period in which such expenses are incurred;

1.7. turnovers on realization in the territory of the Republic of Belarus of works (services) in content and operation of monitoring system are not recognized the taxation object the value added tax at the operator;

1.8. for the purpose of calculation of the value added tax and the income tax the organizations, the income tax at individual entrepreneurs, in property, operational management or economic maintaining which have objects (installation sites):

ensuring placement, electric utility service and safety of the equipment of the operator on a grant basis is not recognized the taxation object the value added tax;

the expenses connected with ensuring placement, electric utility service and safety of the equipment of the operator join in costs on production and sales of goods (works, services), property rights (expenses of individual entrepreneurs);

1.9. with use of monitoring system fixing of administrative offenses against traffic safety and operation of transport can be performed (further - offenses). Penalties for the offenses fixed with use of monitoring system are enlisted in the income of the republican budget. The list of the expenses connected with fixing of offenses with use of monitoring system including on conducting administrative process on them, is determined by the Ministry of Internal Affairs in coordination with the Ministry of Finance. Financing of the expenses connected with fixing of offenses with use of monitoring system is performed at the expense of the means of the republican budget which are annually provided to the Ministry of Internal Affairs in the procedure established by the legislation.

2. Make changes to presidential decrees of the Republic of Belarus (appendix).

3. In six-months time to provide to Council of Ministers of the Republic of Belarus reduction of acts of the legislation in compliance with this Decree and to take other measures for its realization.

4. To the Ministry of Internal Affairs to develop together with the Ministry of Communications and Informatization and in coordination with the Prosecutor General's Office, the Presidential Security Service of the Republic of Belarus, Operational analytical center in case of the President of the Republic of Belarus, Department of financial investigations of the State Control Committee, the Investigative Committee, the Ministry of Emergency Situations, Committee for State Security, the State boundary committee, the State Customs Committee technical requirements to the software of system of video analytics of the hardware and software of data-processing centers of the operator (further - the AIC of DPC), qualification requirements to the supplier of such software and to send them to the operator.

5. To the operator:

in six-months time to perform the choice on competitive basis of the supplier and to acquire the software of system of video analytics of the AIC of DPC;

in eight-months time to provide commissioning of the AIC of DPC.

6. This Decree becomes effective in the following procedure:

subitems 1.2-1.9 of Item 1 and Item 2 - in six months after official publication of this Decree;

other provisions of this Decree - after its official publication.
