Some questions of optimization of functioning of the central executive bodies in the sphere sea and inland water transport and navigation

 Cabinet of Ministers of Ukraine decides:

1. Rename Public service of sea and river transport of Ukraine into Public service sea and inland water transport and navigation of Ukraine.

2. Approve Regulations on Public service sea and inland water transport and navigation of Ukraine which is applied.

3. Place Public service sea and inland water transport and navigation on the avenue Beresteysk, 14, in Kiev.

4. Determine that:

certificates, diplomas, classification certificates of members of crews of fishing boats (confirmation to them) and ship's papers of fishing boats which were registered or issued by the State agency of melioration and fishery till January 1, 2022 are effective before the expiration on which they are issued;

after this date the specified documents are issued by Public service sea and inland water transport and navigation.

5. Agree with the offer of the Ministry of infrastructure relatively:

formations of the Danube interregional management and the Cherkassk interregional management of Public service sea and inland water transport and navigation as structural divisions of the office of the specified Service;

renamings of territorial authorities of Public service sea and inland water transport and navigation as structural divisions of the specified Service according to the list according to appendix.

6. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

7. Recognize invalid acts of the Cabinet of Ministers of Ukraine according to the list which is attached.

8. To the ministry of infrastructure, the Ministry of Agricultural Policy and Food in two-month time to submit to the Cabinet of Ministers of Ukraine proposals concerning entering into acts of the legislation of the changes following from this resolution and to bring own regulatory legal acts into accord with this resolution.

Regulations on Public service sea and inland water transport and navigation of Ukraine

1. Public service sea and inland water transport and navigation of Ukraine (Administration of navigation) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine through the Vice-Prime Minister on recovery of Ukraine - the Minister of development of communities and the territories and realizing state policy in spheres sea and inland water transport and navigation.

2. The administration of navigation in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine accepted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

3. The main objectives of Administration of navigation are:

1) realization of state policy in spheres sea and inland water transport and navigation;

2) submitting for examination of the Vice-Prime Minister on recovery of Ukraine – the Minister of development of communities and the territories of offers on ensuring forming of state policy in spheres sea and inland water transport and navigation;

3) ensuring compliance and accomplishment of the obligations undertaken according to international treaties of Ukraine in the sphere sea and inland water transport and navigation;

4) regulation within the powers provided by the law, merchant shipping, navigation on inland waterways;

5) implementation of the state supervision in the sphere sea and inland water transport and navigation;

6) provision in the cases of administrative services provided by the law in the sphere sea and inland water transport and navigation;

7) navigation and hydrographic ensuring navigation in the territorial sea, internal sea waters and on inland waterways of Ukraine.

4. Administration of navigation according to the tasks assigned to it:

1) generalizes practice of application of the legislation on the questions which are within its competence develops suggestions for improvement of legal acts, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, regulatory legal acts of the ministries and in accordance with the established procedure represents them to the Vice-Prime Minister on recovery of Ukraine – to the Minister of development of communities and the territories;

2) is provided by accomplishment of the obligations following from membership of Ukraine in the international organizations which activities are connected with sea and inland water transport, merchant shipping, navigation on inland waterways, in particular:

develops and submits proposals to the Ministry of Infrastructure concerning the list of the acts of the legislation which are subject to development and approval in connection with accomplishment of obligations according to international treaties of Ukraine in the sphere sea and inland water transport and navigation;

develops drafts of acts of the legislation which are directed to accomplishment of obligations according to international treaties of Ukraine, and also such which are directed to accession of Ukraine to international treaties, and will organize project development of such acts;

3) provides preparation of offers of the Ministry of Infrastructure concerning the conclusion, the terminations or suspensions of action, denouncement and accession to international treaties of Ukraine concerning sea and inland water transport, merchant shipping, navigation on inland waterways, develops drafts of the relevant documents;

4) is provided by implementation of the preliminary translations of texts of international treaties of Ukraine concerning sea and inland water transport, merchant shipping and navigation on inland waterways, changes and amendments to them;

5) posts on own official website information for subjects of navigation which concerns documents of the international organizations, in particular, lists of international treaties of Ukraine, changes and amendments to them, the acts of the legislation connected with implementation of international treaties of Ukraine;

6) participates in work of the international organizations;
