1. Approve the enclosed Rules of cost recovery of the guaranteed benefits package from means of the government budget in case of their realization to receivers of the government address public assistance through the portal of social services.

2. To provide to development department of policy of the public assistance of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Sakeev R. K.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of cost recovery of the guaranteed benefits package from means of the government budget in case of their realization to receivers of the government address public assistance through the portal of social services

Chapter 1. General provisions

1. These rules of cost recovery of the guaranteed benefits package from means of the government budget in case of their realization to receivers of the government address public assistance through the portal of social services are developed according to Item 2 of article 4-1 of the Law of the Republic of Kazakhstan "About the government address public assistance" (further - the Law) and determine procedure for cost recovery of the guaranteed benefits package from means of the government budget in case of their realization to receivers of the government address public assistance through the portal of social services.

2. In these rules the following concepts are used:

1) the portal of social services (further – the portal) – information system of the social and labor sphere which represents the object of informatization giving to separate categories of the population opportunity of purchase of goods and (or) services on the terms of compensation of their cost by local executive bodies according to the laws of the Republic of Kazakhstan "About social protection of persons with disability in the Republic of Kazakhstan" and "About the government address public assistance";

2) the guaranteed benefits package (further - GSP) - the help to the needy families having children aged from one year up to eighteen years in the types and amounts determined by the Government of the Republic of Kazakhstan;

3) needy persons (families) are persons (family) having the average per capita income per month below the poverty line, established in areas, the cities of republican value, the capital;

4) authorized body - the local executive body of the city of republican value, the capital, area, city of regional value, the area in the city, the cities of district value performing purpose of the government address public assistance (further - authorized body).

Chapter 2. Procedure for cost recovery of the guaranteed benefits package from means of the government budget in case of their realization to receivers of the government address public assistance through the portal of social services

3. Cost recovery of GSP to the supplier is performed by authorized body within the guaranteed amount on types and amounts of the help provided within the guaranteed benefits package according to paragraph one of Item 7 of article 2 of the Law.

4. Cost recovery of GSP by authorized body is performed based on the statement of the receiver on compensation to the supplier of the guaranteed amount (further - the statement) in form according to appendix to these rules and the supporting scanned documents according to Item 5 of these rules submitted and certified by the digital signature of the supplier on the portal.

5. The supplier no later than 5 (five) working days from the date of implementation of delivery provides in authorized body:

1) the act of the performed works (the rendered services) according to the R-1 form according to appendix 50 to the order of the Minister of Finance of the Republic of Kazakhstan of December 20, 2012 No. 562 "About approval of forms of source accounting documents" (it is registered in the Register of state registration of regulatory legal acts No. 8265);

2) the sheet of receivers of GSP in form, according to appendix 50 to Rules of appointment and payment of the government address public assistance and provision of the guaranteed benefits package, approved by the order of the Minister of health and social development of the Republic of Kazakhstan of May 5, 2015 No. 320 (it is registered in the Register of state registration of regulatory legal acts No. 11426);

3) electronic the invoice according to the order of the First deputy Premier-Ministra of the Republic of Kazakhstan - the Minister of Finance of the Republic of Kazakhstan of April 22, 2019 No. 370 "About approval of Rules of the statement of the invoice electronically in information system of electronic invoices and its forms" (it is registered in the Register of state registration of regulatory legal acts for No. 18583);
