About approval of Rules of appointment and implementation of payments to separate categories of citizens for the dwelling leased in private housing stock

According to the subitem 4) article 10-2 of the Law of the Republic of Kazakhstan "About the housing relations" PRIKAZYVAYU:

1. Approve the enclosed Rules of appointment and implementation of payments to separate categories of citizens for the dwelling leased in private housing stock.

2. To provide to committee on cases of construction and housing and communal services of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of appointment and implementation of payments to separate categories of citizens for the dwelling leased in private housing stock

Chapter 1. General provisions

1. These rules of appointment and implementation of payments to separate categories of citizens for the dwelling leased in private housing stock (further - Rules) are developed according to the subitem 4) of article 10-2 of the Law of the Republic of Kazakhstan "About the housing relations", and determine procedure for appointment and implementation of payments to separate categories of citizens, for the dwelling leased in private housing stock.

2. In these rules the following concepts are used:

1) payments - the state support appointed on a grant basis in the form of compensation paid for the account of budget funds to receivers of payments for the purpose of payment of lease (hiring) of the dwelling in private housing stock. Payments do not include providing on utility payments and other expenses on content of the rented dwelling;

2) the current special account - the current bank account opened by the receiver in JSC Otbasy bank for transfer of payments and implementation of payments on the purposes provided by these rules;

3) the applicant (applicant) - person who submitted the application for receipt of payments within these rules;

4) the receiver - the citizen needing the dwelling and staying on the registry in Single republican electronic base of people on the waiting list and leasing the dwelling in private housing stock in the place of registration;

5) Single republican electronic base of people on the waiting list - electronic base of registration and priority of the citizens needing the dwelling from the state housing stock or the dwelling leased by local executive body in private housing stock;

6) JSC Otbasy bank - the bank having the license of authorized body on regulation, control and supervision of the financial market and the financial organizations, being the financial operator and performing appointment, implementation, the termination and renewal of payments to receivers;

7) authorized body in the sphere of the housing relations - the central executive body performing management and cross-industry coordination in the sphere of the housing relations and housing and communal services;

8) the dwelling - the separate residential unit (the individual apartment house, the apartment, the room in the hostel) in primary or secondary markets intended and used for permanent residence, answering to the established construction, sanitary, environmental, fire protection and other obligatory standards, rules.

9) family members are the spouses, minor children including adopted (adopted) and the children who are studying full-time in the organizations of secondary, technical and professional, postsecondary, higher and (or) postgraduate education after achievement of age of majority by them until the termination of the organizations of education (but no more than before achievement of twenty-three-year age).

Chapter 2. Procedure for calculation of the amount of payments

3. Payments for the dwelling leased in private housing stock are performed on the parity basis of 50% at the expense of budgetary funds and 50% by the receiver.

At the same time, 50% of payment at the expense of budgetary funds make expenses of 80% from the republican budget and 20% from the local budget provided in the relevant budget for each financial year to the separate categories of citizens staying on the registry in Single republican electronic base of people on the waiting list and to relevant requirements of these rules.

4. Payments cannot be used on the purposes which are not provided by these rules.

5. Payments are not performed in case of lease of housing from the state housing stock, housing stock of public institutions and the companies.

6. The size of the cost of 1 sq.m of lease for the dwelling leased by the receiver in private housing stock is calculated on the basis of the MRP annual level to coefficients of area, the cities of republican value and the capital, on the following formula:

The coefficients of area, the cities of republican value and the capital applied when calculating the size of the cost of 1 sq.m. of lease for the dwelling leased by the receiver in private housing stock are established according to appendix 2 to these rules

The cost of 1 sq.m of lease for the dwelling depends on the MRP size and is recalculated annually and is valid from January to December of the corresponding calendar year.

7. Payments go through JSC Otbasy bank which services are paid based on the service provision agreement signed with authorized body in the sphere of the housing relations within the means provided by the law on the republican budget for the corresponding financial years according to calculation of cost of services of JSC Otbasy bank for implementation of housing payments to separate categories of citizens for the dwelling leased in private housing stock according to appendix 1 to these rules.

Chapter 3. Procedure for appointment and implementation of payments

8. The authorized body in the sphere of the housing relations sends to JSC Otbasy bank the list needing the dwelling, consisting in Single national information system of accounting of people on the waiting list created by local executive bodies, at the request of JSC Otbasy bank within 3 (three) working days.
