About approval of Rules of monitoring procedure of completeness, transparency and reliability of the state inventory count of emissions and absorption of greenhouse gases
According to Item 5 of article 302 of the Ecological code of the Republic of Kazakhstan and with the subitem 2) Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics", PRIKAZYVAYU:
1. Approve the enclosed Rules of monitoring procedure of completeness, transparency and reliability of the state inventory count of emissions and absorption of greenhouse gases.
2. To provide to department of climatic policy and green technologies of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication;
3) within ten working days after state registration in the Ministry of Justice of the Republic of Kazakhstan of this order submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.
3. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of monitoring procedure of completeness, transparency and reliability of the state inventory count of emissions and absorption of greenhouse gases (further - Rules) are developed according to Item 5 of article 302 of the Ecological code of the Republic of Kazakhstan (further - the Code) and determine procedure for monitoring procedure of completeness, transparency and reliability of the state inventory count of emissions and absorption of greenhouse gases (further - the state inventory count).
2. In these rules the following concepts and determinations are used:
1) the Intergovernmental Panel on Climate Change - the body of the United Nations (further - the UN) founded jointly by the World Meteorological Organization and the United Nations Environment Programme in 1988 responsible for assessment of the scientific knowledge connected with climate change and development of methodology of assessment of emissions of greenhouse gases;
2) category of key sources - category which in the national survey cadastre occupies one of priority places as its assessment has significant effect on the general inventory of direct emissions of greenhouse gases from the point of view of the absolute level of emissions, tendencies of emissions or that and another;
3) the operator of system of trade in carbon units - the subordinated organization for regulation of emissions of greenhouse gases of authorized body in the field of environmental protection (further - the Operator) providing technical and expert maintenance of state regulation and international cooperation in the sphere of emissions and absorption of greenhouse gases;
4) recalculation - the procedure of repeated assessment of anthropogenic emissions of greenhouse gases from sources and their absorption by absorbers specified in earlier provided inventories owing to changes in methodologies, changes in methods of obtaining and use of factors of emissions and data on activities or inclusion of new categories of sources and absorbers;
5) the state system of inventory count of emissions and absorption of greenhouse gases - set of the organizational actions for collection, processing, storage and data analysis necessary for determination of the actual amounts of emissions and absorption of greenhouse gases in the Republic of Kazakhstan for the corresponding period;
6) quality control - system of regular technical work on measurement and quality control of the inventory of sources of emissions and absorption of greenhouse gases in process of its development, in process of its creation;
7) quality assurance - planned system of procedures of the consideration performed by employees who are not involved directly in process of development and compilation of inventories, for the purpose of check of accomplishment of tasks in the field of quality of data, ensuring the maximum accuracy of the inventory, from the point of view of assessment of emissions and absorption taking into account the present level of scientific knowledge and the available data, and support of efficiency of the quality test program.
Other terms and determinations used in these rules are applied according to the ecological legislation of the Republic of Kazakhstan.
3. Actions for planning, preparation, the organization of annual state inventory of emissions and absorption of greenhouse gases (further - the state inventory count) it is performed within twelve months, since April 15 of the year following after accounting year.
4. The procedure for monitoring procedure of completeness, transparency and reliability of the state inventory count is performed by means of annual control of functioning of the state inventory count and ensuring the principles of transparency, coordination, comparability, completeness and accuracy of inventories, according to Item 6 of the Decision of the Conference of the Parties operating as the Meeting of the Parties to the Kyoto Protocol 19/CMP.1 of November 30, 2005 "The guidelines for national systems according to Item 1 of Article 5 of the Kyoto protocol" (further - the Decision 19/CMP.1).
5. The organization and coordination of functioning of the state system of inventory count are performed by authorized body in the field of environmental protection (further - authorized body) according to Item 3 of article 302 of the Code.
6. The procedure for monitoring procedure of completeness, transparency and reliability of the state inventory count consists of the following stages:
organization of interdepartmental Working group;
representation of basic data following the results of functioning of the state inventory count;
development and verification of the National report on the inventory of anthropogenic emissions from sources and absorption by absorbers of the greenhouse gases which are not regulated by the Montreal protocol (further - the National report) and tables of general format of the reporting (further - OFO) following the results of annual functioning of the state inventory count according to the subitem and) Item 1 of Article 4 of the Decree of the President of the Republic of Kazakhstan of May 4, 1995 No. 2260 "About ratification of the framework Convention of the Organization of the United Nations on climate change" (further - RKIK UN).
7. For the purpose of providing the first stage of monitoring procedure of completeness, transparency and reliability of the state inventory count and compliance, the authorized body creates the interdepartmental Working group on functioning of the state system of inventory count of greenhouse gases (further - the Working group).
8. The working group is created under the chairmanship of the representative of authorized body and consists of the representatives of authorized body, the Operator, state bodies and the organizations which are responsible for accomplishment of all functions according to the subitem and) Item 10 of the Decision 19/CMP.1.
9. The first meeting of the Working group takes place no later than April 30 annually. Dates of the subsequent meetings of the Working group are determined following the results of the first meeting.
